HomeMy WebLinkAbout2011-05-09-Ordinance 2692_Zoning RegulationsORDINANCE NO.2692 AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKEE,IOWA,BY AMENDING SECTION 301.08,"GENERAL REGULATIONS" BY ADDING NEW SECTION P,TEMPORARY USES -SALE OF AGRICULTURAL PRODUCTS BE IT ORDAINED by the City Council of the City of Waukee: Section 1.Chapter 300,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,Section 301.08 General Regulations is hereby amended by adding as follows: P.Temporary Uses -Sale of Agricultural Products.The City recognizes that in certain instances,some flexibility to allow activities or uses on a limited duration out of the confines of a building can be beneficial to business interests,as well as the consumers and the City alike,provided such events continue to promote the public health,safety and general welfare. These regulations are intended to prescribe the conditions under which the temporary sale of seasonal agricultural products may be allowed within the City. 1.Temporary Agricultural Product Sales Defined.Temporary Agricultural Product Sales shall be defined as the sale of raw, unprocessed fruits and vegetables being sold within the confines of a temporary structure,vehicle or roadside stand. 2.Permit Required.A temporary agricultural product sales permit shall be required and must be issued prior to the commencement of sales. 3.General Requirements Defined. a.Temporary Agricultural Product Sales shall only be permitted on property zoned A-I (Agricultural District),C-l (Community and Highway Service Commercial District),C- 1A (Neighhorhood Commercial District),C-IB (Large Scale Commercial District)or C-2 (Downtown Business District). b.Temporary Agricultural Product Sales shall be limited between May I st and November 15th. c.The temporary structure or roadside stand used in the selling of the agricultural product sales shall be set-up and removed on a daily basis. d.Temporary Agricultural Product Sales shall be compatible with adj acent uses and will not adversely affect the surrounding neighborhood by means of odor,noise,dust or other nuisance. e.Parking required by the temporary agricultural product sales shall be provided on site or provided by adequate street parking available in the immediate area. f.Increased traffic caused by the temporary agricultural product 1 sales shall not adversely affect the surrounding neighborhood or City at large.ISection2.Repealer.All ordinances or parts of ordinances m conflict with the provisions ofthis ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provisions or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect from and after its fmal passage,approval and publication as provided by law.
