(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:31 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Dan Dutcher,Casey L.Harvey,Shelly Hughes,Mike Watts.Absent:None.

(F)Mayor's Report -Congressman Bruce Braley will visit Waukee on 04/04 for a tour of the Alice's
Road Corridor.On 04/14,the Waukee Area Chamber of Commerce hosts "What's Cookin'in
Waukee"and presents the final Legislative Coffee of the session on 04/16.Mayor Peard will
attend the 04/04 ribbon cutting for The Win hall at Williams Pointe.

1)On the proposition of the issuance of not to exceed $340,000 of General Obligation
Bonds (for a General Corporate Purpose)-Mayor Peard opened the public hearing and
asked if any written correspondence had been received;City Administrator Moerman replied
in the negative.No comments were made by the public present.Mayor Peard declared the
public hearing closed.
2)On the proposition of the issuance of not to exceed $985,000 of General Obligation
Bonds (for Essential Corporate Purposes)of the City of Waukee,State of Iowa -Mayor
Peard opened the public hearing and asked if any written correspondence had been
received;City Administrator Moerman replied in the negative.No comments were made by
the public present.Mayor Peard declared the public hearing closed.
3)On the proposition of the issuance of not to exceed $2,000,000 General Obligation
Urban Renewal Bonds of the City of Waukee,State of Iowa -Mayor Peard opened the
public hearing and asked if any written correspondence had been received;City
Administrator Moerman replied in the negative.No comments were made by the public
present.Mayor Peard declared the public hearing closed.
4)On the proposition of the issuance of not to exceed $2,400,000 General Obligation
Urban Renewal Refunding Bonds of the City of Waukee,State of Iowa -Mayor Peard
opened the public hearing and asked if any written correspondence had been received;City
Administrator Moerman replied in the negative.No comments were made by the public
present.Mayor Peard declared the public hearing closed,
5)On an ordinance to amend Section 301.31,Waukee Municipal Code,Zoning Ordinance
of the City of Waukee,Iowa,Schedule of Fees,by amending construction inspection
fees -Mayor Peard opened the public hearing and asked if any written correspondence had
been received;City Administrator Moerman replied in the negative.No comments were
made by the public present.Mayor Peard declared the public hearing closed.
6)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by
rezoning and changing certain property therein from PO [Planned Development
Overlay District]and R-1 [Single Family Residential District]to PO [Planned
Development Overlay District]and R-4 [Row Dwelling and Townhome Dwelling
District]and by amending the Planned Development for Glynn Village to allow for the
construction of additional town homes in the subdivision (Glynn Village Planned
Development)-Mayor Peard opened the public hearing and asked if any wrillen
correspondence had been received;City Administrator Moerman referenced lellers or e-
mails from Nancy and Ed Holland,195 Emerson Ln.;Alison Bell,185 SE Booth Ave.;Tim
and Beth Kniffen,1465 Warrior Ln.;and Mary and Virgil Young,1545 SE Waddell Way,all in
opposition to the proposed rezoning.Mayor Peard asked for comments from those present;
the following addressed the City Council to object to the rezoning application:1)Tracy

St.The objections included ongoing lack of response from Hubbell on rnaintenance issues
in the development and how that precedent might extend to the proposed additional
townhomes,traffic and safety concerns near the clubhouse/pool area,the inclusion of
townhomes along SE Booth Ave.which had not been discussed at the first two
neighborhood meetings on the rezoning plans,proposed means of ingress/egress for the SE
Booth Ave.townhomes,lack of transition between existing single family lots and the SE
Booth Ave.townhomes,increased residential density,and a negative impact on surrounding
property values.Joe Pietruszynski,representing Hubbell Realty Company,stated that the
SE Booth Ave.town homes were part of the original concept and disagreed with certain
traffic nurnbers cited by some objecting to the rezoning.Council Member Hughes,who had
participated in the neighborhood meetings on the rezoning application,agreed with the
objectors that the SE Booth Ave.town homes were not discussed until the third meeting on
the rnaller.In response to concerns about decreased property values,Council Member
Dutcher stated that fewer single family homes in the development would increase property
values.Council Member Walls noted that traffic was heavy in the area because Glynn
Village was developed with a green concept that allowed for more homes to be built due to
decreased setbacks.Council Mernber Blanchard asked if the rezoning application could be
divided into two separate applications,with one each for the Warrior Ln.and SE Booth Ave.
areas;Mr.Pietruszynski replied in the negative due to the overall development plan for the
subdivision.Mayor Peard declared the public hearing closed.
7)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by
amending the Planned Development for Williams Pointe Plat 9 including modification
of the underlying zoning district of C-1A [Neighborhood Commercial District]/R-3
[Rental Multi-Family Residential District]to C-4 [Office Park Commercial District]/C-1A
[Neighborhood Commercial District](Williams Pointe Plat 9 Planned Development)-
Mayor Peard opened the public hearing and asked if any wrillen correspondence had been
received;City Administrator Moerman replied in the negative.No comments were made by
the public present.Mayor Peard declared the public hearing closed.
8)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by

Commercial District](The Crossing at Alice's Road)-Mayor Peard opened the public
hearing and asked if any wrillen correspondence had been received;City Adrninistrator

Moerman replied in the negative.Mayor Peard asked for comments from those present;
Dan Peterson,2832 WAve.,spoke in objection to the apartment portion of rezoning
application,noting the transient nature of apartment dwellers and a potential increase in
crime.Jerry Oliver of Civil Engineering Consultants,representing the applicant,reviewed
the rezoning proposal and expressed the opinion that apartments were a logical transition
between the commercial and single family zoning areas.Bret Dublinske of Gonzalez 8aggio
and Harlan Law Firm,representing Team Technologies,noted ongoing negotiations with
Knapp Properties regarding potential noise ordinance issues caused by his client's
operation.There was some discussion regarding ambiguities in the noise ordinance as it
pertains to data center operations.Council Member Watts expressed concern that Phase II
construction on the Team Technologies facility had yet to be completed and noted that
residential zoning would need to be decertified from the existing TI F district.Mayor Peard
declared the public hearing closed.

additional action for the authorization and issuance of not to exceed $340,000 General

8)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein
from PD [Planned Development Overlay District]and R-1 [Single Family Residential
District]to PD [Planned Development Overlay District]and R-4 [Row Dwelling and
Townhome Dwelling District]and by amending the Planned Development for Glynn
Village to allow for the construction of additional townhomes in the subdivision
(Glynn Village Planned Development)[introduction;first reading]-Council Member
Watts introduced the ordinance.Council Member Harvey moved to approve the first reading
of the ordinance in title only;seconded by Council Member Blanchard.Director of
Development Services Deets briefly reviewed the application,including some background on
the development of Glynn Village.He noted that the proposed rezoning did not impact the
maximum density allowed by the planned development agreement.Council Member
Dutcher agreed with some of the public hearing speakers that single family homes are
selling well in Glynn Village,with the exception of lots around the clubhouse and those along
Waddell Way.He added that rear-loaded townhome development would alleviate access
issues along the divided boulevard of Warrior Ln.Council Member Dutcher also voiced his
concern with maintenance issues in Glynn Village,but noted that the City Council cannot
"punish"Hubbell by rejecting the rezoning application if they meet all the rezoning
requirements.He then asked if the proposed rezoning would impact the conservation nature
of the subdivision;Mr.Deets replied in the negative,adding that the proposed rezoning
would allow for more green space in the subdivision than originally planned.At the request
of the City Council,Joe Pietruszynski with Hubbell Realty Company reviewed traffic count
numbers,noting that traffic patterns are lower for town home development than for single
family.Council Member Harvey agreed that there would be an increase in traffic in the
subdivision,but stated that more traffic was inevitable as Glynn Village develops to the
south.Council Member Blanchard expressed concern that the ingress/egress around the
proposed SE Booth Ave.townhomes seemed especially narrow,noting safety concerns with
traffic flow around the clubhouse.Council Member Hughes echoed the concerns of Council
Member Blanchard regarding traffic flow and safety issues near the clubhouse.Results of
vote:Ayes:Blanchard,Dutcher,Harvey,Watts.Nays:Hughes.Motion carried 4 -1.The
ordinance was read in title only.

Council Member Blanchard introduced the ordinance and moved to approve the first reading
in title only;seconded by Council Member Watts,Director of Development Services Deets
briefly reviewed the rezoning application and clarified how the City's current noise ordinance
would apply to the Team Technologies facility.Council Member Dutcher spoke in favor of
the multi-family section as a good transition between the commercial and single family
parcels.Council Member Watts stated that he did not support the rezoning application,
noting that The Crossing at Alice's Road was designed as an office park and there were
plenty of other residential developments in the community.Amy Stout,representing Knapp
Properties,noted that the development had been marketed heavily as an office park but that
those types of businesses are looking to develop elsewhere,especially along the Alice's
Road Corridor.Council Member Harvey acknowledged Council Member Watt's point
regarding commercial development,but stated that certain types of development cannot be
forced into areas that the City Council might prefer and that holding developers to original
plans can stifle growth.Mayor Peard added that the City needs to let the market dictate how
a property develops.Results of vote:Ayes:Blanchard,Dutcher,Harvey,Hughes.Nays:
Watts.Motion carried 4 -1.The ordinance was read in title only.

7)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein

from A-1 [Agricultural District]to R-2 [One and Two Family Residential District];and
rezoning and changing certain property therein from A-1 [Agricultural District]to R-3
[Rental Multi-Family Residential District](Westown Meadows Plat 2)[second reading]-
Council Member Harvey moved to approve the second reading of the ordinance in title only;
seconded by Council Member Hughes.Director of Development Services Deets stated that
City staff had met with the applicant as directed by the City Council after the 03/25/2013 public
hearing and that the applicant is willing to enter into an agreement that would restrict
construction in the R-2 portion to single family homes only and restrict multi-family buildings
fronting SE Westown Pkwy.in the R-3 portion to two stories.Council Member Harvey asked if
restricting certain multi-family buildings to two stories would reduce the density;Mr.Deets
replied that the density would shift to the south,but that the restriction would help define the
overall density of the project.Council Member Harvey stated that the restrictions seemed like
a good compromise as the multi-family units will look less imposing.Council Member Hughes
asked for clarification on the multi-family complex site plan and setbacks;Mr.Deets stated that
the applicant was not intending to be the developer for the R-3 portion but that a concept plan
is required as part of the rezoning application.He also reviewed setbacks,berming and
landscape buffering along most of the perimeter of the proposed multi-family development.
Mayor Peard asked for comments from those present:Josh Ehlen,2260 SE Willowbrook Dr.;
Nick Larson,2280 SE Willowbrook Dr.;and Eric Krieger,2240 SE Willowbrook Dr.,reiterated
their concerns as noted during the 03/25/2013 public hearing on the matter.Applicant Kurt
Brewer addressed the City Council to give some background on development in Grant Park
and Westown Meadows.He added that the objecting neighbors would not be close to the
proposed multi-family development and that it was his responsibility to market and sell the
single family lots that would abut the multi-family development.Councii Member Watts spoke
in favor of the two-story multi-family building restriction,noting that it was a good transition
between the R-2 and R-3 zoning districts.Results of vote:Ayes:Blanchard,Dutcher,Harvey,
Hughes,Watts.Nays:None.Motion carried 5 -O.The ordinance was read in title only.
