AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKEE,
IOWA BY AMENDING THE ZONING FOR CERTAIN PROPERTY FROM A-I TO C-1
[TOWERCO]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
from A-I (Agricultural District)to C-I (Community and Highway Service Commercial District),
legally described as follows:
A TRACT OF LAND LYING IN THE SOUTHWEST QUARTER OF SECTION 26,TOWNSHIP 79
NORTH,RANGE 26 WEST OF THE FIFTH PRINCIPAL MERIDIAN,DALLAS COUNTY,IOWA,
BEING MORE PARTICULALRY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHWEST CORNER OF SAID SECTION 28,TOWNSHIP 79
NORTH,RANGE 26 WEST,THENCE NORTH 00'10'42"EAST ALONG THE WEST LINE OF
SAID SECTION 26 A DISTANCE OF 734.50 FEET TO THE POINT OF BEGINNING;THENCE
CONTINUING NORTH 00 10'42"EAST ALONG SAID WEST LINE A DISTANCE OF 300.00
FEET TO THE SOUTHWEST CORNER OF LOT 6,BERKSHIRE COMMONS OFFICE PARK
PLAT I;THENCE SOUTH 89'51'27"EAST ALONG THE SOUTH LINE OF SAID BERKSHIRE
PLAT A DISTANCE OF 300.00 FEET;THENCE SOUTH 45'09'38"WEST A DISTANCE OF
424.40 FEET TO THE POINT OF BEGINNING AND COTAINING 1.03 ACRES.
Said parcel to be referred to as TOWERCO.
Section 2.~Re ealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severabilit Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
