September 5,2017
(A)Call to Order —The regular meeting of the Waukee City Council was called to order by Mayor Pro
Tem Bergman at 5:37 p.m.in the Council Chambers at Waukee City Hall,230 W.Hickman Rd.
(B)Pledge of Allegiance
(C)Roll Call —The following members were present:Council Members Anna Bergman,Brian Harrison
(wa telephone),Shelly Hughes,Larry R.Lyon.Absent:Mayor William F.Peard,Council Member R.
Charles Bottenberg.(Council Member Harrison ended participation at 5:51 p.m )
Also present:City Administrator Tim Moerman,Finance Director Linda Burkhart,Public Works
Director John Gibson,Development Services Director Brad Deets,Community and Economic
Development Director Dan Dutcher,Parks and Recreation Director Matt Jermier,Police Chief John

(H)Public Hearings:
1)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing certain property therein from A-1 to M-1 and PD-1,a property
known as Bravo Real Estate,LLC —Mayor Pro Tem Bergman opened the public hearing and
asked if any written correspondence had been received;City Clerk Schuett replied in the
negative.Development Services Director Deets briefly reviewed the rezoning request for
approximately 2,100 acres related to the Apple Data Center project.The PD-1 overlay includes
modifications to overall bulk regulations,parking,landscaping and buffering.Mr.Deets reviewed
a concept plan for two initial data center buildings,including exterior elevations.The remaining
acres are planned for future development.All property owners within the subject area have
signed consent forms related to the proposed rezoning;rezoning is contingent upon the sale of
those properties to Apple.No comments were made by the public present.
2)On the disposal of real property by sale to RMCA,LLC.,pursuant to Iowa Code 364.7
(2017)—Mayor Pro Tem Bergman opened the public hearing and asked if any written
correspondence had been received;City Clerk Schuett replied in the negative.Development
Services Director Deets briefly reviewed the property sale,which corrects the right-of-way along
a portion of Northview Dr.due to an alignment modification for that street segment.No
comments were made by the public present.
3)On the vacation of a public water main easement DNaukee Vista Commercial Park,Lots 1-
5]—Mayor Pro Tem Bergman opened the public hearing and asked if any written
correspondence had been received;City Clerk Schuett replied in the negative.Development
Services Director Deets briefly reviewed the easement vacation,which is necessary due to
building location on the subject lots.No comments were made by the public present.
4)On plans,specifications,form of contract and estimate of cost [Windfield/High School
Trail Phase 1 Project]—Mayor Pro Tem Bergman opened the public hearing and asked if any
written correspondence had been received;City Clerk Schuett replied in the negative.Public
Works Director Gibson briefly reviewed the project,noting that easements are still needed for the
project.The Waukee Community School District will reimburse the City for a portion of trail.No
comments were made by the public present.
(I)Public Hearing Action Items:
1)Resolution:Consideration of approval of a resolution approving City of ylfaukee
Comprehensive Plan 2008 amendment —Council Member Lyon moved to approve the
resolution;seconded by Council Member Hughes.Development Services Director Deets noted
that the amendment was related to both the Bravo Real Estate rezoning and the future Waukee

West Urban Renewal Area.The Apple site would be designated as an "Employment Land Use"
within the Comprehensive Plan amendment.Council Member Bergman stated that she would
abstain from the vote,as she has family currently in property sale negotiations with Apple.

B.Resolution:Consideration of approval of a resolution awarding contract —Council
Member Hughes moved to approve the resolution;seconded by Council Member Lyon.
Public Works Director Gibson briefly reviewed the bid tabulation and project schedule,
making recommendation for award to Concrete Professionals of Altoona,IA.Council
Member Lyon asked if the City had prior experience with the vendor;Mr.Gibson replied in
the negative,but noted that other cities recommended their work.Council Member Hughes
amended the motion to approve the resolution,awarding contract to Concrete Professionals
of Altoona,IA,in the amount of $142,405.20;Council Member Lyon amended the second.
Results of vote:Ayes:Bergman,Hughes,Lyon.Nays:None.Absent:Harrison,Bottenberg.
