AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,
REGARDING BOARD OF ADJUSTMENT -PROCEDURE,POWERS AND DUTIES.
WHEREAS,the City of Waukee seeks to change the date terms for members expire on the
Board of Adjustment.
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee:
Section 1:Chapter 301,Waukee Municipal Code,Section 301.29(A)should be and the
same is hereby repealed and enacted in lieu thereof is as follows:
§301.29.Board of Adjustment -Procedure,Powers and Duties.
A.Board Created.
1.A Board of Adjustment is hereby established which shall consist of
five (5)members.The term of office of the members of the Board
shall be five years,with all terms to expire on January 31 of the
appropriate year.The terms of not more than one-third of the
members will expire in anyone year.
2.If any vacancy exists on the Board,a successor for the remainder of
the term shall be appointed in the same manner as the original
appointee.The position of any Board member shall be vacant if the
member resigns,moves permanently from the City,or if said member
is absent without due explanation from six consecutive regular
meetings of the Board,except in the case of sickness,or is removed
for cause by the Mayor with the approval of the Council.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
ofthis ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or ally section,provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 7th day of October,2013,and approved this 7'h day of October,2013.
