SPECIAL MEETING
May 23,2017
A.Call to Order —The special meeting of the Waukee City Council was called to order by Mayor Peard at
8:08 a.m.at Waukee City Hall,230 W.Hickman Rd.
B.Roll Call —The following members were present:Mayor William F.Peard;Council Members Anna
Bergman,R.Charles Bottenberg,Brian Harrison,Larry R.Lyon.Absent:Council Member Shelly
Hughes.(Council Member Hughes began participation via telephone at 8:15 a.m.)
Also in attendance:City Administrator Tim Moerman,Development Services Director Brad Deets,
Marketing and Communications Director Summer Evans,City Clerk Rebecca D.Schuett,City Attorney
Steve Brick.
C.Agenda Approval —Council Member Bergman moved to approve the agenda;seconded by Council
Member Harrison.Results of vote:Ayes:Bergman,Bottenberg,Harrison,Lyon.Nays:None.Absent:
Hughes.Motion carried 4 —0 —1.
D.Closed Session:Pursuant to Code of iowa t)21.5(1)(c)to discuss strategy with counselin
matters that are presently in litigation or where litigation is imminent where its disclosure would
be likely to prejudice or disadvantage the position of the governmental bodyin that litigation—
Council Member Lyon moved to close the regular session and enter closed session pursuant to Iowa
Code r321.5(1)(c);seconded by Council Member Bergman.Results of vote:Ayes:Bergman,
Bottenberg,Harrison,Lyon.Nays:None.Absent:Hughes.Motion carried 4 —0 —1.Council entered
closed session at 8:09 a.m.
CLOSED SESSION,during which Council Member Hughes began participation via telephone at 8:15
a.m.
Council entered regular session at 8:18 a.m.
E.Action Items:
1)Consent Agenda:Council Member Bergman moved to approve the Consent Agenda;seconded

A.Consideration of approval of a resolution approving the temporary closing of SE Belfry Dnve from 142'
Street west to SE Brentwood Drive on Monday,May 29,2017,between the hours of 4:00 p.m.and 9:00
p.m.for the purpose of a neighborhood block party (Resolution ¹17-248)
B.Consideration of approval of a resolution approving the temporary closing of SE Rwerbirch Lane from
SE Willowbrook Drive to SE Wildflower Drive on Sunday,June 4,2017,between the hours of 4:00 p.m.
and 8:00 p.m.for the purpose of a neighborhood block party (Resolution ¹17-249)
C.Consideration of approval of a resolution correcting a scnvener's error in Payment Estimate No.5 to
Pohlmeier Construction,inc.,for the Southwest Area Trunk Sewer Extension Project,so that the total
corrected amount is $143,873.70 (Resolution ¹17-250)
D.Consideration of approval of a resolution correcting a scrivener's error in Payment Estimate No.5 (Final)
to Rognes Corp.for the Northwest Area Trunk Sewer Extension Project Phase 1,so that the total
corrected amount is $14,536.33 (Resolution ¹17-251)
E.Consideration of approval of Payment Estimate No.2 to McAninch Corp.for the SE Westown Parkway
Extension and GPP Greenbelt Weirs Project in the amount of $745,022 03
F.Consideration of approval of a motion setting June 19,2017 as the date of public hearing on the
annexation of consenting properties by the City of Waukee,Iowa with consideration of the annexation
taking place immediately thereafter [Ruan Propeity]
2)Resolution:Consideration of approval of a resolution approving payment of claim —Council
Member Harrison moved to approve the resolution;seconded by Council Member Bergman.
Results of vote:Ayes:Bergman,Bottenberg,Harrison,Hughes,Lyon.Nays:None.Motion
carried 5 —0.(Resolution ¹17-252)
3)Ordinance:Consideration of approval of an ordinance amending Chapter 622,concerning
the sale and use of fireworks within the City of Waukee (second,third (final)readings)-
Council Member Harrison moved to approve the second reading of the ordinance in title only,
waive the third reading,and place the ordinance on final passage;seconded by Council Member
Lyon.Results of vote;Ayes:Bergman,Bottenberg,Harrison,Hughes,Lyon.Nays:None.Motion
carried 5 —0.(Ordinance ¹2844)

Council Member Lyon moved to adjourn;seconded by Council Member Harrison.Ayes:All.Nays:None.
