(B)Pledge of Allegiance (C)Roll Call-The following members were present:Council Members Donald L.Bailey,JI.;Casey L.Harvey;C.Isaiah McGee.Absent:Mayor William F.Peard;Council Members Darlene Stanton,Mike Watts. Also present:City Administrator/Clerk Jeffrey L.Kooistra,Assistant to the City Administrator McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson, Assistant Director of Public Works Tim Royer,Director of Development Services Brad Deets, City Planner Ben Landhauser,Deputy City Clerk Rebecca D.Schuett,City Engineer Forrest Aldrich,City Attomey Steve Blick. (F)Mayor's Report (G)Presentations: 1)Denman &Company on upcoming FY2009 audit -Presentation made by J oann Tucker of Denman &Company.David Ellis of Denman &Company was also in attendance. 2)Quarterly report from Waukee Area Chamber of Commerce -Report made by Chamber President Paul Hassebroek, (II)Public Hearings: 1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein from A-I [Agricultural District}to C-4 [Office Park Commercial District]and then by rezoning and changing certain property therein from C-4 [Office Park Commercial District]to PD-I [Planned Development Overlay District];and amend the Official Zoning Map to show rezoning (a parcel known as Fox Green Office Park)-Mayor Pro Tem Harvey opened the public hearing and asked if any written correspondence had been received;Kooistra replied in the negative.Bill Ludwig, architect/urban planner for the proposed office park,offered to answer any questions the Council had about the proposal and gave some examples of "green"amenities planned within the office park.Council Member McGee asked if there were any existing "green"office parks to which the Council could refer;Mr.Ludwig replied that a list of such sites would be presented when site plans were submitted for approval.Mayor Pro Tem Harvey declared the public hearing closed. (I)Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein from A-I [Agricultural District]to C-4 [Office Park Commercial District}and then by rezoning and changing certain property therein from C-4 [Office Park Commercial District}to PD-I [Planned Development Overlay District};and amend the Official Zoning Map to show rezoning (a parcel known as Fox Green Office Park)[introduction;first reading]-Council Member Bailey introduced the ordinance and moved to approve the first reading of the ordinance in title only;seconded by Council Member McGee.Director of Development Services Deets briefly presented the rezoning request.Council Member Harvey asked who would verify if buildings within the office park met LEEDS standards;Mr.Deets explained that Development Services staff would review the submittals.Council Member Harvey asked about bike trails within the office park;Mr.Deets replied that a trail planned along SE Swallow Ave.would connect with other city trails planned for the area.Council Member Bailey expressed doubt that permeable roads and parking would be effective in this climate; Bill Ludwig,architect/urban planner for the proposed office park,stated that they hoped to use such "green"amenities in certain test areas and asked that the council be open to their efforts.Roll call:Ayes:Bailey,McGee,Harvey.Nays:None.Absent:Stanton,Watts. Director of Development Services Deets briefly reviewed the site plan.He noted that a portion of the property has been designated a Waterway of the United States and that a 10 lengthy application process with the Army Corp of Engineers was required by the developer in order to move forward with the outdoor amenities as shown in the Planned Development Narrative approved by the Council when the parcel was rezoned.Council Member McGee wondered about the timeline for completion of the outdoor amenities;Dave Smith of Equity Growth Group replied that approval from the Army Corp of Engineers would take 3-4 months,adding that Iowa Finance Authority regulations regarding Section 42 tax credits mandated the proposed outdoor amenities.Council Member McGee asked when the outdoor amenities would be installed;Mr.Smith answered that the amenities must be in place before a certificate of occupancy could be issued by the City.Council Member Bailey moved to approve the resolution contingent upon the completion of all amenities as depicted on Exhibit A within the Planned Development approved by the City Council on July 20,2009,prior to a final certificate of occupancy being issued for the Motion carried 3 -0 -2.(Resolution #09-167) 7)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by amending Section 301.8 to add provisions regulating wind energy systems [third (final)reading]-Council Member Bailey moved to approve the 11 third reading of the ordinance in title only and place the ordinance on final passage;seconded by Council Member McGee.Roll call:Ayes:Bailey,McGee,Harvey.Nays:None.Absent: Stanton,Watts.Motion carried 3 -0 -2.Deputy City Clerk Schuett read the ordinance in title only;Mayor Pro Tem Harvey declared the ordinance duly adopted.(Ordinance #2652) 8)Discussion:Douglas Parkway alignment -Director of Public Works Gibson noted two possible alignments for the Douglas Parkway Improvements Proj ect:1)a northern alignment, which would required the relocation of nnmerous MidAmerican Energy electrical poles at a cost of over $1 million to be paid entirely by the City of Waukee,and 2)a southern alignment,which would require the purchase of several houses for much less money and with the costs associated with the project split between Waukee and Clive.Council Member Bailey asked if the purchase of the houses could be avoided if the Douglas Parkway medians were removed;Mr.Gibson replied in the negative.Council Member Bailey asked if the affected property owners had been notified of the possible purchase of their property;Mr. Gibson replied that they had been notified that Douglas Parkway would be improved to four lanes in the future,but not about the possible property purchase.He added that two of the affected property owners had already expressed a willingness to sell to the City.Council Member Harvey stated that,while he didn't like the idea of pur chasing the houses,he felt the southern alignment was the best and most cost effective option.Council Member Bailey also voiced support for the southem alignment,adding that it would be beneficial to inform the affected property owners of the need to purchase their property for the project.When asked about a timeline for improving Douglas Parkway to four lanes,Mr.Gibson stated that it would likely not take place for many years.
