WAUKEE CITY COUNCIL MINUTES
June 18,2018
(A)Call to Order —The regular meeting of the Waukee City Council was called to order by City
Administrator Moerman at 5:30 p.m.in the Council Chambers at Waukee City Hall,230 W.Hickman
Rd.
Council Member Hughes moved to appoint Council Member Bergman as presiding officer in the
absence of the mayor and mayor pro tern;seconded by Council Member Clarke.Results of vote;
Ayes:Bergman,Clarke,Hughes.Nays:None.Absent:Bottenberg,Lyon.Motion carried 3 —0 —2.
(B)Pledge of Allegiance
(C)Roll Call —The following members were present:Council Members Anna Bergman,Courtney
Clarke,Shelly Hughes.Absent:Mayor William F.Peard;Council Members R.Charles Bottenberg,
Larry R.Lyon.
Also present;City Administrator Tim Moerman,Finance Director Linda Burkhart,Development
Services Director Brad Deets,Community and Economic Development Director Dan Dutcher,Parks
and Recreation Director Matt Jermier,Marketing and Communications Director Summer Evans,
Police Chief John Quinn,City Clerk Rebecca D.Schuett,City Attorney Steve Brick.
(D)Open Forum —1)Dennis Dilley,614 NE Coventry Ln.,introduced himself as representative of a new
Waukee chapter of the Lions Club.2)Mike Harris,31471 Ute Ave.,voiced his concerns with
stormwater wash-off onto his property from the Daybreak development.3)Joe Kazor,31475 Ute
Ave.,noted that he had previously expressed concerns about stormwater run-off from the Daybreak
development (02/20/2018 public hearing on The Reserve at Daybreak rezoning),stating that those
concerns have come true.He was told at that time that City regulations would protect his property
from stormwater damage,but that there was significant standing water on his property following
recent rains.
(E)Agenda Approval —Council Member Clarke moved to approve the agenda,tabling consideration of
Consent Agenda item J1D until the July 2,2018 regular meeting;tabling consideration of Agenda
Item J2 until the July 2,2018 regular meeting;tabling consideration of the third reading of the
ordinance listed as Agenda Item J6 until the June 19,2018 special meeting;and tabling
consideration of Agenda Item J17 until the June 19,2018 special meeting;seconded by Council
Member Hughes.Resultsofvote:Ayes:Bergman,Clarke,Hughes.Nays:None.Absent:
Bottenberg,Lyon.Motion carried 3 —0 —2.

(H)Public Hearings:
1)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing certain property therein from A-1 to M-1/PD-1,a parcel to be
known as Apple Data Center —Presiding Officer Bergman opened the public hearing and asked
if any written correspondence had been received;City Clerk Schuett replied in the negative.
Development Services Director Deets reviewed the rezoning application for properties acquired
by Apple following approval of their initial rezoning application.No comments were made by the
public present.
2)On an ordinance to amend Chapter 222,Building Code Regulations and Penalties for
Violations of the Waukee Municipal Code,to insert Section 222A,Residential Rental Code
—Presiding Officer Bergman opened the public hearing and asked if any written correspondence
had been received;City Clerk Schuett replied in the negative.Development Services Director
Deets reviewed the code as it relates to rental property inspections,noting that state code
requires cities with populations greater than 15,000 to establish such programs.The proposed
program is based on the International Property Maintenance Code and a full-time code
enforcement officer position is being added to administer the program.An amended fee
schedule incorporating rental inspection fees will be presented to the council for consideration at
a later date.No comments were made by the public present.
3)On intent to commence a public improvement project known as Waukee High School No.
2 Project,Adjacent Roadways and Drainage —Presiding Officer Bergman opened the public
hearing and asked if any written correspondence had been received;City Clerk Schuett replied in
the negative.Public Works Director Gibson briefly reviewed the project.The process for
authorizing the use of eminent domain is standard City policy but does not mean that properties
will be acquired through eminent domain.Staff continues negotiations with the affected property
owner regarding land acquisition.No comments were made by the public present.

Reserve at Daybreak —Council Member Clarke moved to approve the resolution;seconded by
Council Member Hughes.Development Services Director Deets briefly reviewed the plat.He
referenced the concerns voiced in Open Forum regarding stormwater drainage,showing a map
of exisiting and future flow conditions.A large detention pond will be construction to collect all
site stormwater,with that water released at a rate specified by SUDAS regulations.Jared Murray
with Civil Design Advantage (CDA)explained the stormwater restriction plan for the proposed
plat.Council Member Bergman asked if City staff had any concerns regarding stormwater run-
off;Mr.Deets replied that staff and City Engineer reviews of the plan leads them to believe the

stormwater system has been designed to fulfill all existing requirements.Council Member Clarke
asked when current stormwater issues with Daybreak Plat 2 would be addressed;Mr.Deets
answered that construction drawings must be approved prior to the start of work on subdivision
construction.Mr.Murray added that grading would begin immediately with this phase.Council
Member Bergman asked those residents in attendance with concerns regarding stormwater flow

constructing the 10"St.connection.Some concerns were raised at the Planning &Zoning
Commission meeting regarding buffering and City staff has worked with the developer to
increase the number of plantings.Council Member Clarke noted other concerns from residents
related to increased traffic and excessive trash;Mr.Deets explained that a weight restriction had
recently been enacted for specific local streets and that no additional plats will be considered
until the 10'"St.connection is complete.Contractors have responded immediately when made
