(B)Pledge of Allegiance (C)Roll Call —The following members were present:Council Members Anna Bergman,R.Charles Bottenberg,Shelly Hughes,Larry R.Lyon.Absent:Mayor William F.Peard;Council Member Brian Harrison. Also present:City Administrator Tim Moerman,Finance Director Linda Burkhart,Public Works Director John Gibson,Development Services Director Brad Deets,Community and Economic Development Director Dan Dutcher,Parks and Recreation Director Matt Jermier,Human Resource Director Patty Holden,Marketing and Communications Director Summer Evans,Police Chief John Quinn,City Clerk Rebecca D.Schuett,City Attorney Steve Brick (D)Open Forum (E)Agenda Approval —Council Member Lyon moved to approve the agenda;seconded by Council Member Bottenberg.Results of vote;Ayes:Bergman,Bottenberg,Hughes,Lyon.Nays:None. Absent:Harrison.Motion carried 4 —0 —1. (F)Mayor's Report —Mayor Pro Tem Bergman presented the Mayor's Report,which noted the success of the BACooN Sizzles Waukee event,reviewed activities scheduled for the City's 4"of July celebration,and reminded residents of fireworks use limitations.Mayor Pro Tem Bergman encouraged all to attend the 06/22 ribbon cutting for the Waukee Veterans Memorial in G.E.Davis Park. (G)Presentations:None (H)Public Hearings: 1)On the annexation of consenting properties by the City of Waukee,iowa,with consideration of the annexation taking place immediately thereafter [Ruan Property]— Mayor Pro Tem Bergman opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Development Services Director Deets presented on the proposed annexation,noting that the application was from one property owner.Mr.Deets also noted that an annexation moratorium agreement with the City of West Des Moines had expired,while one with the City of Van Meter remained in effect.Mr.Deets discussed the City utilities that would be provided to the subject property.No comments were made by the public present. (I)Public Hearing Action Items: 1)Resolution:Consideration of approval of a resolution approving the annexation of consenting properties by the City of I/I/aukee,iowa jRuan PropertyJ —Council Member Bottenberg moved to approve the resolution;seconded by Council Member Lyon.Development Services Director Deets anticipated an August 2017 consideration by the City Development Board,pending council approval of the annexation.Results of vote:Ayes:Bergman,Bottenberg, Hughes,Lyon.Nays:None.Absent Harrison.Motion carried 4 —0 —1.(Resolution ¹17-280) (J)Action Items 1)Consent Agenda:Council Member Lyon moved to approve the Consent Agenda;seconded by Council Member Bottenberg.Results of vote:Ayes:Bergman,Bottenberg,Lyon.Nays:None. (Resolution ¹17-300)Contract awarded to Jasper Construction Services of Newton,IA. 12)Resolution:Consideration of approval of a resolution approving Agreement Concerning Construction of Fence (1060 SE Grant Woods Court)—Development Services Director Deets briefly reviewed the request to construct a 6-foot fence within a landscape buffer easement. Construction on the fence began prior to the builder obtaining a permit;when the builder submitted their application,staff made the builder aware that the fence was within the landscape buffer easement.City staff recommends against approving the fence agreement.Justin Washburn with Caliber Homes,builder of the home on the subject property,requested the allowance of the fence within the landscape buffer easement.He had previously requested that the landscape buffer be removed,but has since amended his request.Mr.Washburn noted the high amount of traffic along University Ave.and that the existing landscape buffer plantings did not offer much screening of the home from the street.Mr.Washburn believes this is a unique lot and asked that the fence be allowed to be constructed on the property line.Council Member Lyon asked how far the proposed fence would be from the existing sidewalk;Mr.Deets replied it would be approximately 15 feet from the sidewalk.Jonathan Ewing,1060 SE Grant Woods Ct., 12 addressed the council and reiterated the request.Council Member Bergman asked if any landscape buffer trees would be within the yard if the fence agreement were approved,noting that if the trees are within a fenced yard,it would be the homeowner's decision if those planting would remain;Mr.Deets replied in the affirmative,adding that a certain number of plantings are required for landscape buffer easements.Council Member Bottenberg asked how many trees would be within the fenced yard;Mr.Deets replied that they would all be within the fenced yard. Council Member Hughes asked which trees would be outside the fence if it were constructed where allowed;Mr.Washburn answered that all the plantings would be outside the fence.
