(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:32 p.m.in the Council Chambers at City Hall.
(8)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Dan Dutcher,Casey L.Harvey,Shelly Hughes,Mike Watts.Absent:None.
Also present:interim City Administrator Brad Deets,Administrative Services Manager/City Clerk
McKinlee Gibson,Director of Finance Linda Burkhart,Assistant Director of Public Works Tim
Royer,City Planner Ben Landhauser,Deputy City Clerk Rebecca D.Schuett,City Engineer
Forrest Aldrich,City Attorney Steve Brick.
(D)Open Forum -Kurt Schade of Schade Creek Vineyard and Winery addressed the Council,
noting difficulties in his attempts over many years to work with the City in order to open and run
his business.He stated that he had followed all the proper procedures to build and operate his
winery,but is currently not open due to an injunction.He stated that he would begin sharing his
version of events with the public,noting that he was disheartened by the lack of vision from the
Council regarding his business.The following people also addressed the Council in support of
Mr.Schade:1)Larry Ingbers of Black Creek Wines in Pella,2)Tom Anderson,no address
given,Mr.Schade's insurance provider,and 3)Mitch Gabrielson,195 SE Kellerman Ln.Mayor
Peard asked Interim City Administrator Deets to review the history of the City's involvement with
the Schade Creek Vineyard and Winery.Mr.Deets presented as requested,adding that the
next step needed to allow Mr.Schade's business to legally operate was to rezone the property,
preferrably as a PUD.Mayor Peard asked if the City had followed legal procedures related to
the Schade property;City Attorney Brick replied in the affirmative,briefly noting court decisions
on the matter in the City's favor.Mr.Schade stated that a PUD rezoning had been the City's
idea and that he had agreed in the past to move forward with rezoning,even though he believed
parts of the rezoning were unfair and limited his business model.However,he had been told
that he would be required to give the City the right-of-way for the University Ave.extension,
destroy grapevines he had growing in the future right-of-way,and provide a signed letter
agreeing to terms related to the right-of-way.in response to Mr,Brick's review of court findings
on the matter,Mr.Schade responded that his attorney at the time of the original court case had
prosecuted the matter contrary to his direction and Mr.Schade believes that the citation was
issued in retaliation.In light of Mr.Schade's experience in real estate,Council Member Dutcher
asked Mr.Schade how he could be unaware of city zoning and right-of-way procedures,noting
that certain provisions in City code must be followed when developing a property.Mr.Schade
replied that he had not developed,but instead improved,the property and stated his belief that it
was unfair of the City to expect him to give up the future University Ave.right-of-way without
compensation for the grapevines he would have to remove.Council Member Hughes expressed
concern that a structure on the Schade property was listed by the Dallas County Assessor as a
utility building but was noted as an event center on the Schade Creek Vineyard and Winery
website;Mr.Schade replied that his website had been in error but has since been corrected.In
response to a question from Council Member Hughes,Mr.Schade explained the process
through which his wine had been sold and consumed on the property prior to the injunction.
Council Member Watts stated that Mr.Schade applied for a building permit for a utility shed,but
had always intended that he would operate a winery out of that building.He also noted that the
University Ave.extension has been part of the City's comprehensive plan for decades and Mr.
Schade should have been aware of that fact.Regarding the utility shed,Mr.Schade responded
that the City had always known his plans for a winery.Mayor Peard noted that the Planning &
Zoning Commission,Board of Adjustment,City Council and Dallas County Courts had all
concluded that Mr.Schade could not operate his winery under its current zoning.Council
Member Harvey expressed his hope that the matter could be resolved through PUD rezoning,
noting his desire to have the business in Waukee,but only if the same rules are followed as any
other business in the City.
(E)Agenda Approval-Council Member Harvey moved to approve the agenda;seconded by
Council Member Dutcher.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts.
Nays:None.Motion carried 5 -O.

Robinson.
(H)Public Hearings:
1)On the proposition of the issuance of not to exceed $2,000,000 Sewer Revenue Capital
Loan Notes,Series 2013A,of the City of Waukee,State of Iowa -Mayor Peard opened
the public hearing and asked if any written correspondence had been received;Interim City
Administrator Deets replied in the negative.No comments were made by the public present.
Mayor Peard declared the public hearing closed.
2)On the proposition of the issuance of not to exceed $5,500,000 in aggregate principal
amount of Private School Facility Revenue Refunding Bonds (St.Francis of Assisi
School Corporation Project),Series 2013,of the City of Waukee,State of Iowa -Mayor
Peard opened the public hearing and asked if any written correspondence had been
received;Interim City Administrator Deets replied in the negative.Mayor Peard asked if
anyone in attendance wished to speak on the matter under consideration;William Lillis
spoke as representative of St.Francis of Assisi and requested council approval.Mayor
Peard declared the public hearing closed.
(I)Public Hearing Action Items:
1)Resolution:Consideration of approval of a resolution instituting proceedings to take
additional action for the authorization of a loan agreement and the issuance of not to
exceed $2,000,000 Sewer Revenue Capital Loan Notes,Series 2013A,approving
electronic bidding procedures and official statement -Council Member Watts moved to
approve the resolution;seconded by Council Member Dutcher.Results of vote:Ayes:
Blanchard,Dutcher,Harvey,Hughes,Watts.Nays:None.Motion carried 5 -0,(Resolution
#13-020)
2)Resolution:Consideration of approval of a resolution authorizing and providing for
the issuance of $5,250,000 aggregate principal amount of Private School Facility
Revenue Refunding Bonds,Series 2013,of the City of Waukee,Iowa;the execution
and delivery of a loan agreement between said City and Sf.Francis of Assisi School
Corporation of West Des Moines,Iowa,providing for the repayment of the loan of the
proceeds of said bonds and the securing of said repayment obligation;the execution
and delivery of a pledge agreement relating to the security interest of said bonds;and
related matters -Council Member Watts moved to approve the resolution;seconded by
Council Member Dutcher.Council Member Harvey asked if the church had attempted to go
to the private market for the bonds;William Lillis,representing St.Francis of Assisi,replied in
the negative,stating that the proposal was to refinance existing bonds and that the City's
conduit bonding capacity would help lower the interest rate.Results of vote:Ayes:
Blanchard,Dutcher,Hughes,Watts.Nays:Harvey.Motion carried 4 -1.(Resolution #13-

to act on behalf of the City of Waukee during the 2013 State of Iowa legislative session
-Council Member Blanchard moved to approve the resolution;seconded by Council Member
Hughes.Interim City Administrator Deets noted staff's recommendation of Davis Brown Law
Firm as lobbyist for the 2013 legislative session.Council Member Harvey spoke against hiring
a lobbyist,seeing it as a large expense with little payback and noting the City's current
representation through the Iowa League of Cities.Michael Gregan,125 Aidan St.,addressed
the Council to also express his concern about the need for lobbying services in relation to the
cost,adding that the money might be better spent on city improvements.He then asked if any
local consortiums existed with which the City could partner for lobbying services;Council
Member Watts replied that the City had pooled with other metro cities in the past related to
lobbying services.He also stated that lobbying activities had assisted Waukee in securing
millions in federal funding toward the Alice's Road Corridor project.Mayor Peard stated that a
lobbyist working on behalf of the City would be beneficial due to the relative speed with which
bills sometimes moves through the [egislature.Council Member Dutcher spoke in favor of
hiring a lobbyist,stating that the potential reward outweighed the risk.Results of vote:Ayes:
