AN ORDINANCE TO AMEND CHAPTER 301,ZONING ORDINANCE,
CITY OF WAUKEE,IOWA,BY CHANGING CERTAIN PROPERTY THEREIN
FROM C-1 [COMMUNITY AND HIGHWAY SERVICE COMMERCIAL
DISTRICT]TO C-1B [LARGE SCALE COMMERCIAL DEVELOPMENT]/PD-I
[PLANNED DEVELOPMENT OVERLAY]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the City of Waukee,Iowa,adopting the Official Zoning Map,is hereby
amended by amending the zoning from C-I (Community and Highway Service
Commercial District)to C-I B (Large Scale Commercial Development)for the property
legally described as follows (the "Property"):
OUTLOT 8 OF THE POINT PLAT 1,AN OFFICIAL PLAT IN THE CITY OF WAUKEE,DALLAS
COUNTY,IOWA AND CONTAINING 15.16 ACRES MORE OR LESS.
Said parcel contains 15.16 acres more or less.
Section 2.Planned Develo ment A cement.Attached hereto as
Exhibit A is the Planned Development Agreement which shall define the
minimum standards and requirements of the PD-I [Planned Development
Overlay District]pertaining to the above legally described property.
Section 3.~Re ealer.All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hearby repealed.
Section 4.Severabilit Clause.If any section,provision or part of
this ordinance shall be adjudged invalid or unconstitutional,such adjudication
shall not affect the validity of the ordinance as a whole or any section,
provision,or part thereof not adjudged invalid or unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon
its final passage,approval and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 18'"day of
December,2017,and approved this 18'"day of Decembe,201 .

Planned Development Overlay District (PD-1)
Item 1 Purpose and Scope of District
~The subject property is located on approximately 15 acres of property on the
north side of Hickman Road between NE Dartmoor Drive and NE Westgate Drive.
~The proposed Fridley Palms subdivision will consist of four commercial lots
including one lot for the development of an approximately 65,000 square foot
movie theater.The theater will consist of a total of 15 screens including an IMAX
screen.The users of the remaining three commercial lots are not known at this
time.
~The proposed underlying zoning of the Property is C-1B Large Scale Commercial
District.The proposed Planned Development Overlay (PD-1)has been requested
to deal with some of the unique aspects of a theater including an IMAX
component which would not typically be allowed within the underlying C-1B
zoning district.
Item 2 Location,Size,Legal Description

~The proposed development is comprised of approximately 15.16 acres located
on the north side of E.Hickman Road (Hwy 6)between NE Dartmoor Drive and
NE Westgate Drive.The property is generally rectangular in shape and has direct
access to both NE Dartmoor Drive and NE Westgate Drive.
Item 3 Conceptual Development Plan

Exhibit F represents a conceptual development plan/preliminary plat showing
the configuration of the proposed theater and associated parking.The theater is
proposed to front NE Westgate Drive.As a part of the subdivision,the developer
will be responsible for the construction of NE Venture Drive (public street)
between NE Dartmoor Drive and NE Westgate Drive.Three additional
commercial lots ranging in size from 1.32 acres to 1.88 acres will be constructed
between NE Venture Drive and E Hickman Road (Hwy 6).Access to the three
commercial lots will be restricted to NE Venture Drive.
Item 4 Building Design Standards,including height,materials,sections and other
information required to describe the project
Minimum building design standards shall be as specified within Chapter 304 Site
and Building Development Standards Ordinance,City of Waukee,iowa.Buildings
shall include a variety of building materials and elevations.Buildings shall be
designed with a consistent level of detail and interest on all sides.
2.As a part of the rezoning application,the applicant has provided conceptual
elevations of the proposed theater.
See Attached Exhibit 6 for conceptual architectural elevations.
Mechanical equipment shall be effectively screened.At the ground level,
outdoor mechanical,electrical and communication equipment shall be located in
the rear side of the building and be screened in a practical manner from any
public way.At the roof level,outdoor mechanical,electrical and communication
equipment shall be located either within the building massing or at the highest
level of the building with no more than two (2)feet of projection above the
lowest parapet.
4.Loading docks,trash dumpsters,utility meters,conduits and pipes,and the like
shall be located in inconspicuous areas and screened where practical.The
screening shall be incorporated into the overall design of the building.
5.Lighting within the development shall meet the minimum standards as defined
within the Waukee Site and Building Development Standards Ordinance.All
parking lot pole lighting shall utilize energy efficient light fixtures (LED preferred).
Item 5 Bulk Regulations —Including Density Regulations,Setbacks,Maximum Heights,
and other design standards specific to the Project
The following requirements shall be observed:
1.Lot Area.None.
2.Front Yard.Fifty (50')feet minimum.
Side Yard.None,except Twenty (20')feet minimum adjacent to residential
Properties.
4.Rear Yard.Fifty (50')feet minimum.

C-1B Large Scale Commercial District Ordinance,City of Waukee,iowa.
Item 7 Signage
1.All signage within the development shall comply with Chapter 305 Sign
Ordinance,City of Waukee,iowa with the following exceptions related only
to Lot 1.
a.For building signage,individual letters shall be allowed to be a
maximum of eight (8')tall on Lot 1.
b.A total of three building signs shall be permitted on the east elevation
of the building on Lot 1.The distance between the signs shall not be
utilized in the calculation of total sign area.
c.For purposes of calculating allowable square footage of signage on
the south side of the building,a ratio of 1.5 times the linear footage
of the building shall be used.
d.Movie posters and cabinets for current films or films that are "coming
soon"shall not be counted towards the maximum permitted building
signage on Lot 1.
2.In lieu of a monument sign on Lot 1,as permitted within Chapter 305 Sign
Ordinance,City of Waukee,iowa,a building projecting sign shall be
permitted for the proposed theater.The permitted projecting sign shall
generally be in conformance with Exhibit H attached and shall meet the
following requirements:
a.The sign shall be designed and located so as not to extend more than
fifteen (15)feet above the parapet or roof line of the theater building.
b.The minimum distance between the bottom of the sign and the grade
below shall be fifteen (15').
c.The maximum projection beyond the face of the building shall be
fifteen (15')feet.
d.The maximum square footage of sign content shall be 175 square
feet.For purposes of calculating sign area,only "Palms Theaters"
shall be used.Other elements that may be associated with the sign
shall not count towards the maximum allowed sign area.
