AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKEE,
IOWA BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM PD
[PLANNED DEVELOPMENT OVERLAY DISTRICT]AND C-l [COMMUNITY AND
HIGHWAY SERVICE COMMERCIAL DISTRICT]TO PD [PLANNED DEVELOPMENT
OVERLAY DISTRICT]AND R-3 [RENTAL MUL TI-FAMIL Y RESIDENTIAL DISTRICT]
(WILLIAMS POINTE NORTH PLANNED DEVELOPMENT);AND AMEND THE
OFFICIAL ZONING MAP TO SHOW REZONING
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
to modify PD-1 (planned Development Overlay District)and C-1 (Community and Highway Service
Commercial District)to PD-1 (Pla1111edDevelopment Overlay District)and R-3 (Rental Multi-Family
Residential District),legally described as follows:
LOT 2,WILLIAMS POINTE PLAT 13,AN OFFICIAL PLAT IN THE CITY OF WAUKEE,DALLAS COUNTY,IOWA,
CONTAINING APPROXIMATELY 7.06 ACRES MORE OR LESS,AND THE WEST HALF OF SE WACO PLACE
RIGHT OF WAY LYING EAST OF AND COINCIDENT WITH SAID LOT 2,AND THE NORTH HALF OF SE LAUREL
STREET RIGHT OF WAY LYING SOUTH OF AND COINCIDENT WITH SAID LOT 2,AND THE EAST HALF OF SE
BRICK DRIVE RIGHT OF WAY LYING WEST OF AND COINCIDENT WITH SAID LOT 2.
A property located in tbe Williams Pointe North Planned Development.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 3'11 day of December,2012,and approved
this 3'd day of December,2012.
