HomeMy WebLinkAbout2012-06-18-Regular MinutesWAUKEE CITY COUNCIL MINUTES June 18,2012 (A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor Peard at 5:33 p.m.in the Council Chambers at City Hall. (B)Pledge of Allegiance (C)Roll Call -The following members were present:Mayor William F.Peard;Council Members Shane Blanchard,Dan Dutcher,Casey L.Harvey,Shelly Hughes,Mike Watts.Absent:None. Also present:Interim City Administrator Brad Deets,Assistant to the City Administrator McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,City Planner Ben Landhauser,Fire Chief Clint Robinson,Deputy City Clerk Rebecca D.Schuett,City Engineer Forrest Aldrich,City Attorney Steve Brick. (D)Open Forum -Kurt Schade,1230 Warrior Ln.and owner of Schade Creek Winery,described recent incidents where Waukee Police Department officers were called to his property in response to complaints about parked cars.When Mr.Schade contacted Dallas County Dispatch about the incidents,they had no record of a filed complaint.Mr.Schade said that he witnessed Council Member Watts driving slowly past his property,then speeding off.He had also been told by a local business that stocks his product that Council Member Watts had been speaking negatively about Schade Creek Winery to an employee of that business.He accused Council Member Watts of using his influence as a council member to pursue a personal vendetta against Mr.Schade,stating his belief that it is inappropriate that Council Member Watts have any future vote on matters concerning the Schade Creek Winery and requesting the City Council take further action. (E)Agenda Approval -Council Member Harvey moved to approve the agenda;seconded by Council Member Dutcher.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts. Nays:None.Motion carried 5 -O. (F)Mayor's Report -On 06/07,Mayor Peard attended the 2011 Citizen of the Year reception.He wished the Chris Colter family well as they move from Waukee,On 06/21,Mayor Peard will attend the MPO Policy Committee meeting and the Waukee Area Chamber of Commerce annual golf outing. (G)Presentations:None (H)Public Hearings: 1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein from C-1A [Neighborhood Commercial District]to C-2 [Downtown Village District]and amend the Official Zoning Map to show rezoning (Sunrise Beginnings)-Mayor Peard opened the public hearing and asked if any written correspondence had been received;Interim City Administrator Deets replied in the negative.No comments were made by the public present.Mayor Peard declared the public hearing closed. 2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein from A-1 [Agricultural District]to R-2 [One and Two Family Residential District]and amend the Official Zoning Map to show rezoning (Booth Farm)-Mayor Peard opened the public hearing and asked if any written correspondence had been received;Interim City Administrator Deets replied in the negative. No comments were made by the public present.Mayor Peard declared the public hearing closed. (I)Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein from C-1A [Neighborhood Commercial District]to C-2 [Downtown Village District]and amend the Official Zoning Map to show rezoning (Sunrise Beginnings)[introduction; first reading]-Council Member Harvey introduced the ordinance and moved to approve the first reading in title only;seconded by Council Member Blanchard.Interim City Administrator Deets and City Planner Landhauser briefly reviewed the application and proposed site plan,noting that the project elevations would likely change prior to site plan approval.Council Member Harvey stated that he had attended the Planning &Zoning Commission meeting in the place of Council Member Dutcher,giving a brief overview of the commission's discussion regarding building setbacks and C-2 zoning district requirements. (Resolution #12-146) 12)Resolution:Consideration of approval of a resolution approving FY2013 non- represented city employee wages and wage matrix adjustment -Council Member Dutcher moved to table consideration of the resolution until the July 2 regular City Council meeting; 11 seconded by Council Member Watts.Results of vote:Ayes:Blanchard,Dutcher,Harvey, Hughes,Watts.Nays:None.Motion to table carried 5 -O. 13)Ordinance:Consideration of approval of an ordinance to repeal Chapter 222 of the Municipal Code of the City of Waukee,Iowa,and to adopt by reference the 2009 Edition of the International Codes (I-CODESTM)and more specifically the International Building Code,the International Residential Code,the International Existing Building Code,the International Fuel Gas Code,the International Mechanical Code,the International Plumbing Code,the International Property Maintenance Code,the International Energy and Conservation Code,the International Fire Code;and by reference the 2011 National Electrical Code to regulate the erection,construction,enlargement,alteration,repair, moving,removal,conversion,demolition,occupancy,equipment,use,height,area and maintenance of buildings and structures,including installation of mobile,manufactured and modular homes;to provide for the issuance of permits and collection of fees;and to provide penalties for violations [second reading]-Council Member Watts moved to approve the second reading of the ordinance in title only;seconded by Council Member Harvey.Council Member Harvey asked if the proposed ordinance would prohibit recreational fires;Fire Chief Robinson replied in the negative.Chief Robinson added that the sprinkler system requirements had been changed to mirror the regulations within the Cities of Johnston and Grimes so that sprinklers would be required in townhomes where the gross square footage is 8,000 square feet or greater.Council Member Blanchard expressed concern with the restrictive nature of the sprinkler system requirements;Chief Robinson explained that the proposed ordinance had been revised to require sprinkler systems in town homes of 8,000 square feet or greater from the initially proposed 6,000 square feet.He added that Johnston and Grimes had both adopted an 8,000 square foot requirement in 2006 and that Johnston had issued 17 townhome building permits in 2011 and 10 such permits so far in 2012. Creighton Cox,representing the Homebuilders Association of Greater Des Moines (HBA), expressed his appreciation that the City was working toward compromise on the matter, adding that he intended to ask the City of Johnston for the same changes to their fire codes. Joe Pietruszynski,representing Hubbell Realty Company,noted that his company was having difficulty meeting market conditions in Johnston and Grimes because of the sprinkler system requirements.He noted that adding such construction costs would put Waukee at a marketing disadvantage.Council Member Watts stated that he was not inclined to go against the recommendations made by Chief Robinson and that he was not interested in sprinkler system requirements in other communities.Council Member Dutcher asked for an explanation of the differences between Chief Robinson's and the HBA's sprinkler system proposals;Chief Robinson briefly noted the differences,adding that the language proposed by the HBA would also exclude apartments,condominiums and dormitories from requiring sprinkler systems.Mr. Cox responded that it was not HBA's intent to exclude such structures.Council Member Dutcher stated that while he did not want Waukee to have the most restrictive sprinkler system requirements,he was not willing to go against Chief Robinson's recommendations.Council Member Hughes asked about additional costs to install town home sprinkler systems;Mr.Cox replied that the construction cost would increase $4,000-6,000 per unit.Mayor Peard suggested the HBA and City staff discuss the ordinance prior to the third and final reading. Council Member Hughes echoed the sentiment of other council members,stating that she puts life safety first and that she trusted Chief Robinson's judgment.Council Member Dutcher asked if there were any studies comparing lives saved by sprinkler systems versus smoke detectors in residential units;Chief Robinson referenced certain studies on the matter that concluded that sprinkler systems were more effective,adding that the HBA could likely reference studies to the contrary.Mayor Peard asked if sprinkler systems were intended to save property or lives;Chief Robinson replied that they saved property in commercial applications,but lives in residential units.He noted that modern construction materials reach combustible temperatures sooner than materials used in the past and that he recommended sprinkler systems when many people might be exposed to danger.Council Member Harvey 12 asked if sprinkler systems required a second service line;Director of Public Works Gibson replied in the negative,saying that they would instead require a larger service line.Chief Robinson asked to work with a couple of council members on the ordinance,as he did not believe a compromise could be reached with the HBA;Mayor Peard suggested Council Members Dutcher and Hughes meet with Chief Robinson on the matter.Mr.Pietruszynski stated that homebuilders were also in favor of public safety,but are looking for a balance between safety and affordability.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes, Watts.Nays:None.Motion to table carried 5 -O.The ordinance was read in title only.
