WAUKEE CITY COUNCIL MINUTES
October 3,2016
(A)Call to Order —The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 5:30 p.m.in the Council Chambers at Waukee City Hall,230 W.Hickman Rd.
(B)Pledge of Allegiance
(C)Roll Call —The following members were present:Mayor William F.Peard;Council Members
Anna Bergman,Brian Harrison,Shelly Hughes,Larry R.Lyon,Rick Peterson.Absent None.
Also present:City Administrator Tim Moerman,Finance Director Linda Burkhart,Senior Planner
Andy Kass,Public Works Director John Gibson,Parks and Recreation Director Matt Jermier,
Marketing and Communications Director Summer Evans,Police Chief John Quinn,City Clerk
Rebecca D.Schuett,City Attorney Steve Brick.

(E)Agenda Approval —Council Member Lyon moved to approve the agenda;seconded by Council
Member Harrison.Results of vote:Ayes:Bergman,Harrison,Hughes,Lyon,Peterson.Nays:
None.Motion carried 5 —0.
(F)Mayor's Report —Mayor Peard discussed the 10/16 closing of Sugar Creek Municipal Golf
Course for sewer improvements,the Waukee Police Department Thanksgiving food basket
drive,and early voting options for the 2016 general election.
(6)Presentations:
1)Waukee Public Library Board of Trustees —Report made by Trustee Brian Hughes.
2)Waukee Planning 8 Zoning Commission report —Report made by Commissioner Scott
Fontenot.
3)Proclamation:In recognition of Randy Jensen for his work on the Raccoon River
Valley Trailhead Public Art Project —Mayor Peard presented Mr.Jensen with the
proclamation and Key to the City.
4)Proclamation:In recognition of Jim Miller for his work on the Raccoon River Valley
Trailhead Public Art Project —Mayor Peard presented Mr.Miller with the proclamation and
Key to the City.
(H)Public Hearings:
1)On the annexation of consenting properties by the City of Waukee,Iowa,with
consideration of the annexation taking place immediately thereafter [Shadow Creek
Estates and Currier Property]—Mayor Peard opened the public hearing and asked if any
written correspondence had been received;City Clerk Schuett replied in the negative.
Senior Planner Kass presented on the application.The properties in question were recently
severed from the City of Clive so that the property owners were free to submit annexation
applications with Waukee.No comments were made by the public present.
2)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,iowa,by
rezoning and changing certain property therein from A-1 to R-2,a property to be
known as Fox Creek Estates Plat 10 —Mayor Peard opened the public hearing and asked
if any written correspondence had been received;City Clerk Schuett replied in the negative.
Senior Planner Kass presented on the application,noting that the applicant has asked the
City to begin rezoning the property while annexation is still in process.The rezoning will not
go into effect until the annexation is approved by the City Development Board.Emily
Harding with Civil Design Advantage (CDA),representing the applicant,introduced herself
for any questions.No comments were made by the public present.
3)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing certain property therein from A-1 to R-2 and R-4/PD-1,a
property to be known as Indi Run —Mayor Peard opened the public hearing and asked if
any written correspondence had been received;City Clerk Schuett replied in the negative.
Senior Planner Kass presented on the application.The concept plan includes detached

townhomes that would front N.Warrior Ln.and have rear-loading garages.Parkland will be
dedicated along the western edge of the property.Council Member Hughes noted a need
for detached townhomes in the community.Emily Harding with Civil Design Advantage
(CDA),representing the applicant,introduced herself for any questions.Mayor Peard asked
for public comment on the matter:1)Mike Leatherman,35 NE Gracewood Dr.,asked about
the proposed price point for the townhomes and how it would effect his property values;
rezoning applicant Eric Grubb replied that the townhomes would likely sell for $250,000-
280,000,adding that the townhomes,while smaller,would have a price per square foot
comparable to single family homes.Mr.Leatherman then expressed his concern that there
was no landscape buffer planned between the proposed townhomes and N.Warrior Ln.;Mr.
Kass explained that the buffer was not needed due to the fact that the townhomes would be
rear-loading.Mr.Grubb added that he intended to landscape along the front of the
townhome units.Finally,Mr.Leatherman worried that additional residents would be
attracted to the private pond that was the responsibility of his homeowners association.

known as Outlot Z of Williams Pointe Plat 14 —Mayor Peard opened the public hearing
and asked if any written correspondence had been received;City Clerk Schuett replied in the
negative.Senior Planner Kass presented on the application,reviewing some of the rezoning
history of the parcel and stating that the current owner requested that the zoning revert back
to C-1/PD-1.The owner has a buyer interested in developing self-storage units on the
property in question,which City staff believes is a reasonable use for the property.Monte
Applegate with Snyder 8 Associates,representing the applicant,introduced himself for any
questions.No comments were made by the public present.

Brandon's Reserve —Council Member Bergman moved to approve the resolution;
seconded by Council Member Lyon.Senior Planner Kass briefly reviewed the plat.Council
Member Peterson asked if Lots 4 and 5 will have ingress/egress easements off S.Warrior
Ln.;David Bentz with Bishop Engineering,representing the developer,replied in the
affirmative.Council Member Lyon asked for clarification on the large number of trees
removed from the property;Mr.Bentz stated that they attempted to keep trees along the
perimeter of the plat,but that overall grading had been necessary almost to the property line.
He added that many of the trees were scrub trees that required removal.Mayor Peard noted
that he had spoken with City staff about the matter and they agreed that the trees were of
poor quality.City Administrator Moerman added that most of the property required extensive
grading due to its topography.Council Member Hughes asked if a significant retaining wall
would be needed for Lots 4 and 5 to be buildable;Mr.Bentz replied in the affirmative.
