HomeMy WebLinkAbout2013-03-25-Special MinutesWAUKEE CITY COUNCIL MINUTES SPECIAL MEETING March 25,2013 A)Call to Order -The special meeting of the Waukee City Council was called to order by Mayor Pro Tem Hughes at 5:30 p.m.in the Waukee City Council Chambers. B)Roll Call-The following members were present:Council Members Shane Blanchard,Dan Dutcher, Casey L.Harvey,Shelly Hughes,Mike Walts.Absent:Mayor William F.Peard.(Mayor Peard arrived at 5:40 p.m.) Also in altendance:Director of Development Services Brad Deets,City Planner Ben Landhauser, Deputy City Clerk Rebecca D.Schuett,City Altorney Doug Fulton. C)Agenda Approval-Council Member Walts moved to approve the agenda;seconded by Council Member Dutcher.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Walts.Nays:None. Motion carried 5 -O. D)Action Items: 1)Resolution:Consideration of approval of a resolution approving the sale of a 1998 Toyne grass truck and payment of associated sales commission -Council Member Walts moved to approve the resolution;seconded by Council Member Dutcher.Director of Development Services Deets briefly reviewed the terms of sale.Results of vote:Ayes:Blanchard,Dutcher, Harvey,Hughes,Walts.Nays:None.Motion carried 5 -o.(Resolution #13-068) 2)Motion:Consideration of approval of setting April 1,2013,as the date of public hearing on an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein from R-4 [Row Dwelling and Townhome Dwelling District],C-1S [Large Scale Commercial District]and C-4 [Office Park Commercial District]to R-2 [One-and Two-Family Residential District];and changing certain property therein from R-4 [Row Dwelling and Townhome Dwelling District},C-1S [Large Scale Commercial District}and C-4 [Office Park Commercial District]to R-3 [Rental Multi-Family Residential District];and changing certain property therein from R-4 [Row Dwelling and Townhome Dwelling District]and C-4 [Office Park Commercial District]to C-1S [Large Scale Commercial District],and amending the Official Zoning Map to show rezoning (The Crossing at Alice's Road Plat 3)-Council Member Harvey moved to approve;seconded by Council Member Walts.Director of Development Services Deets stated that the applicant had requested rescheduling of the rezoning hearing.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Walts.Nays:None.Motion carried 5 -O. E)Public Hearings: 1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by amending Area C of the Planned Development for Williams Pointe North currently zoned PD-1 [Planned Development Overlay District]and R-3 [Rental Multi-Family Residential District]1 R-3A [Owner Occupied Multi-Family Residential District]to allow for the construction of town homes (Williams Pointe North Planned Development)-Mayor Pro Tem Hughes opened the public hearing and asked if any wrilten correspondence had been received;Director of Development Services Deets replied in the negative.No comments were made by the public present.Council Member Walts asked for clarification on the development location;Mr.Deets noted the location and briefly reviewed the rezoning application.(Mayor Peard arrived at 5:40 p.m.)Council Member Walts recommended that approval of the rezoning be made contingent on a specific beginning and completion date for the project;Mr.Deets replied that such a provision would need to be discussed with the applicant.Council Member Harvey asked for an update on the development to the west of the proposed rezoning area. Mayor Peard declared the public hearing closed. 2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein from A-1 [Agricultural District]to R-2 [One and Two Family Residential District];and rezoning and changing certain property therein from A-1 [Agricultural District]to R-3 [Rental Multi-Family Residential District] (Westown Meadows Plat 2)-Mayor Peard opened the public hearing and asked If any written correspondence had been received;Director of Development Services Deets noted four objection letters that had been included in the agenda packet.A petition objecting to the rezoning was presented to the City Council.Council Member Harvey moved to receive and file the petition;seconded by Council Member Dutcher.Results of vote:Ayes:Blanchard,Dutcher, Harvey,Hughes,Watts.Nays:None.Motion carried 5 -O.Mayor Peard asked for comments from those present;the following addressed the City Council to object to the rezoning application:1)Nick Larson,2280 SE Willowbrook Dr.;2)Eric Krieger,2240 SE Willowbrook Dr.; 3)Josh Ehlen,2260 SE Willowbrook Dr.;4)Jason Brown,2250 SE Prairie Creek Dr.;5)Jenny Lutz,2310 SE Leeann Dr.;6)James Rumph,2220 SE Willowbrook Dr.;and 7)Matt Harbaugh, 2145 SE Willowbrook Dr.All expressed concern with the R-3 zoning,stating that there was not enough of a transition between single family and multi-family zoning,the increased density would lead to traffic congestion and safety issues,a multi-family project could negatively Impact surrounding property values,and the proposed parkland was smaller than originaliy planned. Mayor Peard declared the public hearing closed. F)Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by amending Area C of the Planned Development for Williams Pointe North currently zoned PD-1 [planned Development Overlay District]and R-3 [Rental Multi-Family Residential District]!R-3A [Owner Occupied MUlti-Family Residential District]to allow for the construction of townhomes (Williams Pointe North Planned Development)[introduction;first reading]-Council Member Watts Introduced the ordinance.Council Member Harvey moved to approve the first reading of the ordinance in title only;seconded by Council Member Blanchard.Results of vote:Ayes:Blanchard,Dutcher, Harvey,Hughes,Watts.Nays:None.Motion carried 5 -O.The ordinance was read in title only. 2)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein from A-1 [Agricultural District]to R-2 [One and Two Family Residential District];and rezoning and changing certain property therein from A-1 [Agricultural District]to R-3 [Rental MUlti-Family Residential District](Westown Meadows Plat 2)[introduction;first reading]-Council Member Watts introduced the ordinance and moved to approve the first reading in title only;seconded by Council Member Harvey.Director of Development Services Deets briefly reviewed the rezoning application,as weli as the signature requirements on rezoning petitions,the Alice's Road Corridor Master Plan,and parkland dedication requirements.He added that a traffic study would be required before the development of the multi-family parcel and that Westown Pkwy.would be extended to the east to connect with SE Parkview Crossing Dr.within the year,which would alievlate traffic congestion in the area. Council Member Harvey stated that he was not concerned with the size of the proposed park and noted that the Alice's Road Corridor Master Plan was a concept plan for development in the area.He voiced his concern with an apartment complex abutting single family homes;Mr. Deets explained the buffering requirements between single family and multi-family residential zoning.Council Member Harvey stated that he would support the first reading of the ordinance but would take time to review the application prior to the second reading.There was some discussion on adding a transitional zoning area between the single famiy and multi-family districts;Mr.Deets replied that staff would work with the applicant to try and mitigate any concerns but that it would be the applicant's decision to move forward or make changes. Council Member Watts also spoke In favor of a better transition between the single family and multi-family parcels and expressed concern that the R-2 zoning could be developed as single family homes,but also as bi-attached dweliings.Council Member Dutcher echoed the concerns 2 of Council Members Harvey and Watts regarding the transition between zoning areas.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes,Watts.Nays:None.Motion carried 5 -O. The ordinance was read in title only.After the vote,the City Council directed staff to meet with the applicant regarding the transition between the proposed single family and multi-family residential districts.Council Member Watts asked to participate in such meetings. G)Comments Adjournment -Council Member Harvey moved to adjourn;seconded by Council Member Dutcher. Ayes:All.Nays:None.Motion carried 5 -O.
