(B)Pledge of Allegiance (C)Roll Call-The following members were present:Mayor William F.Peard;Council Members Shane Blanchard,Dan Dutcher,Casey L.Harvey,Darlene Stanton,Mike Watts.Absent:None. Also present:Assistant to the City Administrator McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,Assistant Director of Public Works Tim Royer, Director of Development Services Brad Deets,City Planner Ben Landhauser,Deputy City Clerk Rebecca D.Schuett,City Attorney Steve Brick. (D)Open Forum -Cindy DePond of the Waukee Area Arts Council briefly reviewed the group's programming in the past year and requested additional funding from the City for fiscal year 2011. (E)Agenda Approval -Council Member Stanton moved to approve the agenda;seconded by Council Member Watts.Roll call:Ayes:Stanton,Watts,Harvey,Dutcher,Blanchard.Nays: None.Motion carried 5 -O. (F)Mayor's Report -Mayor Peard is preparing for a trip to Washington,D.C.with Council Member Stanton,Director of Development Services Deets,and representatives from the City of West Des Moines to lobby for funding for the Alice's Road Corridor.He will attend an MPO meeting on 02/25. (G)Presentations: 1)Waukee Area Chamber of Commerce quarterly report -Report made by Waukee Area Chamber of Commerce Director Chad Airhart. (H)Public Hearings: 1)On the proposition of the issuance of not to exceed $1,500,000 General Obligation Bonds (for an Essential Corporate Purpose)of the City of Waukee,Iowa -Mayor Peard opened the public hearing and asked if any written correspondence had been received; Deputy City Clerk Schuett replied in the negative.No comments were made by the public present.Mayor Peard declared the public hearing closed. (I)Public Hearing Action Items: 1)Resolution:Consideration of approval of a resolution instituting proceedings to take additional action for the issuance of not to exceed $1,500,000 General Obligation Bonds -Council Member Watts moved to approve the resolution;seconded by Council Member Harvey.Director of Finance Burkhart noted the projects to be funded by the bonds. Nays:None.Motion carried 5 -O.(Resolution #10-42) 2A)Mayor's Appointment:Of a substitute Mayor Pro Tern to serve from March 1,2010 to March 5,2010 -Mayor Peard appointed Council Member Harvey as substitute Mayor Pro Tem for the time during which both the Mayor and Council Member Stanton are in Washington,D.C.on the Alice's Road Corridor lobbying trip. 3)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein to modify PD-1 [Planned Development Overlay District](Legacy Pointe at Waukee)[third (final)reading]-Council Member Watts moved to approve the third reading of the ordinance in title only and place on final passage;seconded by Council Member Harvey.Roil call:Ayes: Watts,Harvey,Stanton,Blanchard,Dutcher.Nays:None.Motion carried 5 -O.Following the roll call vote and at the request of certain persons in attendance,Mayor Peard asked for comments from the floor.Speaking against the rezoning:Kelly Mallory on behalf of parents Allen and Beulah Mallory,1530 SE Golden Harvest Drive;Sharilyne Leonard,address not given;Beulah Mallory,1530 SE Golden Harvest Dr.;Richard Bengsten,1705 SE Holiday Crest Cir.;Colleen Monahan,130 SE Legacy Pointe Blvd.;and William Lawson,1540 SE Golden Harvest Dr.Council Member Watts stated that he had initially voted against the rezoning but now supported it due to low traffic numbers,increased green space,and his belief that a memory care center was the least intrusive use of the property if it were not developed as town homes.Council Member Dutcher explained that he supported the rezoning because of the amount of green space,the residential character of the proposed memory care center,and his belief that such a faciiity would not decrease property values in the area. Council Member Stanton noted that the proposed memory care center would be a good fit for the neighborhood and would look similar to a series of town homes,then spoke about enhanced berming,landscaping and green space.Council Member Harvey agreed that the proposed memory care center would fit well in the area and would be a good transitional project between the town homes and the property to the west,adding that the facility would be quiet with low traffic.Council Member Blanchard noted that he had also initially voted against the rezoning but now supported it because of positive changes in the plan and his belief that the memory care center would make the Legacy Pointe community a complete package for senior needs.At this time,Council Member Watts moved to reconsider approval of the third reading of the ordinance.Motion failed due to lack of a second.(Ordinance #2662) 4)Resolution:Consideration of approval of construction drawings for Legacy Pointe at Waukee Plat 6 -Council Member Watts moved to approve the resolution;seconded by Council Member Dutcher.Director of Development Services Deets briefly reviewed the construction drawings.Roll call:Ayes:Watts,Dutcher,Blanchard,Stanton,Harvey.Nays: None.Motion carried 5 -O.(Resolution #10-43) 5)Resolution:Consideration of approval affinal plat for Legacy Pointe at Waukee Plat 6- Council Member Dutcher moved to approve the resolution;seconded by Council Member Harvey.Director of Development Services Deets briefly reviewed the final plat.Roll call: Ayes:Dutcher,Harvey,Watts,Blanchard,Stanton.Nays:None.Motion carried 5 -O. (Resolution #10-44) 6)Resolution:Consideration of approval of site plan for Legacy Pointe Memory Care Center-Council Member Stanton moved to approve the resolution;seconded by Council Member Dutcher.Director of Development Services Deets briefly reviewed the site plan. Council Member Stanton asked for clarification on the height of light poles and whether they were fully shielded;Mr.Deets replied that the poles were 20 feet tall and the fixtures were fully shielded,adding that City staff would work with the applicant to address any possible light spillage.Roll call:Ayes:Stanton,Dutcher,Blanchard,Watts,Harvey.Nays:None.Motion carried 5 -O.(Resolution #10-45) 6 7)Ordinance:Consideration of approval of an ordinance to amend Chapter 305,Sign Ordinance of the City of Waukee,Iowa [second reading]-Council Member Blanchard moved to approve the second reading of the ordinance in title only;seconded by Council Member Harvey.Council Member Harvey asked if time limits similar to those proposed for electronic changeable signs should be imposed for alternating time/temperature signs;City staff will clarify the language before the third reading.Council Member Harvey also asked that off-premise signs along arterial corridors be addressed in the future.Roll call:Ayes: Blanchard,Harvey,Dutcher,Watts,Stanton.Nays:None.Motion carried 5 -O.Deputy City Clerk Schuett read the ordinance in title only. 8)Ordinance:Consideration of approval of an ordinance to amend Chapter 502,Waukee Municipal Code,Traffic Regulations of the city of Waukee,Iowa,by adding to Section 502,"Parking Regulations,"certain public streets as specified (SE Olson Drive) [introduction;first reading]-Council Member Watts introduced the ordinance and moved to approve the first reading of the ordinance in title only;seconded by Council Member Stanton. Director of Development Services Deets referenced an e-mail from the owners of Sports Plex West asking the City Council to reconsider approving the proposed ordinance.The Council cited ongoing traffic and safety issues in the area as the impetus behind the proposed ordinance.Roll call:Ayes:Watts,Stanton,Blanchard,Harvey,Dutcher.Nays:None.Motion carried 5 -O.Deputy City Clerk Schuett read the ordinance in title only.
