(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:32 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call -The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Dan Dutcher,Casey L.Harvey.Absent:Council Member Mike Watts.
Also present:City Administrator/Clerk Jeffrey L.Kooistra,Assistant to the City Administrator
McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Director of Development Services Brad Deets,City Planner Ben Landhauser,Deputy City Clerk
Rebecca D.Schuett,Fire Chief Clint Robinson,Library Director Erik Surber,City Engineer
Mikelis Briedis,City Attorney Steve Brick.
(D)Open Forum -Jeramy Marean,839 Collins Dr.,requested that the City reexamine the hunting
ordinance.He noted that the current ordinance only allows hunting on agriculturally zoned
property of more than 40 acres,and that most of the applicable property within City limits had
been rezoned in recent years.He asked that hunting be allowed on property that had been
rezoned but was still being farmed.City staff will research the matter.
(E)Agenda Approval -Council Member Dutcher moved to approve the agenda;seconded by
Council Member Harvey.Results of vote:Ayes:Blanchard,Dutcher,Harvey.Nays:None.
Absent:Watts.Motion carried 3 -0 -1.
(F)Mayor's Report -On 10/11,the Iowa Department of Transportation announced that Waukee
was awarded a $5.3 million RISE grant for the Alice's Road Corridor Project.Mayor Peard took
part in the Waukee Volunteer Firefighter Pancake Breakfast and the Raccoon River Valley Trail
(Waukee to Dallas Center segment)ribbon cutting on 10/15.This weekend is the Haunted
House at Centennial Park,and soon the Iowa Department of Transportation will be considering
the IJR application related to on-and off-ramps at the Alice's Rd./105'h St.Interchange.
(G)Presentations:
1)Sum mas,LC,Hickman Road access request -Presentation made by William Lillis on
behalf of Summas,LC.Also in attendance were Adam Van Dike and Dr.Denny Languith.
Mr.Lillis asked for approval by the City Council to move forward with an application to the
Iowa Department of Transportation for a right-in/right-out access for Warrior Station from
Hickman Road.The application would not include a median crossover.As required by an
existing agreement related to the Hickman Road corridor,the applicant has already secured
approval of the access request from the cities of Clive and Urbandale.Mayor Peard asked
for City staff's opinion on the request;Director of Public Works Gibson voiced staff concerns
over 1)safety,specifically the possibility of increased traffic accidents due to the proximity of
the proposed access to Warrior Lane and Carefree Lane,and 2)setting a precedent by
allowing the access.Addressing the safety concern,Council Member Dutcher stated that
the proposed access seemed to be set further away from existing intersections than most,
adding that an independent third party engineer,agreeable to both the applicant and City
staff,should conduct the required traffic study.If the results of the study demonstrate that
the access point is reasonable,Council Member Dutcher would recommend the access.
Council Member Blanchard echoed a concern over safety,but that he would need to see the
results of the traffic study.Council Member Harvey agreed with the need for a traffic study,
expressing concern that the proposed access was located within an existing deceleration
lane on Hickman Road.He added that the proposed access,if approved,could help
alleviate traffic congestion on SE Carefree Lane and that he would be more concerned with
the proposed access if a traffic signal was planned for the Hickman Road/Carefree Lane
intersection.City Attorney Brick asked if there were plans to widen Hickman Road and how
such improvements would affect the proposed access;Director of Development Services
Deets responded that Hickman Road could be expanded to six lanes in the future.Mr.Lillis
added that any lOOT approval of the proposed access would likely be contingent on future
widening of Hickman Road.
2)Waukee Public Library quarterly report -Presentation made by Library Director Erik
Surber.
3)Waukee Fire Department quarterly report -Presentation made by Fire Chief Clint
Robinson.
(H)Public Hearings:
1)On an annexing moratorium agreement between the Cities of Waukee and Dallas
Center -Mayor Peard opened the public hearing and asked if any written correspondence
had been received;City Administrator/Clerk Kooistra replied in the negative.No comments
were made by the public present.Mayor Peard declared the public hearing closed.
2)On the proposed sale of real property owned by the City of Waukee,Iowa,and legally
described as Lots 2,3 and 4 of Clayton Commons Plat 1 -Mayor Peard opened the
public hearing and asked if any written correspondence had been received;City
Administrator/Clerk Kooistra replied in the affirmative,noting that a proposal had been
received from Marean Construction for the purchase of Lots 3 and 4 at $31,000 each.Greg
Marean of Marean Construction addressed the Council,stating that his company had
purchased Lots 1 and 5 and he did not desire someone else building between his lots.He
added that he could not afford to purchase all three lots at this time.Mayor Peard declared
the public hearing closed.
(I)Public Hearing Action Items:
1)Resolution:Consideration of approval of a resolution approving a 28E agreement
providing for an annexing moratorium for a period of ten years between the Cities of
Waukee and Dallas Center-Council Member Harvey moved to approve the resolution;
seconded by Council Member Dutcher.Director of Development Services Deets briefly
reviewed the agreement and the proposed annexation borderline.Council Member Harvey,
who had taken part in discussions with the City of Dallas Center on the matter,explained the
reasoning behind the proposed borderline.Results of vote:Ayes:Blanchard,Dutcher,
Harvey.Nays:None.Absent:Watts.Motion carried 3 -a -1.(Resolution #11-199)
2)RESOLUTION:Consideration of approval of a resolution approving the sale of real
property legally described as Lots 2,3 and 4 of Clayton Commons Plat 1 and
authorizing the mayor to sign documents on behalf of the City of Waukee related to
the sale of said property -Council Member Harvey moved to approve the resolution;
seconded by Council Member Blanchard.Director of Development Services Deets briefly
reviewed the purchase offer from Ryan T.Beattie and referenced the Marean Construction
offer for Lots 2 and 3.Council Member Dutcher suggested that City staff contact Mr.Beattie
and see if the City could accommodate him with three different lots and recommended
tabling the matter;Council Member Harvey replied that there were no truly comparable lots
within Clayton Commons Plat 1.Council Member Dutcher also expressed concern that the
sale price of the lots in Clayton Commons Plat 1 continued to decrease.Council Member
Harvey voiced his approval of tabling the matter as long as the City continued to move
forward on selling the lots.Council Member Blanchard added that he would like to see the
same builder continue to purchase lots in the area.Council Member Harvey amended the
motion to table consideration of the resolution;Council Member Blanchard amended the
second.Results of vote:Ayes:Blanchard,Dutcher,Harvey.Nays:None.Absent:Watts.
Motion carried 3 -0 -1.Motion tabled.
(J)Action Items
1)Consent Agenda:Council Member Harvey moved to approve the Consent Agenda,
removing consideration of the $7,612.50 payment to HR-OneSource from the Bill List;

seconded by Council Member Dutcher.Council Member Harvey noted that City staff was
researching the HR-OneSource bill in question.Results of vote:Ayes:Blanchard,Dutcher,
Harvey.Nays:None.Absent:Watts.Motion carried 3 -0 -1.

3)Resolution:Consideration of approval of a resolution adopting the Downtown Design
Guidelines as an amendment to the Downtown Master Plan -Council Member Harvey
moved to approve the resolution;seconded by Council Member Blanchard.City Planner
Landhauser briefly reviewed the process involved to arrive at the proposed guidelines,as well
as certain aspects of the guidelines themselves.Council Member Harvey asked how the grant
program for facade improvements fit in with the proposed guidelines and whether the district
eligible for the grant program would be expanded;Mr.Landhauser replied that it would be
more appropriate at this time for the grant program to apply to properties within the C-2 zoning
district.Mayor Peard expressed his hope that the new community center would set a
precedent for redevelopment in the downtown area.Results of vote:Ayes:Blanchard,
Dutcher,Harvey.Nays:None.Absent:Watts.Motion carried 3 -0 -1.(Resolution #11-202)
