(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:34 p.m.in the Council Chambers at City Hall.

(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Dan Dutcher,Casey L.Harvey,Shelly Hughes,Mike Watts.Absent:None.
Also present:Interim City Administrator Brad Deets,Administrative Services Manager/City Clerk
McKinlee Gibson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Assistant Director of Public Works Tim Royer,City Planner Ben Landhauser,Deputy City Clerk

(E)Agenda Approval -Council Member Watts moved to approve the agenda;seconded by
Council Member Harvey.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts.
Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Peard attended the 11/29 special meeting of the City Council to review
city administrator applications and the 12/01 State Senate candidate forum at the Waukee
Public Library.He will attend the 12/05 WEDCO board meeting,the 12/06 Festival of Lights at
the Waukee Public Library,and the 12/07 Winterfest celebration.On 12/12,Mayor Peard will
take part in the United Way Legislative Breakfast and MIALG.
(G)Presentations:
1)Proclamation:In recognition of Sarah Bidney,2012 Iowa PGA Teacher of the Year-
Mayor Peard read the proclamation aloud and presented it to Sarah Bidney.
2)Proclamation:In recognition of Chad Proehl,2012 Iowa PGA Player of the Year-
Mayor Peard read the proclamation aloud and presented it to Chad Proehl.
3)Waukee Area Arts Council budget request -Waukee Area Arts Council President Karen
Dluhos addressed the Council.Council Member Harvey asked if the organization had any
plans to reduce their need for City funding;Ms.Dluhos responded that their organization
would ideally be funded through corporate donations like other metro area art councils.
Cindy DePond with the Waukee Area Arts Council added that the organization raises funds
by applying for grants,soliciting program sponsors and subleasing space to a Montessori
school.Mayor Peard noted that the City had recently partnered with Bravo Des Moines,
which would positively impact the Waukee Area Arts Council,and stated that he was not as
concerned with immediate plans for the Waukee Area Arts Council to become fiscally
independent from the City.
4)Iowa League of Cities 2013 legislative agenda -Iowa League of Cities Executive Director
Alan Kemp addressed the Council regarding the impact of recent elections,2013 legislative
priorities,and how the City can be more involved in representing their interests before the
State legislature.

[third (final)readingj-Council Member Harvey moved to approve the third reading of the

ordinance and place it on final passage;seconded by Council Member Watts.Annette
McCarthy of RJ Lawn and Landscaping,16180 SE Laurel Ave.,addressed the Council to
express the opinion that the concerns she forwarded to the Council via e-mail regarding issues
with projects undertaken by the developer in eastern Iowa had been dismissed without
consideration or due diligence on behalf of the Council.She reiterated her belief that the
project was not a good fit for Waukee and noted that the surrounding property owners would
be vigilant in monitoring and reporting any issues such as noise violations and unclean streets
during the construction process.Council Member Dutcher stated that the City has rules and
regulation that must be followed by all developers and that this particular developer cannot be
held to any higher standard.He expressed disbelief that the surrounding property owners
continued to object to the Section 24 senior apartments when the more contentious part of the
developer's initial proposal (low income townhomes)had been removed from consideration.
Council Member Harvey expressed the opinion that the proposed project was a good fit for the
neighborhood,adding that the planned development agreement would control the
development of the parcel and that he did not see the parcel developing as a commercial
property.Council Member Watts voiced his support for the project,stating that the density
was at a lower level than was originally platted.Council Member Hughes echoed some of
Council Member Dutcher's statement that the City holds all developers to the same high
standard,adding that she believed the proposed project to be a safe plan for this parcel.Dave

that a park shelter in this plat was required as part of an existing development agreement.

bid tabulation and recommended approving sale to Robert W.Baird &Co.,Inc.Council
Member Watts asked if there were any upcoming opportunities for bond re-funding;Ms.
Blankenship answered that PFM regularly monitors such opportunities on behalf of the City.
