AN ORDINANCE TO AMEND CHAPTER 403,WAUKEE MUNICIPAL CODE,
REGARDING BOARD OF APPEALS.
WHEREAS,the City of Waukee seeks to change the date terms for members expire for the
Board of Appeals.
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee:
Section 1:Chapter 403,Waukee Municipal Code,Section 403.2 should be and the same
is hereby amended as follows:
§403.2.Board of Appeals.Board of Appeals shall mean the Municipal Code Appeals
Board.The Board shall be appointed by the Mayor,subj ect to Council approval.
The Board shall consist of seven members,six of which shall be individuals
knowledgeable by training and/or education in the construction industry or the
fire service and one member shall be a citizen appointed at large.Members of the
Board shall be appointed for a term of five years,and all terms shall expire on
January 31 of the appropriate year.A quorum shall consist of four members.All
members of the Board shall reside in the City.The Board shall adopt rules of
procedure for conducting its business
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clanse.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitutional,
Section 4.Effect on Terms of Existing Board.The intent of this ordinance is to
coordinate appoinhnents with appointments to other Boards established by the Municipal Code
to the extent allowed by Iowa Law.Due to the change in the term expiration date provided
herein,the terms for positions on the Board existing at the time of passage are extended so as to
expire on the January 31 following the date on which the term for such seat on the Board would
have otherwise expired prior to said amendment.
Section 5.Effective Date.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
