WAUKEE CITY COUNCIL MINUTES
February 5,2018
(A)Call to Order —The regular meeting of the Waukee City Council was called to order by Mayor Peard
at 5:34 p.m.in the Council Chambers at Waukee City Hall,230 W.Hickman Rd.
(B)Pledge of Allegiance
(C)Roll Call —The following members were present:Mayor William F.Peard;Council Members R.
Charles Bottenberg,Courtney Clarke,Shelly Hughes,Larry R.Lyon.Absent:Council Member Anna
Bergman.(Council Member Hughes left at 6:08 p.m.)
Also present:City Administrator Tim Moerman,Finance Director Linda Burkhart,Development
Services Director Brad Deets,Public Works Director John Gibson,Community and Economic
Development Director Dan Dutcher,Parks and Recreation Director Matt Jermier,Marketing and
Communications Director Summer Evans,Police Chief John Quinn,City Clerk Rebecca D.Schuett,
City Attorney Steve Brick.

Member Clarke.Results of vote:Ayes:Bottenberg,Clarke,Hughes,Lyon.Nays:None.Absent:
Bergman.Motion carried 4 —0 —1.
(E)Closed Session:Pursuant to Code of iowa ('f21.5(1)(c)to discuss strategy with counsel in
matters that are presentlyin litigation or where litigationisimminent whereits disclosure
would be likely to prejudice or disadvantage the position of the governmental bodyin that
litigation —Council Member Hughes moved to close the regular session and enter closed session
pursuant to Iowa Code $21.5(t)(c);seconded by Council Member Clarke.Results of vote:Ayes:
Bottenberg,Clarke,Hughes,Lyon.Nays:None.Absent:Bergman.Motion carried 4 —0 —1.

(F)Open Forum —Council Member Hughes asked why gas utility bills were so high this month;Public
Works Director Gibson noted that gas use doubled for most users due to cold temperatures.
(G)Mayor's Report —The Waukee Community School District bond referendum vote,Iowa League of
Cities Legislative Day,and Alice's Road Corridor Phase 5 public informational meeting are all
scheduled for 02/06.02/16 is the deadline for submittal of nominations for Waukee 2017 Citizen of
the Year.All City offices are closed 02/19 in observance of Presidents'Day.

1)On a proposed Amendment No.1 to the Waukee Central Urban Renewal Plan in the City of
Waukee,State of Iowa —Mayor Peard opened the public hearing and asked if any written
correspondence had been received;City Clerk Schuett replied in the negative.Development
Services Director Deets reviewed the proposed amendment,which addresses certain street
improvements as part of the Decry Brothers development.No additional properties or projects
have been added.No comments were made by the public present.(Council Member Hughes
left at 6:08 p.m.)
2)On a proposal to enter into a Development Agreement with Decry,Decry tk Decry,LLC and
Fred Rose,L.C.—Mayor Peard opened the public hearing and asked if any written
correspondence had been received;City Clerk Schuett replied in the negative.Development
Services Director Deets reviewed the proposed development agreement,which addresses
improvements associated with 10'"St.City staff anticipates the need to realign Ashworth Dr.in
the future.No comments were made by the public present.
3)On plans,specifications,form of contract,and estimate of cost [Northwest Area Trunk
Sewer Extension Project Phase 4]—Mayor Peard opened the public hearing and asked if any
written correspondence had been received;City Clerk Schuett replied in the negative.Public

an economic development area,and that the rehabilitation,conservation,redevelopment,
development or a combination thereof,of such area is necessary in the interest of the
public health,safety or welfare of the residents of the City;designating such area as
appropriate for urban renewal projects;and adopting the Amendment No.1 to the yyaukee
Central Urban Renewal Plan —Council Member Lyon moved to approve the resolution;
seconded by Council Member Clarke.Results of vote:Ayes:Bottenberg,Clarke,Lyon.Nays:

Resolution:Consideration of approval of a resolution approving and authorizing
execution of a Development Agreement by and among the City of Waukee,Decry,Decry tt
Decry,LLC,and Fred Rose,L.C.—Council Member Clarke moved to approve the resolution;
seconded by Council Member Lyon.Council Member Bottenberg asked if the proposed
agreement was consistent with other previously-approved agreements;Development Services
Director Deets replied that the agreement structure was similar.Results of vote:Ayes:
Bottenberg,Clarke,Lyon.Nays:None.Absent:Bergman,Hughes.Motion carried 3 —0 —2.

the resolution;seconded by Council Member Clarke.Results of vote:Ayes:Bottenberg,
Clarke,Lyon.Nays:None.Absent:Bergman,Hughes.Motion carried 3 —0 —2.

B.Resolution:Consideration of approval of a resolution awarding contract —Council
Member Lyon moved to approve the resolution;seconded by Council Member Bottenberg.
Public Works Director Gibson reviewed the bid tabulation,recommending award to J8 K
Contracting of Ames,IA,in the amount of $1,919,226.00.Council Member Lyon amended
the motion to award contract to J8K Contracting of Ames,IA,in the amount of
$1,919,226.00;Council Member Bottenberg amended the second.Council Member Clarke
asked if there were any concerns regarding the bid being so much below the engineer's
estimate;Mr.Gibson replied in the negative.Results of vote:Ayes:Bottenberg,Clarke,

reviewed the proposed amendments,which in specific circumstances will allow the valuation of
building permits to be based on a predetermined minimum valuation.The proposed amendment
to the National Electrical Code (NEC)section is based on that code as adopted by the State of
iowa.Council Member Lyon asked if the State had adopted the NEC with any unusual changes;
Mr.Deets replied he was not aware of any such changes,noting that the City is mandated by the

including building elevations.The buildings are proposed as flex space.Council Member Clarke
asked what uses would be permitted in such flex space;Mr.Deets replied that permitted uses

which is zoned primarily for single family residential development with smaller areas for higher
density residential and commercial.The existing Raccoon River Valley Trail abuts the subject
property and City staff is working with the developer on access to that trail.Council Member
Clarke asked about price ranges proposed for the single family residential lots;Mr.Deets replied
that he was not certain,but that prices would likely be comparable to those in Spring Crest,which
