Council Member Hughes moved to appoint Council Member Bergman as presiding officer in the absence of the mayor and mayor pro tern;seconded by Council Member Clarke.Results of vote; Ayes:Bergman,Clarke,Hughes.Nays:None.Absent:Bottenberg,Lyon.Motion carried 3 —0 —2. (B)Pledge of Allegiance (C)Roll Call —The following members were present:Council Members Anna Bergman,Courtney Clarke,Shelly Hughes.Absent:Mayor William F.Peard;Council Members R.Charles Bottenberg, Larry R.Lyon. Also present;City Administrator Tim Moerman,Finance Director Linda Burkhart,Development Services Director Brad Deets,Community and Economic Development Director Dan Dutcher,Parks and Recreation Director Matt Jermier,Marketing and Communications Director Summer Evans, Police Chief John Quinn,City Clerk Rebecca D.Schuett,City Attorney Steve Brick. (D)Open Forum —1)Dennis Dilley,614 NE Coventry Ln.,introduced himself as representative of a new Waukee chapter of the Lions Club.2)Mike Harris,31471 Ute Ave.,voiced his concerns with stormwater wash-off onto his property from the Daybreak development.3)Joe Kazor,31475 Ute Ave.,noted that he had previously expressed concerns about stormwater run-off from the Daybreak development (02/20/2018 public hearing on The Reserve at Daybreak rezoning),stating that those concerns have come true.He was told at that time that City regulations would protect his property from stormwater damage,but that there was significant standing water on his property following recent rains. (E)Agenda Approval —Council Member Clarke moved to approve the agenda,tabling consideration of Consent Agenda item J1D until the July 2,2018 regular meeting;tabling consideration of Agenda Item J2 until the July 2,2018 regular meeting;tabling consideration of the third reading of the ordinance listed as Agenda Item J6 until the June 19,2018 special meeting;and tabling consideration of Agenda Item J17 until the June 19,2018 special meeting;seconded by Council Member Hughes.Resultsofvote:Ayes:Bergman,Clarke,Hughes.Nays:None.Absent: Bottenberg,Lyon.Motion carried 3 —0 —2. (F)Mayor's Report (G)Presentations:None (H)Public Hearings: 1)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein from A-1 to M-1/PD-1,a parcel to be known as Apple Data Center —Presiding Officer Bergman opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the rezoning application for properties acquired by Apple following approval of their initial rezoning application.No comments were made by the public present. 2)On an ordinance to amend Chapter 222,Building Code Regulations and Penalties for Violations of the Waukee Municipal Code,to insert Section 222A,Residential Rental Code —Presiding Officer Bergman opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Development Services Director Deets reviewed the code as it relates to rental property inspections,noting that state code requires cities with populations greater than 15,000 to establish such programs.The proposed program is based on the International Property Maintenance Code and a full-time code enforcement officer position is being added to administer the program.An amended fee schedule incorporating rental inspection fees will be presented to the council for consideration at a later date.No comments were made by the public present. 3)On intent to commence a public improvement project known as Waukee High School No. 2 Project,Adjacent Roadways and Drainage —Presiding Officer Bergman opened the public hearing and asked if any written correspondence had been received;City Clerk Schuett replied in the negative.Public Works Director Gibson briefly reviewed the project.The process for authorizing the use of eminent domain is standard City policy but does not mean that properties will be acquired through eminent domain.Staff continues negotiations with the affected property owner regarding land acquisition.No comments were made by the public present. Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,iowa,by rezoning and changing certain property therein from A-1 to M-1/PD-f,a parcel to be known as Apple Data Center(introduction;first reading]- Council Member Hughes introduced the ordinance and moved to approve the first reading in title only;seconded by Council Member Clarke.Results of vote:Ayes:Bergman,Clarke,Hughes.
