AN ORDINANCE REPEALING CHAPTER 224A.3 CONCERNING THE UNIVERSITY
AVENUE TRUNK SEWER CONNECTION FEE DISTRICT 5
WHEREAS,Section 384.38 of the Code of Iowa authorizes cities to establish by
ordinance connection fee districts and corresponding schedules of fees in order to allocate the
cost of improvements necessary to extend sewer service to properties within such a district;and
WHEREAS,pursuant to Section 384.38,the City of Waukee (the "City")established the
University Avenue Trunk Sewer Connection Fee District 5 (the "District")in 1999 and
established a corresponding schedule of connection fees,in accordance with Iowa law;AND
WHEREAS,at the time of passage of the connection fee in this District,the sanitary
sewer improvements which were the subject of the fee were the most efficient method available
to serve the property within the District;AND
WHEREAS,additional sewer infrastructure in another area of the City designed and is
contemplated to be constructed which will provide alternative means to serve the property in this
District,among others,when the property owners chooses to develop their property in the area;
AND
WHEREAS,the City believes that it is in the best interest of the City that this connection
fee district be repealed,as the property will be served by other infrastructure.
BE IT THEREFORE ORDAINED by the Council of the City of Waukee:
Section 1.The Chapter 224A.3 of the Waukee Municipal Code is hereby repealed.
Section 2 Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitntional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitntional.
Section 4.Effective Date.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
Passed by the Council the 24th day of January,2011,and approved this 24th
2011.
