AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKEE,
IOWA BY AMENDING THE ZONING FOR CERTAIN PROPERTY FROM C-4 TO R-3
[ALICE'S ROAD APARTMENTS]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
from C-4 (Office Park Commercial District)to R-3 (Rental Multi-Family Residential District),
legally described as follows:
PARCEL 'AA'OF THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER,SECTION
27,TOWNSHIP 79 NORTH,RANGE 26 WEST OF THE FIFTH PRINCIPAL MERIDIAN,AN
OFFICIAL PLAT IN THE CITY OF WAUKEE,DALLAS COUNTY,IOWA AND MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST QUARTER OF SAID PARCEL 'AA';THENCE NORTH
0 03'16"WEST,1316.95 FEET;THENCE NORTH 89 34'37'"EAST,661.45 FEET;THENCE
SOUTH 0'03'16"EAST,698.90 FEET;THENCE NORTH 89 56'44"EAST,20.00 FEET;THENCE
SOUTH 0'03'16"EAST,338.00 FEET;THENCE SOUTH 89'56'44"WEST,20.00 FEET;THENCE
SOUTH 0'03'16"EAST,280.40 FEET;THENCE SOUTH 89'36'27"WEST,661.45 FEET TO THE
POINT OF BEGINNING AND CONTAINING 20.16 ACRES (877,960 SQUARE FEET).
SAID PARCEL TO BE REFERRED TO AS ALICE'S ROAD APARTMENTS.
Section 2.~Re ealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severabilit Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
