(A)Call to Order —The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem Peterson at 5:32 p.m.in the Council Chambers at Waukee City Hall,230 W.Hickman
Rd.

(C)Roll Call —The following members were present:Council Members Shane Blanchard,Casey L.
Harvey,Shelly Hughes,Rick Peterson.Absent:Mayor William F.Peard,Council Member Bdan
Harrison.(Council Member Blanchard left the meeting at 6:20 p.m.)

3)Resolution:Consideration of approval of the Independent Auditor's Final Report forthefiscalyearendingJune30,2015 —Council Member Harvey moved to approve the
resolution;seconded by Council Member Hughes.Results of vote;Ayes;Blanchard,
Harvey,Hughes,Peterson.Nays:None.Absent:Harrison.Motion carried 4 —0 —1.

(H)Public Hearings:
1)On the proposed sale of real property owned by the City of Waukee,Iowa,located atthenorthwestcornerof5'"Street and University Avenue —Mayor Pro Tem Peterson
opened the public hearing and asked if any written correspondence had been received;City
Clerk Schuett replied in the negative.Director of Development Services Deets briefly
reviewed the proposed sale of the subject property to the Waukee Community School
District for development as a transportation facility.Mr.Deets reviewed a development
concept plan,which includes a shared fueling station for both the school district and City,as
well as a regional detention pond which will be owned by the City.The proposed sale would
include $200,000 worth of site improvements by the school district on behalf of the City,as
well as an exchange of the subject property for a district-owned parcel located along
Westown Pkwy.near the Stone Prairie subdivision.No comments were made by the public
present.
2)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,byrezoningandchangingcertainpropertythereinfromA-1 to M-1,a parcel to be knownasWaukeeTransportationFacility—Mayor Pro Tem Peterson opened the public hearing
and asked if any written correspondence had been received;City Clerk Schuett replied in thenegative.Director of Development Services Deets briefly reviewed the rezoning application,
which pertains to the property proposed for sale to the Waukee Community School District.
No comments were made by the public present.

On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,iowa bychangingcertainpropertythereinfromA-1 to R-2,R-4,and C-1,a parcel known as theBeasleyProperty—Mayor Pro Tem Peterson opened the public hearing and asked if any
written correspondence had been received;City Clerk Schuett replied in the negative.
Director of Development Services Deets briefly reviewed the rezoning application for the
property located southwest of the intersections of Alice's Rd.and Douglas Pkwy.Mr.Deets
reviewed the development concept plan,noting a parcel to be dedicated to the City for the
development of the Alice's Road Historic District park.Erin Ollendike with Civil Design
Advantage (CDA)introduced herself to the City Council to answer any questions on behalf of
the applicant.Mayor Pro Tem Peterson asked for public comment on the matter:1)Rodney
Paul Backsmeier,3690 NW 169'"St.,Clive,spoke in opposition to the rezoning,stating that
the commercial portion would be detrimental to the atmosphere of Midwestern living.He
noted that there is no commercial development along the length of Douglas Pkwy,west of
the Pilot Truck Stop area.He added that Waukee residents were given notice of the public
hearing,but that Clive residents were not.He asked that the City Council put consideration
of the application on hold for 60 days to allow other city neighbors to take an active part in
the discussion.He also requested additional environmental,traffic,water runoff and light
pollution studies.2)Jason Stone,16838 Airline Dr.,Clive,reiterated Mr.Backsmeier's
request to postpone consideration of the matter.He understands that Clive also intends to
allow commercial development at the subject intersection and he would like the neighbors tobegivenmoretimetopondertheconcept.
On the the vacation of a portion of a Public Utility Easement [Lot 9 of Duprez Place]—
Mayor Pro Tem Peterson opened the public hearing and asked if any written
correspondence had been received;City Clerk Schuett replied in the negative.Director of
Development Services Deets briefly reviewed the portion of the easement to be vacated,
noting that a previous property owner had constructed a detached garage in a portion of the
easement.There are no existing utilities in the easement area where the garage was
constructed.The property owners request that the City vacate a portion of the easement to
allow for clean title for the property.No comments were made by the public present.

Resolution:Consideration of approval of a resolution approving the sale of real

Street and University Avenue —Council Member Blanchard moved to approve the
resolution;seconded by Council Member Harvey.Director of Development Services Deets
stated that,pending approval of the sale by the City Council,the Waukee Community School
District School Board will take action on items related to the sale.Council Member Peterson
noted that the property sale was a good first step in a collaborative effort with the school
district to construct a new transportation facility.Council Member Hughes asked when the
transportation facility would be open;Mr.Deets replied that the school district planned to bid
the project in February 2016 with construction in the Spring.Council Member Peterson
asked that the City keep aware of increased traffic in the area;Mr.Deets reviewed planned
ingress/egress points for the property.Results of vote:Ayes:Blanchard,Harvey,Hughes,Peterson.Nays:None.Absent:Harrison.Motion carried 4 —0 —1.(Resolution ff15-404)
Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning
Ordinance,City of Waukee,iowa,by rezoning and changing certain property therein
from A-1 to N-1,a parcel to be known as Waukee Transportation Facility(introduction;
first readingJ —Council Member Harvey introduced the ordinance and moved to approve
the first reading in title only;seconded by Council Member Hughes.Council Member Harvey
asked about maintenance of the portion of University Ave.that abuts the subject property;
Director of Development Services Deets replied that the Waukee Community School District
would be responsible for half of the maintenance costs until such time as University Ave.is
paved.Results of vote:Ayes:Blanchard,Harvey,Hughes,Peterson.Nays:None.Absent:
Harrison.Motion carried 4 —0 —1.
Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning
Ordinance,City of Waukee,iowa by changing certain property therein from A-1 to R-2,
R-4,and C-t,a parcel known as the Beasley Property (introductionl first readingj-Council Member Blanchard introduced the ordinance and moved to approve the first readingintitleonly;seconded by Council Member Harvey.Director of Development Services Deetsbrieflyreviewedrezoningapplicationprocedures,including notification of surroundingpropertyownerswithintheCityofWaukeeandpublichearingsignagerequirements.HeaddedthatAlice's Rd./Douglas Pkwy.was planned as a major intersection with significanttrafficandthattheCityofClive's long-range plans for the area near the intersection includedcommercialdevelopment.Council Member Harvey asked if it was common practice to havesinglefamilylotsplannedinsuchcloseproximitytocommercialdevelopment;Mr.Deetsrepliedthatitwasanunusualrequest.Council Member Harvey noted several dry basinsincludedontheconceptplanandaskedaboutmaintenanceresponsibilities;Mr.Deetsstatedthatsuchresponsibilitieswouldbeaddressedduringplatting.In response to some oftheconcernsmentionedduringthepublichearingontherezoningapplication,CouncilMemberHarveyexpressedhisconfidenceintheprojectengineer's surface water flowageanalysis,noted that approval of the ordinance required three separate readings so that adelaywasunnecessary,and voiced his support for the rezoning application.CouncilMemberHughesaskedforclarificationonplansfortheextensionofDouglasPkwy.andquestionedhowtheCityofCliveplannedtodeveloppropertytotheeast;Mr.DeetsreviewedtheDouglasPkwy.extension plans,then stated that he was unsure of Clive's long-range plans for development in the area.Council Member Peterson reminded those inattendancethattherewouldbetwomorereadingsoftheordinancebeforefinalapproval.Results of vote:Ayes;Blanchard,Harvey,Hughes,Peterson.Nays:None.Absent:Harrison.Motion carried 4 —0 —1.
