(B)Pledge of Allegiance (C)Roll Call -The following members were present:Mayor William F.Peard;Council Members Shane Blanchard,Dan Dutcher,Shelly Hughes,Mike Watts.Absent:Council Member Casey L. Harvey. Also present:Interim City Administrator Brad Deets,Assistant to the City Administrator McKinlee Gibson,Director of Finance Linda Burkhart,Assistant Director of Public Works Tim Royer,City Planner Ben Landhauser,Fire Chief Clint Robinson,Code Compliance Officer Keith Rash, Deputy City Clerk Rebecca D.Schuett,City Engineer Mikelis Briedis,City Attorney Steve Brick. (D)Open Forum (E)Agenda Approval-Council Member Watts moved to approve the agenda;seconded by Council Member Dutcher.Results of vote:Ayes:Blanchard,Dutcher,Hughes,Watts.Nays: None.Absent:Harvey.Motion carried 4 -0 -1. (F)Mayor's Report -Mayor Peard participated in OS/28 Memorial Day services in Waukee. (G)Presentations:None (H)Public Hearings: 1)On plans,specifications,proposed form of contract and estimate of cost (1&1Manhole Rehabilitation Project)-Mayor Peard opened the public hearing and asked if any written correspondence had been received;Interim City Administrator Deets replied in the negative. No comments were made by the public present.Mayor Peard declared the public hearing closed. 2)On an ordinance to repeal Chapter 222 of the Municipal Code of the City of Waukee, Iowa,and to adopt by reference the 2009 Edition of the International Codes (I- CODESTM)with local amendments -Mayor Peard opened the public hearing and asked if any written correspondence had been received;Interim City Administrator Deets referenced an e-mail received from the Homebuilders Association of Greater Des Moines.Creighton Cox,representing that organization,addressed the Council to request that 1)ordinance Section R313.1 delete the sprinkler system requirement for all townhomes and instead insert language that sprinkler systems not be required for R-1 and R-2 residential buildings of not more than twelve dwelling units with no less than two means of eqress and not more than three stories above grade,including back-to-back configurations;and 2)ordinance Section R313.2 delete the sprinkler system requirement for all one-and two-family dwellings and instead insert language that sprinkler systems be required throughout all individual dwelling units that exceed 8,000 square feet of dwelling space.Mr.Cox noted that the ordinance as presented would create the most restrictive sprinkler system requirements in the metro area, with Johnston as the second most restrictive.Fire Chief Robinson addre~~d the Council to review the proposed fire code amendments,including sprinkler system requirements,certain fees,and licensing for life safety contractors through the West Des Moines Fire Department. Regarding townhome sprinkler systems,Chief Robinson agreed the proposed requirements would be the most restrictive in the metro area,comparing commercial sprinkler requirements with the proposed residential requirements.Council Member Blanchard mentioned liability concerns,adding that he did not want Waukee to have the most restrictive metro area sprinkler requirements.Council Member Dutcher agreed with Council Member Blanchard,but also expressed concern with life safety.Council Member Watts suggested that the first reading of the ordinance be approved as presented and that the Council review the changes requested by the Homebuilders Association prior to the second reading. Council Member Hughes also asked for time to review the suggested changes,adding that life safety was a higher priority than money.Mayor Peard stated that other metro area communities that had adopted less restrictive sprinkler system regulations must have done so after much research on safety issues.He then suggested that Mr.Cox meet with City staff to review the concerns of the Homebuilders Association.Mayor Peard declared the public hearing closed. (I)Public Hearing Action Items: 1)Resolution:Consideration of approval ofa resolution approving plans,specifications, form of contract and estimate of cost (/&1 Manhole Rehabilitation Project)-Council Member Dutcher moved to approve the resolution;seconded by Council Member Hughes. Assistant Director of Public Works Royer briefly reviewed the project.Council Member Watts asked if the storm sewer intake at 151 St.and Bel Aire Dr.would be repaired as part of the project;Mr.Royer replied that the intake was scheduled for repair this summer.Results of vote:Ayes:Blanchard,Dutcher,Hughes,Watts.Nays:None.Absent:Harvey.Motion carried 4 -0 -1.(Resolution #12-129) 2)Resolution:Consideration of approval of a resolution awarding contract (1&1Manhole Rehabilitation Project)-Council Member Dutcher moved to approve the resolution awarding contract to Drake Construction of Menlo,IA;seconded by Council Member Blanchard.Results of vote:Ayes:Blanchard,Dutcher,Hughes,Watts.Nays:None.
