AN ORDINANCE TO AMEND SECTION 213A.I0,WAUKEE MUNICIPAL CODE,TO
IDENTIFY AND REQUIRE TRANSPORT AND DISPOSAL OF UNRECYCLED SOLID
WASTE GENERATED WITHIN THE CITY AT METRO PARK WEST (NORTH DALLAS
LANDFILL).
WHEREAS,the City of Waukee is a member of the North Dallas Landfill Commission is located
within the comprehensive planning area for the North Dallas Landfill;AND
WHEREAS,the North Dallas Landfill was acquired by the Metro Waste Authority in a
transaction that was authorized by the members of the North Dallas Landfill Commission,including the
City of Waukee;AND
WHEREAS,the existing ordinance provides for disposal at said landfill however the landfill is
responsible for compliance and enforcement of the ordinance and requests the change in the interests of
uniformity amongst the communities that dispose at the landfill.
BE IT THEREFORE ORDAINED by the City Council of the City of Waukee:
Section 1:Section 213A.IO,Waukee Municipal Code,be amended by repealing the same and
enacting in lieu thereof the following:
§2 13A.10 Exclusive Disposal Site Designation.All unrecycled solid waste generated
within the city shall be transported to the Metro Park West (North Dallas Landfill)nnless
written permission is received from the Landfill to dispose of said waste at another permitted
site.
Section 2 Repealer.All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provisions or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect from and after its final passage,
approval and publication as provided by law.
