(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Hughes at 5:31 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Council Members Shane Blanchard,Casey L.
Harvey,Shelly Hughes,C.isaiah McGee,Mike Watts.Absent:Mayor William F.Peard.
Also present:City Administrator Tim Moerman,Director of Finance Linda Burkhart,Director of
Development Services Brad Deets,Director of Public Works John Gibson,Community and
Economic Deveiopment Director Dan Dutcher,City Clerk Rebecca D.Schuett,City Attorney
Steve Brick.

(E)Agenda Approval -Council Member Harvey moved to approve the agenda;seconded by
Council Member Watts.Results of vote:Ayes:Blanchard,Harvey,Hughes,McGee,Watts.
Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Pro Tem Hughes highlighted some of the planned events for Waukee
Fest on 08/24.
(G)Presentations:
1)Waukee Public Library Board of Trustees report -As there was no Library Board of
Trustees member in attendance at this time,the Council agreed to table the presentation
until a board member was in attendance.
(H)Public Hearings:
1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
amending the zoning for Willow Pines from A-1 [Agricultural District]to R-1 [Single
Family Residential District]-Mayor Pro Tem Hughes opened the pubiic hearing and
asked if any written correspondence had been received;City Administrator Moerman replied
in the affirmative,referencing a 08/12 letter from Mark and Diane Foust,32279 Ute Ave.,in
opposition to the rezoning application.Director of Development Services Deets briefly
reviewed the rezoning request,noting two processes through which the application could
move forward:1)by written consent of the owners of at least 50%of the surrounding
property,and 2)by super majority vote of the City Council.Caleb Smith with McClure
Engineering addressed the council on behalf of the applicant,noting that certain surrounding
property owners are not within Waukee city limits but approve of the application.David
Stilley,developer for the project,noted that he was unable to obtain signatures from the
owners of 50%of the surrounding property as he had repeatediy attempted to contact
Phillips Hamilton but with no response.All other neighboring properties,with the exception
of the Fousts,give their consent to the rezoning.Mayor Pro Tem Hughes asked if anyone in
attendance wished to speak on the matter under consideration.1)Mark Foust,32279 Ute
Ave.,spoke in opposition of the rezoning application,noting that the applicant had not
obtained the 50%signatures and asking for clarification on the two processes through which
the application could move forward;City Attorney Brick reviewed the owner-and council-
initiated rezoning procedures.Mr.Foust stated his objection to the rezoning application due
to increased density,incompatibility with the surrounding area,high visibility of the area from
R-22 due to topography,lack of parkland in the proposed deveiopment,and concerns
regarding storm water and erosion control.2)Sharon Chisholm,presenting the Phillips
Hamilton property,also expressed concern with erosion and asked for confirmation that
storm water would not be redirected onto the Phillips Hamilton property.Mayor Pro Tem
Hughes declared the public hearing closed,
(I)Public Hearing Action Items:
1)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein
from A-1 (Agricultural District)to R-1 (Single Family Residential District),a
subdivision to be known as Willow Pines [introduction;first readingj-Council Member
Watts introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Blanchard.Director of Development Services Deets
addressed certain concerns mentioned during the public hearing on the application,noting
that staff has made the developer aware of the parkland dedication ordinance and reviewing
the storm water management requirements for all new developments.Council Members
Watts,Harvey,Bianchard and Hughes all stated that they would vote in favor of the first
reading of the ordinance,but that they still had questions related the application.Council
Member Harvey asked how the proposed development would connect to the north;Mr.
Deets noted that connectivity between the subject property and Ashworth Rd.would be
addressed during preliminary platting.Council Member Harvey spoke in favor of parkland
dedication and not payment in lieu thereof;Council Member Blanchard agreed.Sharon
Chisholm,representing the Phillips Hamilton property,clarified that Phillips Hamilton has not
stated that they would include parkland on the property when it develops,then asked for
confirmation of the sewer line connection location off Ute Ave.Results of vote:Ayes:
Blanchard,Harvey,Hughes,McGee,Watts.Nays:None.Motion carried 5 -O.The
ordinance was read in title only.
Presentation:Waukee Public Library Board of Trustees report -At this time,report made
by Waukee Public Library Board of Trustees member Sue Ellen Kennedy.

1)Consent Agenda:Council Member McGee moved to approve the Consent Agenda,
removing item J1 I from consideration and removing item J1 N for separate consideration;
seconded by Council Member Harvey.Results of vote:Ayes:Blanchard,Harvey,Hughes,
McGee,Watts.Nays:None.Motion carried 5 -O.

2)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa by amending the Planned Development for Lot 1 of
Williams Pointe Plat 13 including modification of the underlying zoning district of C-1
(Community and Highway Service Commercial District)to R-4 (Row Dwelling &
Townhome Dwelling District)[third (final)reading]-Council Member Watts moved to
approve the third reading of the ordinance in title only and place it on final passage;seconded
by Council Member Harvey.Council Member Blanchard asked the City Council to vote
against the rezoning to allow the property to develop as commercial.Council Member McGee
asked Community and Economic Development Director Dutcher what drives commercial
development;Mr.Dutcher replied that such development depended on location and access
and the subject property may have more value with transitional zoning between commercial
and residential.Council Member Harvey reiterated that he did not see any legal reason to
deny the application.Council Member Watts voiced his support for the rezoning application,
noting that if the subject property were to remain commercial,it could develop as something
very intrusive to the neighborhood;Council Member McGee agreed,adding that the property
would likely be well maintained if it were developed as townhomes,as such maintenance
wouid be in the property owner's best interest.Council Member Blanchard asked if there were
updated traffic counts in the area;Director of Development Services Deets responded that a
recent count was unusable due to technical issues but that typically residential development
generates less traffic than commercial.Council Member Watts added that he had observed
traffic in the area along Brick Dr.and Waco PI.and did not see high traffic volumes.Council
Member Hughes responded that she had witnessed the high traffic in the area and would not
support the application for that reason.Results of vote:Ayes:Harvey,McGee,Watts.Nays:

3)Resolution:Consideration of approval of a resolution approving preliminary plat for
Bluestem Plat 1 -Council Member Harvey moved to approve the resolution;seconded by
Council Member McGee.Director of Development Services Deets briefly reviewed the plat,
noting that a passive park is planned in the SW corner of Bluestem as a whole.The developer
is also considering purchasing adjoining property and may relocate the planned parkland to
that property.Council Member Harvey asked about an agreement related to parkland
dedication;Mr.Deets replied that the matter will be addressed at final plat.Council Member
Hughes asked if there were any concerns with the alignment of the Bluestem Plat 1 access
with the Timberline Schoo]entrance;Mr.Deets replied in the negative,noting that staff
encourages such alignment as part of traffic control.Council Members Watts and McGee both
expressed concern with the amount and flow of traffic anticipated along LA Grant Pkwy.as
