HomeMy WebLinkAbout2013-11-18-Ordinance 2751_Wastewater Treatment Connection Fee District, Fee ReductionORDINANCE NO.2751 AN ORDINANCE TO AMEND CHAPTER 224X.6,WAUKEE MUNICIPAL CODE,TO REDUCE THE W ASTE WATER TREATMENT CONNECTION FEE FOR SINGLE FAMILY RESIDENCES CONNECTING TO THE CITY SEWER UTILITY. WHEREAS,Section 384.38 of the Code of Iowa authorizes cities to establish by ordinance connection fee districts and corresponding schedules of fees in order to allocate the cost of improvements necessary to extend waste water service to properties within such a district; AND WHEREAS,pursuant to Section 384.38,the City of Waukee (the "City")established the Waste Water Treatment Connection Fee District (the "District")with a corresponding schedule of connection fees;AND WHEREAS,the district was created to allocate the cost of improvements necessary to extend sewer to property and the fees established in tins connection fee district are related to a portion of the costs of improvements related to increased treatment capacity required in order to extend sewer to property within the City;AND WHEREAS,the City Staff has conducted its periodic review of the connection fee and have determined that the City is retiring some indebtedness related to Waste Water Treatment infrastructure and staff recommends that other sewer utility resources be allocated to Waste Water Treatment infrastructure costs incurred in order to defray the connection fee burdens in the community;AND WHEREAS,based on the foregoing the City Council is desirous of reducing the connection fee established in this chapter tlrrough the allocation of other available resources to waste water treatment infrastructure improvement costs in order to reduce the connection fee burdens in the community. BE IT ORDAINED by tile Council of the City of Waukee: Section 1.That effective January 1,2014,Section 224X.6 Waukee Municipal Code should be and the same is hereby amended to provide as follows: Section 224X,6.Schedule of Water COlmection Fees. a)Waste water connection fees shall be due at the time of submission of a building permit as described in Section 5 of this Ordinance.Issuance of building permits and/or Mobile Home Permits shall not occur until such time as any and all fees have been paid in full. b)Fees shall be based upon the equitable costs of extending service from tile Municipal Waste Water System to the property for which connection is sought,From the effective date of this ordinance,fees shall be imposed in the following amounts: Page 1 of2 1)Residential Single Family--$600.00 per household unit. 2)Residential-Non-Single Family-$1,265 per milt 3)Non Residential-$95.70 Per Fixture Unit c)The City Council reserves the light to review and revise the fees as it deems appropriate. Section 2 Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provisions or part thereof not adjudged invalid or unconstitutional. 2014.
