(B)Pledge of Allegiance (C)Roll Call —The following members were present:Council Members Shane Blanchard,Brian Harrison,Casey L.Harvey,Shelly Hughes,Rick Peterson.Absent:Mayor William F.Peard. Also present:City Administrator Tim Moerman,Director of Development Services Brad Deets, Director of Public Works John Gibson,Director of Finance Linda Burkhart,Director of Community and Economic Development Dan Dutcher,Parks and Recreation Director Matt Jermier,Communications Director Amanda Gorsche Miller,Fire Chief Glint Robinson,City Clerk Rebecca D.Schuett,City Attorney Steve Brick. (D)Open Forum (E)Agenda Approval —Council Member Blanchard moved to approve the agenda,removing items J2 and J3 from consideration;seconded by Council Member Harvey.Results of vote:Ayes: Blanchard,Harrison,Harvey,Hughes,Peterson.Nays:None.Motion carried 5 —0. (F)Mayor's Report (G)Presentations:None (H)Public Hearings: 1)On the annexation of consenting properties by the City of Waukee,Iowa,with consideration of the annexation taking place immediately thereafter PNaco Placel98'" Street Boundary Realignment]—Mayor Pro Tem Harrison opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Director of Development Services Deets presented on the rnatter,stating that the proposal included the severance and annexation of property in coordination with the City of West Des Moines in order to realign the Waco Pl.curve.Mayor Pro Tem Harrison asked for public comment on the matter:Mark Jorgenson,595 SE Dallas Point Dr.,asked if the property severance would negatively impact Waukee's tax base;Mr.Deets replied in the negative,adding that there could not be an even property exchange with West Des Moines due to the proposed road realignment geometry.Council Member Hughes asked about West Des Moines'roadway construction timeline;Mr.Deets noted that West Des Moines was responsible for construction of the intial two lanes of the project and that their construction drawings would be submitted for Waukee's review prior to construction slated to begin this summer.Council Member Blanchard wondered if the railroad crossing would mean additional roadway development costs for Waukee;Mr.Deets stated that those costs would be the responsibility of the property owner when the parcel is developed.Mayor Pro Tem Harrison declared the public hearing closed. 2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by amending the zoning for certain property from C-1 and R-3 to R-2„and amending certain property from C-1 to PD and R-4;and amending certain property from C-1 to R- 2 [Brookside]—Mayor Pro Tem Harrison opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Director of Development Services Deets presented on the matter,reviewing the zoning history of the property and a development concept plan.One parcel is planned for single family detached homes that operate in a similar manner as townhomes.Parkland dedication for the development will abut and be included in the larger Fox Creek Park area.No comments were made by the public present.Mayor Pro Tem Harrison declared the public hearing closed. (I)Pu 1) 3) 4) On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa by amending the zoning for certain property from C-4 to PD and R-3;and amending certain property from C-4 to C-1 [Autumn Ridge]—Mayor Pro Tem Harrison opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Director of Development Services Deets presented on the matter,comparing the proposed zoning with that included in the 2011 Alice's Road Corridor Master Plan.The development concept plan includes a 5-acre parkland dedication abutting the recreational trail to the north of the subject property,playground facilities and trail connections.Mr.Deets reviewed a traffic impact study related to the proposed rezoning and noted the extension of SE Olson Dr.from SE Brick Dr.to Alice's Rd.and a planned future traffic signal at the Alice's Rd./SE Olson Dr.intersection.Mayor Pro Tem Harrison asked for public comment on the matter:1)Mary Ann Lowary,1329 SE University Ave.,Unit 4106; spoke against the rezoning application,noting a concern with increased traffic and casting doubt on the traffic study results.She noted that tenants in other nearby apartments were bad neighbors and asked that the subject property remain zoned for office park use.2)Mark Jorgenson,595 SE Dallas Point Dr.,spoke against the rezoning application,advising the council to be cautious with Waukee's growth and not base their decision purely on economic factors.3)Karen Stovnheim,1313 SE University Ave.,Unit 4110,stated that she had sent an e-mail to the council members on the matter.IVlayor Pro Tem Harrison declared the public hearing closed. blic Hearing Action Items: Resolution:Consideration of approval of a resolution approving the voluntary severance of property within the City of Waukee,iowa PYaco Place/98'"Street Boundary Realignment]—Council Member Harvey moved to approve the resolution; seconded by Council Member Blanchard.Council Member Harvey asked why the subject properties in Waukee and West Des Moines were not more equally divided;Director of Development Services Deets noted that the roadway improvement design is based on anticipated speeds along the corridor and does not allow for more equity in the severance and annexation.Council IVlember Hughes asked about the completion date for roadway improvements;Mr.Deets replied that West Des Moines hoped to complete the project before the start of the school year,but it could run past that date.After a brief discussion, Council Member Harvey amended the motion to approve the resolution contingent upon approval by the City of West Des Moines;Council Member Blanchard amended the second. Results of vote:Ayes:Blanchard,Harrison,Harvey,Hughes,Peterson.Nays:None.Motion carried 5 —0.(Resolution 414-152) Resolution:Consideration of approval of a resolution approving the annexation of consenting properties by the City of Waukee,iowa I/Yaco Place/98'"Street Boundary Realignment'—Council Member Harvey moved to approve the resolution contingent upon approval by the City of West Des Moines;seconded by Council Member Harrison.Results of vote:Ayes:Blanchard,Harrison,Harvey,Hughes,Peterson.Nays:None.Motion carried 5 —0.(Resolution 014-153) Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,iowa by amending the zoning for certain property from C-1 and R-3 to R-2;and amending certain property from C-1 to PD and R-4;and amending certain property from C-1 to R-2,a parcel to be known as Brookside (introduction;first readingJ —Council Member Harvey introduced the ordinance and moved to approve the first reading in title only;seconded by Council Member Blanchard.Council Member Harvey asked if the planned cul-de-sac had a large enough radius for emergency vehicle access; Director of Development Services Deets replied that City staff would analyze the matter more thoroughly during the site plan approval process.Results of vote:Ayes:Blanchard, Harrison,Harvey,Hughes,Peterson.Nays:None.Motion carried 5 —0.The ordinance was read in title only. Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,iowa by amending the zoning for certain property from C-4 to PD and R-3;and amending certain property from C-4 to C-1,a parcel to be known as Aufumn Ridge (infroducfion;first reading J —Council Member Harvey introduced the ordinance and moved to approve the first reading in title only;seconded by Council Member Peterson.Council Member Blanchard asked for clarification on the proximity of the proposed apartments to the existing Winhall Apartments and the proposed trail location and connections.Council Member Harvey expressed concern that the traffic impact study may not adequately reflect Waukee High School traffic and spoke in favor of completing the construction of SE Olson Dr.before the proposed apartment complex is fully built.He stated that he would vote in favor of the first reading but wanted his concerns addressed.Council Member Hughes echoed Council Member Harvey's concerns regarding traffic,adding that the area is saturated with multi-family housing options and noting her current discomfort with the proposal.City Administrator Moerman asked if a roadway build-out strategy and timeline for the area would be helpful to the council;Council Member Harvey answered in the affirmative.Council Member Peterson stated that he was also not convinced by the traffic impact study results and agreed with Council Member Hughes'assessment of the housing saturation in the area.At the request of City Attorney Brick,Director of Development Services Deets reviewed the rezoning application and notification procedures.Results of vote:Ayes:Blanchard,Harrison,Harvey.Nays:Hughes,Peterson.Motion carried 3 —2.
