AN ORDINANCE TO AMEND CHAPTER 109,ESTABLISHING THE POWERS AND
DUTIES OF CITY CLERK,BY REPEALING AND ENACTING IN LIEU THEREOF
PROVISIONS RELATED TO THE DUTIES OF THE CITY CLERK
WHEREAS,Iowa Law requires that a City have a City Clerk to carry out those duties
and responsibilities established by Iowa Law;AND
WHEREAS,the City of Waukee,Iowa created a City Administrator position in the late
1990's and since that time the City Administrator served as both the City Administrator and City
Clerk;AND
WHEREAS,over the last several years the City experienced tremendous growth in
population,area served,and public infrastructure increasing the burdens on the Office of City
Admillistrator/Clerk in carrying out the various responsibilities associated with the dual Office;
AND
WHEREAS,the City Council of the City of Waukee deems it in the City's best interest to
separate the Offices of the City Clerk and City Administrator so as to provide for the efficient
administration of the different and distinct duties and responsibilities associated with each office
respectively;AND
WHEREAS,in order to effectuate the separation of the duties and responsibilities of the
City Clerk and City Administrator,certain sections of the Waukee Municipal Code need to be
separated to set forth the duties of the respective offices.
BE IT THEREFORE ORDAlNED by the Council of the City of Waukee:
Section 1:Chapter 109,Waukee Municipal Code,should be and the same is hereby
repealed and enacted in lieu thereof is as follows:
§109.1 Appointment and Term.The City Clerk shall be appointed by a majority
vote of the council at a regular meeting of such body.The City Clerk shall hold office at the
pleasure of the council and shall be subject to removal by a majority vote thereof.
§109.2 General Duties.The City Clerk shall exercise the powers and perform the
duties prescribed by State Law and by City Ordinance.
§109.3 Additional Duties.In addition,and to the extent not in conflict with State
Law,the powers and duties of the City Clerk,enumerated by City Ordinance are as follows:
1.Prepare and publish a condensed statement of council proceedings
to include the total expenditure from each city fund.The statement
shall further include a list of all claims allowed,a summary of all
receipts and the gross amount of the claims.
2.Record each measure taken by the council,stating where
applicable whether the mayor signed,vetoed,or took no action on
the measure and what action the conncil made upon the mayor's
veto.
3.Cause to be published all ordinances and amendments enacted by
the city.All such measures,except motions,shall be authenticated
with the Clerk's signature,certifying the time and place of
publication when required.
4.Maintain copies of all effective city ordinances and codes for
public use.
5.Publish notice of public hearings,elections and other official
actions as required by state and city law.
6.Certify all measures establishing any zoning district,building lines,
or fire limits,and a plat showing each district,lines or limits to the
recorder of the county containing the affected parts ofthe city.
7.Following conncil adoption of the budget,certify the necessary tax
levy for the following year to the county auditor and the county
board of supervisors.
8.Prepare the annual public report,publish it,and send a certified
copy to the state auditor and other state officers as required by law.
9.Maintain all city records as required by law.
10.Have custody and be responsible for the safekeeping of all writings
or documents in which the municipality is a party in interest unless
otherwise specifically directed by law or ordinance.
11.Fumish upon request to ally municipal officer a copy of ally
record,paper or public document under the City Clerk's'control
when it may be necessary to such officer in the discharge of the
officer's'duty.The City Clerk shall fumish a copy to any citizen
when requested upon payment of the fee set by council resolution,
12.The City Clerk shall,under the direction of the mayor or other
authorized officer,affix the seal of the corporation to those public
documents or instruments,which by ordinance are required to be
attested,by the affixing of the seal.
13.Provide for and preserve a correct record of the proceedings of
meetings of all committees,boards and commissions of the city.
14.Keep and file all communications and petitions directed to the city
councilor to the city generally.The City Clerk shall endorse
thereon the action of the city conncil taken upon matters
considered in such communications and petitions.
15.Issue all licenses and permits approved by the council,and keep a
record of licenses and permits issued which shall show date of
issuance,license or permit munber,official receipt number,name
of person to whom issued,term of license or permit,and purpose
for which issued.
16.Inform all persons appointed by the mayor or city council to
offices in the municipal government of their position and the time
at which they shall assume the duties of their office.
17.Compile and preserve a complete record of every city election,
regular or special,and perform duties required by law or ordinance
of the city clerk in regard to elections.
18.Post an agenda of all council meetings as required by law and list
on the agenda all items requested by the mayor or any council
member.
19.The City Clerk shall exercise such other duties and responsibilities
as shall be directed by the City Council and the Mayor.
Section 2 Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clanse.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
