HomeMy WebLinkAbout2012-02-27-Ordinance 2709_Rezoning, Warrior RidgeORDINANCE NO.2709 AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKEE, IOWA,BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM A-I [AGRICULTURAL DISTRICT]TO R-2 [ONE AND TWO FAMILY RESIDENTIAL DISTRICT];AND AMEND THE OFFICIAL ZONING MAP TO SHOW REZONING BE IT ORDAlNED by the Council of the City of Waukee: Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate from A-I (Agricultural District)to R-2 (One and Two Family Residential District),legally described as follows: A PARCEL OF LAND IN GOVERNMENT LOT 9,IN THE NORTHEAST FRACTIONAL QUARTER OF SECTION 5,TOWNSHIP 783 NORTH,RANGE 26 WEST OF THE 5TH P.M.,DALLAS COUNTY,IOWA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF LOT 78 HEMINGWAY PLAT 1,AN OFFICIAL PLAT, CITY OF WAUKEE,DALLAS COUNTY,IOWA,SAID POINT BEING ON THE NORTH LONE OF GOVERNMENT LOT 9;THENCE N83°18'16"E,1319.44 FEET ALONG THE NORTH LINE OF SAID GOVERNMENT LOT 9 TO THE NORTHEAST CORNER OF OF SAID GOVERNMENT LOT 9;THENCE SOoo16'48"W,399.42 FEET ALONG THE EAST LINE OF SAID GOVERNMENT LOT 9;THENCE N89°43'12"W,63.87 FEET TO A 200.00 FEET RADIUS CURVE CONCAVE TO THE NORTHEAST; THENCE NORTHWESTERLY 91.03 FEET ALONG SAID CURVE,SAID CHORD LENTH OF 90.25 FEET AND A CHORD BEARING OF N76°40'50"W;THENCE 63°38'29"W,138.71 FEET TO A 450.00 FEET RADIUS CURVE CONCAVE TO THE SOUTHWEST;THENCE NORTHWESTERLY 259.62 FEET ALONG SAID CURVE,SAID CURVE HAS A CHORD LENGTH OF 256.Q3 FEET AND A CHORD BEARING OFN80010'08''W;THENCE S83°18'12"W,119.82 FEET;THENCE SOooI9'16"W,720.66 FEET; THENCE S83°19'35"W,677.14 FEET TO THE WEST LINE OF GOVERNMENT LOT 9;THENCE NOoo42'46"E,907.57 FEET ALONG SAID WEST LINE OF GOVERNMENT LOT 9,TO THE SOUTHWEST CORNER OF LOT 78 HEMINGWAY PLAT 1,AND TO THE POINT OF BEGINNING. SAID TRACT OF LAND CONTAINS 17.306 ACRES MORE OR LESS. Section 2.Further Zoning Restriction.Development of the real estate shall be limited to single family residential only. Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 5.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law.
