AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKKK,
IOWA BY AMENDING THE ZONING FOR CERTAIN PROPERTY FROM R-2 TO R-4
|SOMERSET OAKS]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
from R-2 (One and Two Family Residential District)to R-4 (Row Dwelling and Townhome District),
legally described as follows:
A PART OF PARCEL 'BB',IN THE NORTHEAST QUARTER OF SECTION 27,TOWNSHIP 79
NORTH,RANGE 26 WEST OF THE FIFTH PRINCIPAL MERIDIAN IN THE CITY OF
WAUKEE,DALLAS COUNTY,IOWA AND MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
COMMENCING AT THE CENTER CORNER OF SAID NORTHEAST QUARTER;THENCE,
NORTH 0 03'35"WEST ALONG THE EASTERLY LINE OF THE NORTHWEST QUARTER OF
SAID NORTHEAST QUARTER,168.94 FEET TO THE POINT OF BEGINNING;THENCE
CONTINUING NORTH 0'03'35"WEST ALONG SAID EASTERLY LINE,350.85 FEET;THENCE
NORTH 89 58*40"WEST,197.32 FEET;THENCE SOUTH 79'39'00"WEST,77.87 FEET;
THENCE SOUTH 89'34'12"WEST,442.21 FEET;THENCE SOUTH 32'19'34"EAST,52.08
FEET;THENCE SOUTH 28 09'59"EAST,97.56 FEET;THENCE SOUTH 22'24'05"EAST,97.56
FEET;THENCE SOUTH 14 20'17"EAST,121.44 FEET;THENCE NORTH 89'34'37"EAST,
575.34 FEET TO THE POINT OF BEGINNING AND CONTAINING 4.99 ACRES (217,558
SQUARE FEET).
Said parcel to be referred to as SOMERSET OAKS.
Section 2.~Re ealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severabilit Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
