(B)Pledge of Allegiance (C)Roll Call -The following members were present:Mayor William F.Peard;Council Members Shane Blanchard,Dan Dutcher,Casey L.Harvey,Darlene Stanton,Mike Watts.Absent:None. Also present:City Administrator/Clerk Jeffrey L.Kooistra,Assistant to the City Administrator McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson, Director of Development Services Brad Deets,City Planner Ben Landhauser,Administrative Coordinator Beth Richardson,City Engineer Mikelis Briedis,City Attorney Steve Brick. (D)Open Forum -Chet Chedester,220 Waukee Avenue,thanked the Council for considering revisions to the sign ordinance that would allow advertising for businesses.Mr.Chedester also expressed concern with potential increases in gas rates and the use of property taxes and TIF monies.Council Member Watts discussed how the gas rates affect employee pay and the building of new facilities.He also asked Mr.Chedester for documentation showing Waukee gas rates 30%higher than MidAmerican Energy,as Mr.Chedester claimed. (E)Agenda Approval -Council Member Watts moved to approve the agenda;seconded by Council Member Dutcher.Roll call:Ayes:Watts,Dutcher,Harvey,Stanton,Blanchard.Nays: None.Motion carried 5 -O. (F)Mayor's Report -Mayor Peard attended the Waukee Goal Setting Session,WEDCO (Waukee Economic Development Corporation)meeting,and the Park Comprehensive Planning open house.He will attend the Greater Des Moines Partnership Annual Dinner on Thursday and the MPO meeting on 01/21. (G)Presentations: 1)Recognition of outgoing citizen commissions,committee,and board members- Mayor Peard recognized the followinq with Certificates of Appreciation: Dan Dutcher,Planning and Zoning Commission Heather Hassebroek,Planning and Zoning Commission Shane Blanchard,Park Board Steve Schmiedt,Park Board John Wemer,Utilities Committee 2)Consideration of approval of a resolution of appreciation for Jerry Steele for his 20 years of service as a member of the Planning and Zoning Commission -Council Member Harvey moved to approve the resolution;seconded by Council Member Stanton. Roll call:Ayes:Harvey,Stanton,Blanchard,Dutcher,Watts.Nays:None.Motion carried 5 -O.Mayor Peard read the resolution and presented a framed copy to Mr.Steele. (Resolution #10-14 ) 3)Consideration of approval of a resolution of appreciations for Dan Gardiner for his 13 years of service as a member of the Park Board -Council Member Watts moved to approve the resolution;seconded by Council Member Harvey.Roll call:Ayes:Watts, Harvey,Blanchard,Dutcher,Stanton.Nays:None.Motion carried 5 -O.Mayor Peard read the resolution and presented a framed copy to Mr.Gardiner.(Resolution #10-15) 4)Waukee Public Library,Fire Department quarterly reports -Reports made by Library Director Maryann Mori and Fire Chief Clint Robinson. 5)Iowa Communities Assurance Pool (ICAP)-PowerPoint presentation made by Mark Currie and Kasi Koehler of the Iowa Communities Assurance Pool (ICAP). (H)Public Hearings: 1)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein to modify PD·1 [Planned Development Overlay District](Legacy Pointe at Waukee)-Mayor Peard opened the public hearing and asked if any written correspondence had been received;City Administrator/Clerk Kooistra replied that several pieces of correspondence had been received including a letter dated 01/16/2010 from Richard Bengston,1705 SE Holiday Crest Circle.Josh Cowman of Ewing Land Development Services explained that the zoning request was due to market changes,adding that the proposed Memory Care Facility would fulfill promises made for the development to meet all of the aging needs of the retirement community.Council Member Dutcher voiced his support of the project but would like to see additional landscaping in Lot 7 as a condition of approval.Council Member Stanton expressed concern with changing the integrity of the development,stating her desire to see no more decreases in the development of townhomes and that she would like to see greenery in the Memory Care Facility area.1)Kelly Mallory,representing her parents at 1530 SE Golden Harvest Drive, spoke against the rezoning request,expressing concern over losing the sense of community. 2)Wanda Bredice,1600 SE Holiday Crest Circle,spoke in favor of the rezoning request, noting her husband's recent diagnosis of Alzheimer's Disease.3)Brad Schumacher,365 SE Sagewood Circle,spoke against the rezoning due to concerns with property values, traffic flow,and lighting.He presented a petition with 28 signatures from area single-family residents opposing the project.4)Richard Bengston,1705 SE Holiday Crest Circle,spoke against the rezoning,expressing concern with the number of times the original Development Agreement and design of Legacy Pointe had been revised.5)Brandon Richards,480 SE Waco Place,voiced concern with a compromise of the overall aesthetics of the neighborhood.Mayor Peard declared the public hearing closed. (I)Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein to modify PD·1 [Planned Development Overlay District](Legacy Pointe at Waukee) [introduction,first reading]-Council Member Watts introduced the ordinance and moved to approve the first reading of the ordinance in title only;seconded by Council Member Stanton.Council Member Harvey voiced his support for the project with no other reduction in the number of town homes,noting that the property to the west is slated to be developed as rental apartments which would increase traffic flow in that area and not around the proposed Memory Care Facility.He added that the facility fits well with the initial conceptual design.Council Member Dutcher thanked the developer for working to address the concerns of the Planning and Zoning Commission and the residents.He then explained that the Memory Care Facility would provide more green space than the townhome project, adding that he would like the developer to enhance that green space.Council Member Watts stating that he would not support the project in light of the number of petitions received against it.Roll Call:Ayes:Stanton,Dutcher,Harvey.Nays:Watts,Blanchard.Motion carried 3 -2.
