Pledge of Allegiance Roll Call —The following members were present:Mayor William F.Peard;Council Members Shane Blanchard,Casey L.Harvey,Rick Peterson.Absent:Council Members Brian Harrison, Shelly Hughes. (o) (E) (F) (G) (H) Also present:City Administrator Tim Moerman,Director of Finance Linda Burkhart,Director of Development Services Brad Deets,Director of Community and Economic Development Dan Dutcher,Director of Public Works John Gibson,Communications Director Amanda Gorsche Miller,Fire Chief Glint Robinson,Police Chief John Quinn,City Clerk Rebecca D.Schuett,City Attorney Steve Brick. Open Forum Agenda Approval —Council Member Harvey moved to approve the agenda,moving consideration of items J3,J4 and J5 to after item J10 as requested by the applicant;seconded by Council Member Blanchard.Results of vote:Ayes:Blanchard,Harvey,Peterson.Nays: None.Absent:Harrison,Hughes.Motion carried 3 —0 —2. Mayor's Report —Mayor Peard presented the annual State of the City address on 03/26.Also on 03/26,he recognized the Waukee High School girls'basketball team on their Class 5A state title.He attended the Waukee Area Chamber of Commerce's "What's Cookin'in Waukee*'event on 04/02 and the Mayor and City Managers meeting on 04/03.The annual Easter Egg Hunt and the Waukee Area Chamber of Commerce's Legislative Coffee were both held on 04/04.Mayor Peard then named Terry Snyder as Waukee's 2014 Citizen of the Year. Presentations: 1)IT server replacement,managed services,printer/copier services —Director of Finance Burkhart briefly reviewed the process for recommendation to the City Council of an IT firm to address server replacement,managed services,and printer/copier services,then introduced Mandi Dunkin and Steve Ames with Access Systems,the recommended firm.Ms.Dunkin and Mr.Ames reviewed their assessment of the IT system's current status and future needs. Council Member Harvey asked about specific technical aspects of the proposal and asked if Access Systems would be willing to undergo a regular,independent audit of their work for the City;Mr.Ames replied in the affirmative. 2)Walnut Creek Watershed Management Authority —Director of Development Services Deets reviewed the purpose and function of the Walnut Creek Watershed Management Authority,noting an upcoming 04/29 public meeting. Public Hearings: 1)On an an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa, by changing certain property therein from A-1 to C-1A (Hermann Property)—Mayor Peard opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Director of Development Services Deets presented on the rezoning request,stating that the Planning 8 Zoning Commission recommendation that the application move forward for City Council consideration was not a unanimous vote.Mr.Deets reviewed the history of annexation of the subject property, stating that the preannexation agreement included language that the City Council could consider rezoning the parcel to commercial.City staff have been working with the subject property owners to obtain easements and right-of-way for the SE Westown Pkwy./SE LA Grant Pkwy.Intersection Improvements Project,and during those negotiations,the Hermanns asked for a City-initiated rezoning of the property.Mr.Deets discussed zoning of and potential future uses for the surrounding properties,as well as potential access points for the subject property.Dan Manning,the attorney representing Jim and Carolyn Hermann, stated that his clients have anticipated the commercial rezoning of their property for some time and that the rezoning request appears consistent with plans in the area.Mayor Peard welcomed public comment on the matter:1)Sue Portz,2085 SE Oxford Dr.,expressed concern that rezoning of the subject property would allow two commercially-zoned parcels in the area with no specific plans for development,and that the City's Comprehensive Plan showed the subject property as a neighborhood residential district.She added that commercial development would increase traffic and possibly lead to more accidents.2) Brian Portz,2085 SE Oxford Dr.,also spoke about the proposed rezoning conflicting with the Comprehensive Plan and his concern that certain businesses,specifically gas stations, could develop the property without any restrictions on the zoning.He also asked for additional berming and landscaping along the north side of the subject property. 2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by changing certain property therein from C-1 to C-1 and PD-1 (Cove at Kettlestone)— Mayor Peard opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Director of Development Services Deets presented on the rezoning request,noting that the property is located within the overall Kettlestone master plan area and that City staff is working with the applicant on a planned development that would incorporate the Kettlestone draft design standards.James Lindgren with Rock Equity Holdings,developer of the property,stated that his company was working with the Cities of Waukee and West Des Moines,as well as adjacent property owners,to improve SE Waco Pl.as a private project.No comments were made by the public present. 3)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by changing certain property therein from R-2 to R-4 (Somerset Oaks)—Mayor Peard opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Director of Development Services Deets presented on the rezoning request,stating that the project planned for the subject property included ranch- style townhornes with a lower density than allowed in R-4 zoning.Erin Ollendike with Civil Design Advantage (CDA),project engineer,introduced herself if there were any questions on the project.No comments were made by the public present. (I)Public Hearing Action Items: 1)ORDINANCE:Consideration of approval of an ordinance to amend Chapter 300, Zoning Ordinance,City of Waukee,iowa,by changing certain property therein from A- 1 to C-1A (Hermann Property)(introduction;first reading J —Council Member Blanchard moved to table the matter for consideration by the full council;seconded by Council Member Harvey.After a brief procedural discussion,Council Member Blanchard introduced the ordinance and moved to table consideration of the matter;seconded by Council Member Harvey.Council Member Harvey asked if C-1A zoning allowed for gas stations;Mr.Deets replied that the zoning district allowed for convenience stores,which often include gas sales. Council Member Harvey echoed the concerns mentioned during the public hearing that there would be two commercially-zoned parcels in the area with no current plans for development. He also asked for clarification on access to the Waukee United Methodist Church property to the north.City Administrator Moerman stated that Mr.Deets would be unavailable for the 04/20 City Council meeting,so the matter would need to be tabled to a different,specific date.Council Member Blanchard reintroduced the ordinance and amended the motion to table consideration of the matter until the 05/04 meeting for discussion and vote;Council Member Harvey amended the second.Results of vote:Ayes:Blanchard,Harvey,Peterson. Nays:None.Absent:Harrison,Hughes.Motion to table carried 3 —0 —2. 2)ORDINANCE:Consideration of approval of an ordinance to amend Chapter 300, Zoning Ordinance,City of Waukee,iowa,by changing certain property therein from C- 1 to C-1 and PD-1 (Cove at Kettlestone)Iintroduction;first reading J —Council Member Harvey introduced the ordinance and moved to approve the first reading of the ordinance in title only;seconded by Council Member Peterson.Council Member Peterson asked about signage requirements for mixed use properties;Director of Development Services Deets answered that the planned development document would define signage requirements, which will follow both the City code and the Kettlestone draft design guidelines.Council Member Harvey voiced concern about increased traffic,specifically those vehicles turning left onto University Ave.;Mr.Deets noted that part of an analysis on the paving of SE Waco Pl.would include a recommended timeline for installation of a traffic signal at SE University Ave./SE Waco Pl.There are also future plans for a traffic signal at SE University Ave./SE Brick Dr.Council Member Harvey asked about plans for the railroad crossing on SE Waco Pl.;Mr.Deets replied that such improvements would be a joint project between the Cities of Waukee and West Des Moines.Results of vote:Ayes:Blanchard,Harvey,Peterson.Nays: None.Absent:Harrison,Hughes.Motion carried 3 —0 —2. 3)ORDINANCE:Consideration of approval of an ordinance to amend Chapter 300, Zoning Ordinance,City of Waukee,iowa,by changing certain property therein from 8- 2 to R-4 (Somerset Oaks)Iintroduction;first reading J —Council Member Harvey introduced the ordinance and moved to approve the first reading of the ordinance in title only;seconded by Council Member Blanchard.Results of vote:Ayes:Blanchard,Harvey, Peterson.Nays:None.Absent:Harrison,Hughes.Motion carried 3 —0 —2.
