(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 7:04 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Donald L.Bailey,Jr.;Casey L.Harvey;C.Isaiah McGee;Darlene Stanton;Mike Watts.Absent:
None.
Also present:City Administrator/Clerk Jeff Kooistra,Assistant to the City Administrator
McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Assistant Director of Public Works Tim Royer,Director of Development Services Brad Deets,
City Planner Ben Landhauser,Deputy City Clerk Rebecca D.Schuett,City Engineer Mikelis
Briedis,City Attorney Steve Brick.
(D)Open Forum -Kim Cavanaugh,3515 150'h St.in Urbandale,requested an amendment to the
City ordinance to allow her to open a temporary Tropical Sno business.She noted the creation of
jobs (or high school athletes,involvement in the school and community,and Warrior Plaza as a
possible location for the proposed business.
(E)Agenda Approval-Council Member Watts moved to approve the agenda;seconded by Council
Member McGee.Roll call:Ayes:Watts,McGee,Bailey,Harvey,Stanton.Nays:None.Motion
carried 5 -O.
(F)Mayor's Report -Last week,Mayor Peard traveled to Washington,D.C.with Council Members
McGee and Stanton and City Administrator/Clerk Kooistra,as well as representatives from the
City of West Des Moines,regarding funding for the Alice's Road Corridor project.On 03/28,he
attended the ribbon cutting for West Bank.Upcoming appointments include "Business After
Hours"at Community State Bank on 04/08,a ribbon cutting for Teacher Tools 4 Tomorrow on
04/09,and the Waukee Area Chamber of Commerce luncheon on 04/16.
(G)Presentations:
I)Waukee Downtown Master Plan -Monica Haddad,assistant professor at Iowa State
University with the Department of Community and Regional Planning,gave a brief
PowerPoint presentation on the plan.She also reviewed the planning process and made note
of the good relationship between her department and the Waukee downtown business
association.Council Member Watts wondered if the plan was too aggressive;Prof.Haddad
replied that it is a 20-year plan and was similar to that included in the 2008 Comprehensive
Plan.Joe Schmidt,1490 SE Primrose Dr.and a Planning &Zoning Commissioner,asked if
the plan required the development of new zoning districts;Prof.Haddad answered that the
City's existing zoning district classifications would be used.Director of Planning Deets
briefly reviewed the planning process,adding that the plan was intended as a marketing tool
for the downtown area.He mentioned the positive comments he'd received regarding the
ISU students who worked on the plan,and added that Council action to approve the plan was
scheduled for a later date.Lyn Schafer,450 6th St.and a representative of the downtown
business group,also spoke on the positive experience she had with the ISU group.Council
Member McGee asked how this plan compared with previous plans for the downtown area;
Ms.Schafer answered that this plan continues with the village aspect and a pedestrian-
friendly atmosphere,but includes more open space.Council Member Watts stated that the
plan would require a large commitment from the City,advocating for a future relocation of
City Hall back to the downtown area.The Council expressed their thanks to the ISU group
for their work on the plan.Larry Crannell of Charter Bank also expressed his thanks,then
asked the Council to consider implementing the plan as soon as possible.
(H)Public Hearings:
1)On a proposal to temporarily dispose of an interest in real property owned by the City and
located at 4106'"Street,Waukee,Iowa -Mayor Peard opened the public hearing and asked
if any written correspondence had been received;City Administrator/Clerk Kooistra replied
in the negative.No comments were made by the public present.Mayor Peard declared the
public hearing closed.
(I)Public Hearing Action Items:
1)Resolution:Consideration of approval of a proposal to dispose of the City's interest in the
property locally known as 410 6'"Street,Waukee,Iowa,by short term lease to the Waukee
American Legion -Council Member Watts moved to approve the resolution;seconded by
Council Member Bailey.Roll call:Ayes:Watts,Bailey,Harvey,McGee,Stanton.Nays:
None.Motion carried 5 -O.(Resolution #09-69)

Finance Management (PFM)presented the bid tabulation,noting that the low bid was non-
conforming.While the City cannot legally accept the non-conforming bid,PFM recommends
rejecting all bids and negotiating with the low bidder on terms not less favorable,pursuant to

10)Ordinance:Consideration of approval of an ordinance to amend Chapter 203,Waukee
Municipal Code,by repealing the existing rates for water and enacting new rates as
specified [third (final)reading]-Council Member Watts moved to approve the third reading
of the ordinance in title only and place the ordinance on final passage;seconded by Council
Member Stanton.Council Member Stanton noted that she'd received an anonymous note
from someone who thought the rates were too high when compared with other surrounding
communities,adding that the figures in the letter were incorrect,Council Member Watts
stated that he also received the letter.Council Member Bailey suggested that council
members who might have ideas for preventing a rate increase should bring those ideas
forward for consideration;otherwise,he didn't see any way to avoid the proposed increase at
this time.Council Member McGee wondered if there was something that could've been done
earlier so that the Council would not feel obligated to raise rates.Council Member Watts
replied that the rates needed to be increased in order to pay for city infrastructure and to keep
bonding capacity in good standing.Director of Public Works Gibson added that the cash
flow created by a rate increase was necessary in order to cover City debt payments,noting
that other communities were also raising utility rates this year due to the economic downturn.
Council Member Bailey mentioned general costs associated with providing clean water.
Council Member McGee voiced the opinion that the Council needed to review the rates in the
context of the overall budget;City Administrator/Clerk Kooistra noted that the rates had been
