Call to Order —The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:34 p.m.in the Council Chambers at Waukee City Hall,230 W.Hickman Rd.
Pledge of Allegiance
Roll Call —The following members were present:Mayor William F.Peard;Council Members
Shane Blanchard,Brian Harrison,Casey L.Harvey,Shelly Hughes,Rick Peterson.Absent:
None.(Council Member Peterson left the meeting at 6:56 p.m.)

Open Forum
Agenda Approval —Council Member Peterson moved to approve the agenda,tabling consent
agenda item J10 until the August 17,2015,regular meeting of the VVaukee City Council;
seconded by Council Member Hughes.Results of vote:Ayes:Blanchard,Harrison,Harvey,
Hughes,Peterson.Nays;None.Motion carried 5 —0.
Mayor's Report —Mayor Peard attended the Grant Park ribbon cutting on 07/30.On 08/04,he
and City Administrator Moerman will meet with representatives from the Greater Des Moines
Partnership and VVaukee Area Chamber of Commerce.Also on 08/04,Mayor Peard will take
part in Public Safety Day.
Presentations:
1)Recognition of outgoing Waukee Planning and Zoning Commissioner Wayne Johnson
—Certificate of Appreciation presented to Wayne Johnson.
2)Snyder 8 Associates intersection review [recreational trail crossing at SE Alice's
Road/SE Olson Drive]—Mark Perington with Snyder &Associates briefly reviewed the
study conducted for the subject crossing,recommending no additional traffic control devices
at this time.He added that such devices may be needed in the future as traffic increases
along the SE Alice's Rd.corridor.Wrye Downs,address not given,who had requested
traffic control devices at the subject crossing,cited a long wait time for trail users crossing at
SE Alice's Rd.and asked for installation of a flashing pedestrian crossing signal,similar to
those at school crossings.Council Members Peterson and Harrison stated that the City
would continue to monitor safety issues at trail crossings.Director of Public Works Gibson
noted plans for temporary traffic signals at SE Alice's Rd./SE Olson Dr.that would create
more of a gap between northbound vehicles.Council Member Harvey asked if a flashing
pedestrian crossing signal would be helpful at the subject crossing;Mr.Perington replied
that such a signal would likely be the next step if a conflict arises.
Public Hearings:
1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,by
changing certain property therein from A-1 to R-1,a parcel to be known as Daybreak
Plat 2 —Mayor Peard opened the public hearing and asked if any written correspondence
had been received;City Clerk Schuett replied in the negative.Director of Development
Services Deets briefly reviewed the rezoning application and concept plan,noting a parcel
for parkland dedication and a recreational trail extension across Ashworth Rd.Caleb Smith
with McClure Engineering introduced himself on behalf of the developer.Mayor Peard
asked for public comment on the matter:1)Jennifer Miller,32059 U Place,Adel,asked what
kind of disclosure the City planned to provide potential Daybreak Plat 2 buyers regarding an
existing hog confinement operation near the development.She stated that homeowners in
Stone Prairie had been given false information by developers about relocation of the New

Pioneer Gun Club facility.She then reviewed various human health issues attributed to hog
confinement operations.City Administrator Moerman noted that the City is not required to
make such a disclosure,as it is the responsibility of potential buyers to make such
investigations.Council Member Harvey agreed that the City did not have a responsibility to
make such a disclosure.He noted his childhood experience of growing up on a farm,adding
that buyers looking to purchase property in the country in Iowa need to be self-aware that
there are certain smells and chemical applications associated with nearby farming
operations.Ms.Miller noted possible pending lawsuits elsewhere in the state related to hog
confinement operations and asked if the City had a response;Council Member Harvey
replied that he would need to see documentation related to those pending lawsuits.Council
Member Hughes stated that she grew up on a farm and agreed that it is difficult to see open
country developed,but cited residential development in the comprehensive plan for the
Daybreak Plat 2 area.She echoed Council Member Harvey's comments regarding buyer
responsibility to research what surrounds a property and what may locate there in the future.
Ms.Miller did not think it fair for Council Members Harvey and Hughes to project their
positive rural experiences to those of others and noted it was more a matter of disclosure.
Council Member Blanchard agreed that City disclosure is unnecessary,echoing comments
about personal responsibility to conduct research before purchasing a property.Council
Member Harrison also stated that disclosure was not the City's responsibility.City Attorney
Brick noted potential liability issues if the City made such disclosures,explained the
difference between moving near a supposed nuisance and having that nuisance move near
existing development,and stated that liability would go against a developer or builder if they
were to mislead potential buyers about existing nuisances.

briefly reviewed the rezoning application,noting certain additional steps required following
rezoning approval and prior to issuance of a building permit.Pete McNally of the Grinnell
Group,representing TowerCo and future tower tenant iWireless,introduced himself.Council
Member Peterson asked about tower design;Mr.McNally stated it would be a monopole
without guy-wires.Mayor Peard asked for public comment on the matter:1)Mark
Jorgenson,595 SE Dallas Point Drive,spoke in opposition to the rezoning,stating the cell
tower would be an eyesore that would provide no benefit to residents.
On plans,specifications,form of contract and estimate of cost [2015 Grand Prairie
Parkway Gas Main Extension Project]—Mayor Peard opened the public hearing and
asked if any written correspondence had been received;City Clerk Schuett replied in the
negative.Director of Public Works Gibson briefly reviewed the project.Council Member
Harvey asked for clarification on the expected lifespan of the project;Mr.Gibson replied that
redundancies built into the project would extend the life to 4-5 years,after which the lines will
be upgraded to meet increased demands on the system.No comments were made by the
public present.

Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of yyaukee,by changing certain property therein from A-1 to R-1,a
parcel to be known as Daybreak Plat 2 (introduction;first reading j —Council Member
Blanchard introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Harvey.Council Member Harvey referenced an email he
received from a resident concerned that the area in question is losing its rural character,but
Council Member Harvey stated that the project fits with the comprehensive plan.He

reiterated comments he made during the public hearing on the rezoning application,
restating that people buying property so close to rural areas need to be self-aware of the
potential for farm smells.Council Member Hughes agreed with Council Member Harvey,
adding that the City is trying to responsibly handle growth and development and that the
subject area is a logical place for development.Results of vote:Ayes:Blanchard,Harrison,
Harvey,Hughes,Peterson.Nays:None.Motion carried 5 —0.
Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning

Blanchard introduced the ordinance and moved to approve the first reading in title only;
seconded by Council Member Harvey.Council Member Harrison asked about cell tower site
selection;Director of Development Services Deets noted provisions in the Waukee Municipal
Code regarding co-location of towers and that there are currently no stand-alone monopoles
in the city.Mayor Peard asked if the tower would provide any direct benefit to residents;Mr.
Deets replied that such towers are needed for cellular activity and that the proposed location
was not highly visible from major roadways.Pete McNally of the Grinnell Group,
representing TowerCo and future tower tenant iWireless,stated that the proposed location
fits best into the network.He noted that major development has not yet occurred near the
location and discussed improvements for emergency services and general cellular coverage.
Council Member Blanchard agreed that the proposed tower seemed to be in a good location.
Council Member Peterson stated that he would vote in favor of the first consideration of the
ordinance,but added that cities should push cellular providers to find alternatives to towers.
He referenced light pole antennas being used in West Des Moines.Mr.McNally replied that
there is currently no technology to replace towers and that there are existing cellular towers
in West Des Moines providing umbrella coverage under which the antennas provide
coverage for a limited area.Council Member Harvey asked about the proximity of the
proposed tower to existing Clive homes;Mr.Deets speculated that there was nearly "/4 mile
distance between the two areas.Council Member Harvey asked how City ordinances
regulating cellular towers compared with those for windmills;Mr.Deets answered that the
site distance and tower location regulations were similar.City Administrator Moerman stated
that staff would provide the City Council with additional information related to cellular tower
sites.Results of vote:Ayes:Blanchard,Harvey,Hughes,Peterson.Nays:Harrison.Motion
carried 4 —1.
Resolution:Consideration of approval of a resolution approving plans,specifications,
form of contract and estimate of cost J2015 Grand Prairie Parkway Gas Main
Extension Proj ectJ —Council Member Harvey moved to approve the resolution;seconded
by Council Member Harrison.Results of vote:Ayes:Blanchard,Harrison,Harvey,Hughes,

Resolution:Consideration of approval of a resolution awarding contract (2015 Grand
Prairie Parkway Gas Main Extension ProjectJ —Council Member Harvey moved to
approve the resolution;seconded by Council Member Peterson.Director of Public Works
Gibson briefly reviewed the bid results,recommending award to Profile Contracting of Le
Claire,IA,in the amount of $309,344.24.Results of vote;Ayes:Blanchard,Harrison,Harvey,

Resolution:Consideration of approval of a resolution approving preliminary plat for
Glynn Village Plat 10-Council Member Harvey moved to approve the resolution;
seconded by Council Member Peterson.Director of Development Services Deets briefly
reviewed the plat,which is the final phase of the Glynn Village development.Plans include
extending S.Warrior Ln.to connect with Westown Pkwy.,adding roadway connections with
Warrior Ridge and Hemingway,and paving a portion of Westown Pkwy.Council Member
Harvey asked if there would be landscape buffering between the proposed plat and
development to the east;Doug Saltsgaver with ERG replied in the affirmative on behalf of
the developer,noting that the east side would be planted with prairie grasses for drainage.
Council Member Harrison asked for clarification on the large proposed detention pond,
specifically related to drainage during a major rain event;Mr.Saltsgaver answered that
Glynn Village has multiple drainage basins and that the Plat 10 detention pond would hold a
significant amount of water.Any water over the capacity of the pond would discharge into
the existing stream.Council Member Hughes asked about recreational trails;Mr.Deets
reviewed the proposed locations for Glynn Village and future creek bank trail systems.
