AN ORDINANCE TO AMEND SECTION 213A.I0,WAillffiE MUNICIPAL CODE,TO
IDENTIFY AND REQUIRE DISPOSAL OF UNRECYCLED SOLID WASTE GENERATED
WITHIN THE CITY TO BE TRANSPORTED AND DEPOSITED IN THE METRO WEST
LANDFILL
WHEREAS,the City of Waukee is a member of the North Dallas Landfill Commission is located
within the comprehensive planning area for the Metro West Landfill;AND
WHEREAS,the Metro West Landfill was acquired by the Metro Waste Authority in a transaction
that was authorized by the members of the North Dallas Landfill Commission,including the City of
Waukee;AND
WHEREAS,it is in the best interest of the City and the public health,welfare and safety,that a
disposal site be designated and utilized as it pertains to the waste stream generated within the City limits.
BE IT THEREFORE ORDAINED by the City Council ofthe City of Waukee:
Se~tion 1:Section 213A.10,Waukee Municipal Code,be amended by repealing the same and
enacting in lieu thereof the following:
§2 13A.10 Exclusive Disposal Site Designation.The sanitary landfill facility that is known
as the Metro West Landfill is designated by the City as the official disposal site for all non-
hazardous solid waste generated within the City of Waukee.All eligible solid waste generated
within the City shall be transported to the Metro West Landfill unless written permission is
received from the Landfill to dispose said waste in another permitted site.
Section 2 Repealer.All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as
a whole or any section,provisions or part thereof not adjudged invalid or unconstitutionaL
Section 4.Effective Date.This ordinance shall be in effect from and after its final passage,
approval and publication as provided by law.
