(B)Pledge of Allegiance (C)Roll Call-The following members were present:Mayor William F.Peard;Council Members Shane Blanchard,Dan Dutcher,Casey L.Harvey,Shelly Hughes,Mike Watts.Absent:None. Also present:Interim City Administrator Brad Deets,Assistant to the City Administrator McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,City Planner Ben Landhauser,Deputy City Clerk Rebecca D.Schuett,City Engineer Forrest Aldrich, Assistant City Engineer Becky Ford,City Attorney Steve Brick. (D)Open Forum (E)Agenda Approval -Council Member Dutcher moved to approve the agenda;seconded by Council Member Hughes.After a brief discussion,Council Member Dutcher amended the motion to approve the agenda,removing item J1 H from the Consent Agenda for separate consideration;Council Member Hughes amended the second.Results of vote:Ayes:Blanchard, Dutcher,Harvey,Hughes,Watts.Nays:None.Motion carried 5 -O. (F)Mayor's Report -Mayor Peard met with the Slavin Management Consultants representative on 09/12 to discuss the city administrator/clerk recruitment criteria. (G)Presentations: 1)Proclamation:In recognition of October as National Anti-bullying Month -Mayor Peard read the proclamation aloud. (H)Public Hearings: 1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein to modify PD-1 [Planned Development Overlay District](University Woods)-Mayor Peard opened the public hearing and asked if any written correspondence had been received;Interim City Administrator Deets referenced a Consent for Zoning Change petition signed by Kenneth and Lois Oostenink, 1060 SE Bluegrass Cir.,that included comments requesting the enforcement of buffer and open space requirements.No comments were made by the public present.Mayor Peard declared the public hearing closed. (I)Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein to modify PD-1 [Planned Development Overlay District](University Woods)[introduction; first reading]-Council Member Harvey introduced the ordinance.Council Member Watts moved to approve the first reading of the ordinance in title only;seconded by Council Member Harvey.Interim City Administrator Deets briefly reviewed the rezoning application, which would allow for a skilled recovery center.He noted that some surrounding property owners had attended the Planning &Zoning Commission meeting on the matter and expressed concern regarding landscaping and buffering.Such matters will be addressed during site plan approval.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes, Watts.Nays:None.Motion carried 5 -O. Nays:None.Motion carried 5 -O.(Resolution #12-210) 4)Resolution:Consideration of approval of a resolution approving preliminary plat for Fox Creek Estates Plat 3 -Council Member Harvey moved to approve the resolution;seconded by Council Member Dutcher.City Planner Landhauser briefly reviewed the preliminary plat, noting that the original concept plan included higher density residential units.The plat is currently zoned R-4;however,the Waukee Municipal Code allows for the developer to elect to develop under the R-2 provisions.By doing so,the developer is no longer allowed to develop town home or duplex units on the subject property.Results of vote:Ayes:Blanchard,Dutcher, Harvey,Hughes,Watts.Nays:None.Motion carried 5 -O.(Resolution #12-211) 5)Resolution:Consideration of approval of a resolution approving construction drawings for Fox Creek Estates Plat 3 -Council Member Dutcher moved to approve the resolution; seconded by Council Member Blanchard.Results of vote:Ayes:Blanchard,Dutcher,Harvey, Hughes,Watts.Nays:None.Motion carried 5 -O.(Resolution #12-212) (K)Reports -Reports made by Interim City Administrator Deets,Director of Finance Burkhart,City Planner Landhauser,City Engineer Aldrich.
