HomeMy WebLinkAbout2014-11-17-Ordinance 2774_Rezoning, Daybreak Phase 1ORDINANCE NO.2774 AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUIMK, IOWA BY AMENDING THE ZONING FOR CERTAIN PROPERTY FROM A-1 TO R-1 [DAYBREAK PHASE 1] BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate from A-1 (Agricultural District)to R-1 (Single Fanuly Residential District),legally described as follows: A PART OF LOT 1,SUGAR GROVE HEIGHTS PLAT 1,AN OFFICIAL PLAT,CITY OF WAUIWE,DALLAS COUNTY,IOWA AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 1;THENCE SOUTH 45'5l'47" EAST ALONG THE NORTH LINE OF SAID LOT 1,A DISTANCE OF 95.71 FEET;THENCE NORTH 88'42'20"EAST ALONG SAID NORTH LINE,672.07 FEET TO THE CENTERLINE OF UTE AVENUES COUNTY HIGHWAY R22;THENCE SOUTHERLY ALONG SAID CENTERLINE AND A CURVE CONCAVE EASTERLY WHOSE CHORD BEARS SOUTH 76'15'53"WEST,90.49 FEET;THENCE SOUTH 82'49'28"WEST,103.55 FEET;THENCE SOUTH 89'28'50"WEST,106.66 FEET;THENCE NORTH 90'00'00"WEST,197.95 FEET TO THE WEST LINE OF SAID LOT 1;THENCE NORTH 0'33'15"WEST ALONG SAID WEST LINE,427.05 FEET TO THE POINT OF BEGINNING AND CONTAINING 5,90 ACRES (256,995 SQUARE FEET). Section 3.Severabilit Clause.If any section,provision or part of tiiis ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.Tliis ordinance shall be in effect upon its final passage,approval and publication as provided by law.
