HomeMy WebLinkAbout2009-03-12-Special MinutesWAUKEE CITY COUNCIL MINUTES SPECIAL MEETING MARCH 12,2009 A)Call to Order -The special meeting of the Waukee City Council was called to order by Mayor Pro Tern Harvey at 5:05 p.m.in the Waukee City Council Chambers. B)Roll Call -The following members were present:Council Members Donald L.Bailey,JI.;Casey L. Harvey;Mike Watts.Absent:Mayor William F.Peard;Council Members C.Isaiah McGee,Darlene Stanton. Also present:City Administrator/Clerk Jeffrey L.Kooistra,Director of Public Works John Gibson, Assistant to the City Administrator McKinlee Gibson,Deputy City Clerk Rebecca D.Schuett. C)Agenda Approval-Council Member Watts moved to approve the agenda;seconded by Council Member Bailey.Roll call:Ayes:Watts,Bailey,Harvey.Nays:None.Absent:McGee,Stanton. Motion carried 3 -0 -2. D)Resolution:Consideration of approval of a resolution authorizing approval of condemnation awards regarding the 105'"Street/Alice's Road Overpass of 1-80 Project,IDOT No.HDP- 8177(606)-71-25 -Council Member Watts moved to approve the resolution;seconded by Council Member Bailey.Richard Scieszinski,West Des Moines City Attorney,summarized the property purchase and condenmation process to date for the project,adding that the condemnation board approved the city-appraised price for all three properties to be condemned.Council Member Watts felt that the appraised price was still too high.MI.Scieszinski stated that one of the affected property owners had indicated that he would appeal the decision of the condenmation board unless the cities payed $300,000 more than was awarded,then spoke briefly about the appraisal process and "highest and best use"of property.He voiced his opinion that the appraisals were accurate.Council Member Bailey agreed that the appraisals were fair,which was proven by the decision of the condemnation board.Council Member Harvey added that the cities should not speculate on land values.Linda Robel,9075 Linda's Ln.,West Des Moines,addressed the council to express her frustration with the Alice's Road/105'h Street road alignment,adding that the proposed alignment would be more costly than that initially planned 19 years ago.She then stated that her property was being condenmed only for the use of-dirt on the property as fill and that the project would ruin her land and certain sources of income.Council Member Watts called for the question.Roll call:Ayes:Watts,Bailey,Harvey. Nays:None.Absent:McGee,Stanton.Motion carried 3 -0 -2.(Resolution #09-52) E)Resolution:Consideration of approval of a resolution authorizing approval and acceptance of purchase agreement and deed for the lOS'"Street/Alice's Road Overpass of 1-80 Project,IDOT No. HDP-8177(606)-71-25 -Council Member Watts moved to approve the resolution;seconded by Council Member Bailey.Roll call:Ayes:Watts,Bailey,Harvey.Nays:None.Absent:McGee, Stanton.Motion carried 3 -0 -2.(Resolution #09-53) F)Resolution:Consideration of approval of a resolution authorizing approval and acceptance of tenant purchase/relocation agreement for the 105'"Street/Alice's Road Overpass of 1-80 Project, mOT No.HDP-8177(606)-71-25 -Council Member Bailey moved to approve the resolution; seconded by Council Member Watts.Roll call:Ayes:Bailey,Watts,Harvey.Nays:None.Absent: McGee,Stanton.Motion carried 3 -0 -2.(Resolution #09-54) G)Comments 1 Adjournment -Council Member Watts moved to adjourn;seconded by Council Member Bailey.Ayes: All.Nays:None.Motion carried 3 -O.
