SPECIAL MEETING
December 13,2010
A)Call to Order -The special meeting of the Waukee City Council was called to order by Mayor
Peard at 5:39 p.m.in Waukee City Hall.
B)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Dan Dutcher,Casey L.Harvey,Mike Watts.Absent:Council Member Darlene
Stanton.
Also present:Director of Development Services Brad Deets,Director of Finance Linda Burkhart,
Director of Public Works John Gibson,Deputy City Clerk Rebecca D.Schuett,City Attorney
Steve Brick.
C)Agenda Approval-Council Member Watts moved to approve the agenda;seconded by Council
Member Harvey.Roll call:Ayes:Watts,Harvey,Dutcher,Blanchard.Nays:None.Absent:
Stanton.Motion carried 4 -a -1.
D)Resolution:Consideration of approval of an amended and restated Developers Agreement
between Team Technologies,LLC,as successor-in-interest to Team Technologies,L.C.-
Council Member Watts moved to approve the resolution;seconded by Council Member Dutcher.
Director of Development Services Deets briefly reviewed the amended agreement,including a
two-year extension for the completion of Phases II and III,and a surety bond related to
completion of the final exterior wall.Council Member Harvey asked that in future development
agreements,City staff be included in addition to the City Attorney as the parties to approve the
form of surety bond.Council Member Watts stated that allowing frequent amendments to
development agreements did not offer much incentive for completing construction;Mr.Deets
replied that,in the case of Team Technologies,the amended agreement would likely spur the
construction of the remaining phases more quickly than if there was no amendment.Roll call:
Ayes:Watts,Dutcher,Blanchard,Harvey.Nays:None.Absent:Stanton.Motion carried 4 -a -

Adjournment -Council Member Harvey moved to adjourn;seconded by Council Member Blanchard.
Ayes:All.Nays:None.Motion carried 4 -O.
