AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF ']
WAUKEE,IOWA,BY AMENDING SECTION 301.18A(F),"C-IB"LARGE SCALE
COMMERCIAL DISTRICT,MINIMUM OPEN SPACE
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1.Chapter 300,Waukee Municipal Code,Zoning Ordinance of the City of
Waukee,Iowa,Section 301.l8A(F)Minimum Open Space is hereby repealed and enacted in lieu
thereof is as follows:
F.Minimum Open Space:The total land area devoted to open space
and landscaping shall not be less than twenty (20)percent of the
gross land area included in the building lot.Such open space shall
be maintained as grassed and landscaped area and shall not include
access drives,parking areas,structures or buildings;except
omamental structures included as part of the landscaping theme.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the 1
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitutional.
Section 4.Effective Date.TIns ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 10th day of January,2011,and approved this 10th day of January,
