Call to Order —The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:33 p.m,in the Council Chambers at Waukee City Hall,230 W.Hickman Rd.
Pledge of Allegiance
Roll Call —The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Casey L.Harvey,Shelly Hughes,Rick Peterson.Absent:Council Member

Also present;City Administrator Tim Moerman,Director of Finance Linda Burkhart,Director of

Open Forum —Mayor Peard invited comments regarding agenda item J2 (Hermann Property
rezoning application):1)Dan Manning,the attorney representing Jim and Carolyn Hermann,
introduced himself in the event of any questions regarding the application.2)Jeremy Sprague,
2165 SE Oxford Dr.,presented a petition signed by neighbors in the Warrior Ridge and Grant
Park developments that oppose the rezoning application.Mr.Sprague expressed his objection
to the application,stating that he did not see the need for such rezoning due to a number of
commercial properties in the nearby Kettlestone development and the University Ave.corridor.
He also voiced safety concerns regarding an increase in vehicular and pedestrian traffic in the
area,especially near school zones.3)Sue Portz,2085 SE Oxford Dr.,restated the concerns
she voiced during the 04/06 public hearing regarding additional commercially-zoned property in
the area with no development plan.She also expressed concern that a possible gas station on
the property would make alcohol and tobacco easily accessible to children attending nearby
schools.4)Brian Portz,2085 SE Oxford Dr.,also reiterated the concerns he noted during the
04/06 public hearing,specifically that the proposed rezoning did not follow the City's
Comprehensive Plan.He added that the property should not be rezoned until a development
plan is brought forward.5)Jim McGraw,2145 SE Oxford Dr.,spoke in opposition to the
rezoning application,citing traffic and safety concerns.He noted his desire that the property be
zoned for residential development,or that any commercial rezoning be approved after submittal
of a development plan that also prohibits gas stations.
Agenda Approval —Council Member Harvey moved to approve the agenda,tabling item G1
until the May 18,2015 regular meeting of the Waukee City Council;seconded by Council
Member Hughes.Results of vote:Ayes:Blanchard,Harvey,Hughes,Peterson.Nays:None.
Absent:Harrison.Motion carried 4 —0 —1.
Mayor's Report —The Waukee Fire Department pancake breakfast and food drive will be held
05/09;the open house reception for 2014 Citizen of the Year Terry Snyder is 05/14;the City-
Wide Clean-up is 05/09.Certain council members,City staff and Mayor Peard will take part in
the Greater Des Moines Partnership's annual trip to Washington,DC,on 05/10 through 05/12.
Mayor Peard acknowledged and thanked the 8'"grade South Middle School track team and their
coach for volunteering to clean trash in an area in the community.

first reading of the ordinance in title only;seconded by Council Member Blanchard.Director
of Development Services Deets briefly reviewed the request,noting that it was a City-
initiated rezoning as part of an agreement with the Hermanns.He noted that the SE L.A.
Grant Pkwy./SE Westown Pkwy.intersection was anticipated to have fairly significant traffic
in the future.He then reviewed access issues with the Hermann property that could limit
some uses.Council Member Blanchard asked about traffic counts near the Waukee High
School;Mr.Deets speculated that traffic counts may be a high as 20,000 vehicles per day in
that area.Council Member Peterson felt that commercial properties at the SE L.A.Grant/SE
Westown Pkwy.intersection may be enticing for development,then asked if there was a
timeline for development of the property at the southwest corner of that intersection;Mr.
Deets replied in the negative.Council Member Hughes asked for clarification on the limited
access to the Hermann property;Mr.Deets answered that access would be limited to the
extreme north and west sides of the property due to planned intersection improvements.
Council Member Harvey asked about the size of the Hermann property;Mr.Deets replied it
was approximately 4 acres.Council Member Harvey stated he saw no reason to deny the
rezoning application,as some amount of commercial development in the area makes sense
and he didn't see the property developing as residential.Council Member Blanchard agreed
that commercial development is needed in the area and compared it with the commercial
district across from Waukee High School.Council Member Hughes thanked those residents
who took an interest in the matter,then noted that SE Westown Pkwy.has always been
planned as a major corridor and that she also did not forsee residential development for the
Hermann property.Results of vote:Ayes:Blanchard,Harvey,Hughes,Peterson.Nays:
None.Absent:Harrison.Motion carried 4 —0 —1.

reviewed the application.Erin Ollendike with Civil Design Advantage (CDA),engineers for
the project,introduced herself if there were any questions.Council Member Harvey stated
that the project location was appropriate,but that the concept plan was not harmonious with
the other development in the area.He expressed confidence that his concerns would be
addressed during the site planning stage.Council Member Hughes echoed Council Member
Harvey's concerns regarding the concept plan.Council Member Blanchard stated the
council was considering a lot of apartment development lately.Results of vote:Ayes;
