ORDINANCE AMENDING SECTION 228.09 OF THE WAUKEE MUNICIPAL CODE TO
ALLOW FOR THE TESTING AND OPERATION OF ELECTRICAL GENERATION
EQUIPMENT UPON GOVERNMENTAL,COMMERCIAL AND INDUSTRIAL PROPERTY
AS SPECIFIED BELOW
WHEREAS permanent electric generation equipment is routinely installed by property owners
at locations where governmental,commercial and industrial activity at the premises is vitally
dependent on electrical service;AND
WHEREAS,the City utilizes generators in times of electrical outage to assure continued
operation of utilities and other essential operations;AND
WHEREAS,to assure operation of equipment necessary to provide essential services to the
community during periods of electric utility outages,it is the best interest of the City to allow for such
operation and the repair testing of such equipment at reasonable times to confirm operation in the event
of an outage.
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee,Iowa that
Section 228.09 of the Waukee Municipal Code should be amended to add the following exceptions to
the noise ordinance:
Section 1.Section 228.09(11).The emISSIOn of sound from the operation of electrical
generation equipment on governmental,commercial or industrial properties during periods of an
electrical utility outage.
Section 2.228.09(12)The emission of sound in connection with the repair and/or testing of
electrical generation equipment permanently situated on governmental,commercial and industrial
property interests for operation in the event of an electrical power failure,
Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 4.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provisions or part thereof not adjudged invalid or unconstitutional.
Section S.Effective Date.This ordinance shall be in effect from and after its final passage,
approval and publication as provided by law.
