(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 7 :02 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call -The following members were present:Mayor William F.Peard;Council Members
Donald L.Bailey,Ir.;Casey L.Harvey;C.Isaiah McGee;Mike Watts.Absent:Darlene Stanton.
Also present:City Administrator/Clerk IeffKooistra,Assistant to the City Administrator
McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Director of Development Services Brad Deets,City Planner Ben Landhauser,Fire Chief Clint
Robinson,Deputy City Clerk Rebecca D.Schuett,City Engineer Forrest Aldrich,City Attorney
Steve Brick.

(E)Agenda Approval-Council Member Harvey moved to approve the agenda;seconded by
Council Member McGee.Roll call:Ayes:Harvey,McGee,Watts,Bailey.Nays:None.Absent:
Stanton.Motion carried 4 -0 -I.
(F)Mayor's Report -Mayor Peard noted the Greater Des Moines Partnership's "I Believe"kickoff
event taking place that evening.He and his wife Linda helped with the Waukee High School
after prom party.On OS/09,he will attend the Waukee Fire Association pancake breakfast.On
04/30,Mayor Peard,City Administrator/Clerk Kooistra and Assistant to the City Administrator
Gibson met with Mayor Steve Gaer and City Manager IeffPomeranz of the City of West Des
Moines regarding the lOS'h St./Alice's Road Corridor project.On OS/08,he and City
Administrator/Clerk Kooistra will attend a meeting with Sen.Kames,followed by a tour of the
Alice's Road Corridor area.Mayor Peard will attend the SMART Conference on OS/07,and a
Waukee Exec Call to Mustang Media on OS/06.
(G)Presentations:
1)Quarterly report from Waukee Public Library,Waukee Fire Department -Reports made by
Library Director Maryann Mori,Fire Chief Clint Robinson.
2)City of Waukee Website -Assistant to the City Administrator Gibson and City Planner
Landhauser reviewed some highlights of the new website,which is scheduled to go live this
evenmg.
(H)Public Hearings:
1)On the adoption of plans and specifications,proposed form of contract and estimate of cost
for Raccoon River Valley Trail Improvements for the City of Waukee,Iowa -Mayor Peard
opened the public hearing and asked if any written correspondence had been received;City
Administrator/Clerk Kooistra replied in the negative.No comments were made by the public
present.Mayor Peard declared the public hearing closed.
2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
amending Section 301.9,A-I Agricultural District,to add provisions regulating vineyards-
Mayor Peard opened the public hearing and asked if any written correspondence had been
received;City Administrator/Clerk Kooistra replied in the negative.No comments were
made by the public present.Mayor Peard declared the public hearing closed.
(I)Public Hearing Action Items:
1)Resolution:Consideration of approval of a resolution adopting plans and specifications,
form of contract and estimate of cost for Raccoon River Valley Trail Improvements-
Council Member Harvey moved to approve the resolution;seconded by Council Member
McGee.Director of Development Services Deets noted a public meeting scheduled for 05/06
with property owners adjacent to the project area.Richard Voelker and Brenna Fall of
Snyder &Associates presented an overview of the project.Council Members McGee and
Watts asked if the project would impact future improvements at the 5-way stop intersection at
Warrior Lane;Mr.Deets replied in the negative.Council Member McGee asked about the
section of trail that would cross Hickman Road at 6th Street;Mr.Deets answered that a traffic
analysis of that intersection was included as part of the project,with plans to work with IDOT
to signalize the intersection in the future.Mr.Voelker stated that the low bidder for the
project was Grimes Asphalt &Paving Corp.of Grimes,IA.Roll call:Ayes:Harvey,McGee,
Bailey,Watts.Nays:None.Absent:Stanton.Motion carried 4 -0 -I.(Resolution #09-100)
2)Resolution:Consideration of approval of a resolution making award of construction
contract for Raccoon River Valley Trail Improvements -Council Member Bailey moved to
approve the resolution;seconded by Council Member Watts.Roll call:Ayes:Bailey,Watts,
Harvey,McGee.Nays:None.Absent:Stanton.Motion carried 4 -0 -I.Contract awarded
to Grimes Asphalt &Paving Corp.of Grimes,IA.(Resolution #09-101)
3)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa,by amending Section 301.9,A-I Agricultural District,to
add provisions regulating vineyards [introduction;first reading]-Council Member McGee
introduced the ordinance.Motion by Council Member Bailey to approve the first reading of
the ordinance in title only;seconded by Council Member McGee.Director of Development
Services Deets briefly reviewed the rezoning request made by Kurt Schade,who intends to
use the property in question for a win elY and to host special events.The proposed ordinance
would restrict the size and type of special events held on the property.Mr.Schade has
already obtained a Class "A"Native Wine liquor license,which does not require council
approval.Council Member Bailey asked about water connection fees and future rights-of-
way related to the property;Mr.Deets replied that all fees associated with the property and
improvements have been paid,but the future rights-of-way have yet to be resolved.Council
Member Bailey stated that right-of-way issues needed to be addressed at this time.Council
Member Watts expressed frustration that the applicant was sidestepping city ordinances by
conducting commercial activities on an agriculturally zoned property,and that Mr.Schade
had not been upfront about his current plans for the property.Council Member Harvey stated
that he would support the ordinance if the right-of-way and easement issues were settled.He
then asked who would enforce the ordinance,whether the term "private event"was clearly
defined in the proposed ordinance,and if the proposed use was too commercial.Council
Member McGee asked how other communities have addressed similar issues;Mr.Deets
replied that Waukee's issue was unique,as the majority of wineries in the state are located in
unincorporated county areas and not within municipalities.Council Member Watts stated
that the property should no longer be zoned as A-I,noting surrounding zoning and the
property's location within the city.Roll call:Ayes:Bailey,McGee,Harvey.Nays:Watts.
Absent:Stanton.Motion carried 3 -I -I.Deputy City Clerk Schuett read the ordinance in
title only.

4)Ordinance:Consideration of approval of an ordinance to amend Chapter 502,Waukee
Municipal Code,Traffic Regulations of the City of Waukee,Iowa,by adding to Section
502,"Parking Regulations,"certain public streets as specified (SE Cypress Court,SE
Applewood Lane,SE Olson Drive)[second reading]-Council Member Watts moved to
approve the second reading of the ordinance in title only;seconded by Council Member
Bailey.Mike Mahoney,co-owner of SportsPlex West,addressed the Counc:i:1to state that the
parking issues along SE Olson Drive that are a result of events at his place of business only
occur during the winter months.He also noted that "no parking"on both sides of SE Olson
Drive would increase safety issues,as patrons would then park along SE Frontier Drive and
be forced to wallc in the street as there are limited sidewalks along that street.Mr.Mahoney
suggested either "no parking"only on the north side of SE Olson Drive or "no parking"on
both sides of SE Olson Drive to the west of the entrance to his parking lot.Director of
Development Services Deets clarified that no parking was allowed on the south side of SE
Olson Drive because of mailbox locations.Council Member Harvey wished to explore the
option of allowing parking on the south side of SE Olson Drive.Council Member McGee
expressed the opinion that safety would continue to be an issue if parking were allowed on
the south side of SE Olson Drive,asking if there were still available parking in the SportsPlex
West lot.Mr.Mahoney replied that sometimes the lot is full.Council Member Bailey asked
if Mr.Mahoney were able to expand the parking lot;Mr.Mahoney responded that they
owned an adjacent lot to the south of SportsPlex West,but that they plarmed to use it as green
space.Council Member Bailey suggested relocating the mailboxes to allow for parking on

the south side of SE Olson Drive.Council Member Harvey also suggested a mailbox cluster.
Jim Woodworth,705 SE Olson Drive,addressed the Council on various concerns regarding
SE Olson Drive,including inadequate street width,lighting issues,and speeding.Roll call:
Ayes:Watts,Bailey,Harvey,McGee.Nays:None.Absent:Stanton.Motion carried 4 -0-

5)Discussion:City Administrator/Clerk performance evaluation process -City Attorney
Brick stated that he'd received requests from the Council on ways to improve the City
Administrator/Clerk performance evaluation process.He referenced a letter sent to the mayor
and council by his office with some suggestions.The Council discussed several possible
changes to the process,including a "1 to 3"evaluation scale,no anonymous evaluation forms
in light of full disclosure,the inclusion of the mayor in the evaluation process,and a mid-year
interim review.
