(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:37 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Dan Dutcher,Casey L.Harvey,Shelly Hughes,Mike Watts.Absent:None.
Also present:Interim City Administrator Brad Deets,Administrative Services Manager/City Clerk
McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Assistant Director of Public Works Tim Royer,Fire Chief Clint Robinson,Library Director Erik
Surber,Human Resources Manager/Assistant Finance Director Patty Holden,City Clerk
Rebecca D.Schuett,City Engineer Forrest Aldrich,City Attorney Steve Brick.
(0)Open Forum -Rick Peterson,865 SE Bell Dr.,spoke representing the Waukee Area
Leadership Institute and presented a concept plan for an amphitheater in Centennial Park.The
Institute will raise funds for the project through grant applications and a significant 2013
fund raising effort.The Council voiced their support for the project.
(E)Agenda Approval -Council Member Dutcher moved to approve the agenda;seconded by
Council Member Harvey.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts.
Nays:None.Motion carried 5 -O.
(F)Mayor's Report -On 10/30,Mayor Peard,Interim City Administrator Deets and Parks and
Recreation Director Matt Jermier met regarding parks and recreation facilities.Mayor Peard
proposed a summit meeting in December to brainstorm parks and recreation improvements.
Mayor Peard and Interim City Administrator Deets presented to the Waukee Area Leadership
Institute on 11/01 and to the Waukee Area Chamber of Commerce on 11/13,On 11/28,the City
Council will meet to review applications for the city administrator position.

1)On plans,specifications,proposed form of contract and estimate of cost [Little
Walnut Creek Regional Lift Station Project]-Mayor Peard opened the public hearing and
asked if any written correspondence had been received;Interim City Administrator Deets
replied in the negative.No comments were made by the public present.Mayor Peard
declared the public hearing closed.
2)On the issuance of not to exceed $4,000,000 General Obligations Urban Renewal
Bonds of the City of Waukee,State of Iowa -Mayor Peard opened the public hearing and
asked if any written correspondence had been received;Interim City Administrator Deets
replied in the negative.No comments were made by the public present.Mayor Peard
declared the public hearing closed.
3)On a proposed Amendment No.3 to the Waukee Unified Urban Renewal Plan in the
City of Waukee,State of Iowa -Mayor Peard opened the public hearing and asked if any
written correspondence had been received;Interim City Administrator Deets replied in the
negative.No comments were made by the public present.Mayor Peard declared the public
hearing closed.
4)On an ordinance to repeal Chapter 304,Site Plan Ordinance,City of Waukee,Iowa,
and to adopt revised and restated requirements for sites and buildings and eliminate
provisions for landscaping and open space (Site and Building Development
Standards Ordinance)-Mayor Peard opened the public hearing and asked if any written
correspondence had been received;Interim City Administrator Deets replied in the negative.
No comments were made by the public present.Mayor Peard declared the public hearing
closed.
5)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
adopting Chapter 301.27 A to establish minimum standards related to landscaping and
open space for residential,commercial,and industrial properties within the City of
Waukee (Landscaping and Open Space Ordinance)-Mayor Peard opened the public
hearing and asked if any written correspondence had been received;Interim City
Administrator Deets replied in the negative.No comments were made by the public present.
Mayor Peard declared the public hearing closed.
(J)Public Hearing Action Items:
1)Resolution:Consideration of approval of a resolution approving plans,specifications,
form of contract and estimate of cost [Little Walnut Creek Regional Lift Station
Project]-Council Member Watts moved to approve the resolution;seconded by Council
Member Harvey.Director of Public Works Gibson briefly reviewed the project.Results of

2)Resolution:Consideration of approval of a resolution instituting proceedings to take
additional action for the authorization and issuance of not to exceed $4,000,000
General Obligations Urban Renewal Bonds -Council Member Blanchard moved to
approve the resolution;seconded by Council Member Harvey.Director of Finance Burkhart
briefly reviewed the proposed bond.Results of vote:Ayes:Blanchard,Dutcher,Harvey,
Hughes,Watts.Nays:None.Motion carried 5 -O.(Resolution #12-249)
3)Resolution:Consideration of approval of a resolution directing the advertisement for
sale of General Obligation Urban Renewal Bonds,Series 20120,and approving
electronic bidding procedures and official statement-Council Member Harvey moved
to approve the resolution;seconded by Council Member Blanchard.Results of vote:Ayes:
Blanchard,Dutcher,Harvey,Hughes,Watts.Nays:None.Motion carried 5 -O.(Resolution
#12-250)
4)Resolution:Consideration of approval of a resolution determining an area of the City
to be a blighted and economic development area,and that the rehabilitation,
conservation,redevelopment,development or a combination thereof,of such area is
necessary in the interest of the public health,safety or welfare of the residents of the
City;designating such area as appropriate for urban renewal projects;and adopting
the Amendment No.3 to the Waukee Unified Urban Renewal Plan -Council Member
Harvey moved to approve the resolution;seconded by Council Member Watts.Interim City
Administrator Deets briefly reviewed the revisions to the proposed amendment and noted
that neither the school district nor county attended the 10/22 consultation meeting on the
amendment.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts.Nays:
None.Motion carried 5 -O.(Resolution #12-251)
5)Ordinance:Consideration of approval of an ordinance to repeal Chapter 304,Site Plan

and Building Development Standards Ordinance)[introduction;first reading]-Council
Member Watts introduced the ordinance.Council Member Harvey moved to approve the
first reading of the ordinance in title only;seconded by Council Member Blanchard.Interim
City Administrator Deets briefly reviewed the proposed ordinance,highlighting certain
changes to design standards and hard surface material requirements.He also noted an
architectural design sample book proposed as a companion piece to the ordinance,adding
that future revisions to the sample book would be approved via resolution of the council.
Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts.Nays:None.Motion
carried 5 -O.The ordinance was read in title only.

noted that the applicant has submitted a request to remove the PD/R-4 parcel from the
rezoning request,leaving the PD/R-3 the only parcel for consideration by the council.Mayor
Peard opened the meeting for comment from those in attendance.The following spoke
against the rezoning application:1)Matt Salge,1480 SE Sagewood Cir.;2)Scott Politte of

Plumbing,16190 SE Laurel Ave.Those objecting again voiced concerns with traffic,crime
and high density residential,the reputation of the developer on past projects both in Waukee
and elsewhere in the state,and the possibility that the parcel may be developed in some way
other than the proposed Section 24 senior apartment project.They asked that the parcel
retain its current C-1 zoning classification.Mr.Deets clarified that the proposed PO zoning

included very specific provisions that would limit development of the parcel to Section 24
senior apartments as proposed,adding that any major changes or revisions to the PD would
require another public hearing.Rockne Brosman with Equity Growth Group addressed the
council to reiterate that the parcel would be developed as Section 24 senior apartments.
Council Member Hughes asked him to comment on any litigation between the developer and
contractors;Mr.Brosman replied that he was unaware of any such issues.Council Member
Dutcher added that the Iowa Finance Authority was unlikely to continue granting tax credits to
a developer with repeated vendor issues.Results of vote:Ayes:Dutcher,Harvey,Watts.

3)Resolution:Consideration of approval of resolution approving site plan for Vince Meyer
Learning Center [445 5th St.]-Council Member Harvey moved to approve the resolution;
seconded by Council Member Dutcher.Interim City Administrator Deets briefly reviewed the
site plan,which includes the removal of the majority of the existing single story portion of the
former Waukee Elementary School.Council Member Harvey asked about landscaping and
playground equipment;David Bentz of Bishop Engineering replied that the space left after the
demolition would remain as open space and that the playground would be located to the south
of the existing original structure.Tom Long of FRK Architects reviewed the proposed building
design.Council Member Watts questioned the design of the one-story vestibule connecting
