HomeMy WebLinkAbout2009-06-22-Ordinance 2649_R-1 and R-2 Zoning District, Minimum Floor AreaORDINANCE NO.2649 AN ORDINANCE TO AMEND CHAPTER 301,ZONING ORDINANCE,CITY OF WAUKEE,IOWA,BY AMENDING SECTION 301.11(C)(2)"R-I"SINGLE FAMILY RESIDENTIAL DISTRICT AND SECTION 301.12(C)(2)ONE AND TWO FAMILY RESIDENTIAL DISTRICT BY REPEALING SAID SECTIONS AND ENACTING IN LIEU THEREOF REVISED PROVISIONS FOR MINIMUM FLOOR AREA BE IT ORDAINED by the City Council of the City of Waukee: Section I:Chapter 301,Zoning Ordinance,City of Waukee Municipal Code,Section 301.11(C)(2)should be and the same is hereby repealed and enacted in lieu thereof is as follows: 2.Minimum Floor Area: 1,050 square feet for single story dwelling;If building is two or more stories,minimum square footage shall be 1,400 square feet with a minimum first floor square footage of 700 square feet.If a building is a split level,each level shall be a minimum of 400 square feet.If building is a split foyer,the square footage shall be a minimum of 1,050 square feet per StOlY. Section 2:Chapter 301,Zoning Ordinance,City of Waukee Municipal Code,Section 301.12(C)(2)should be and the same is hereby repealed and enacted in lieu thereof is as follows: 2.Minimum Floor Area: Single story single-family -950 square feet.Single story two-family -750 square feet per unit.If building is two or more stories,minimum square footage shall be 1,250 square feet for single-family with a minimum of 600 square feet on the first floor and 1,050 square feet for two-family with a minimum of 500 square feet on the first floor.If a building is a split level,each level shall be a minimum 350 square feet.If a building is a split foyer,the square footage shall be a minimum of 950 square feet per StOlY. Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provisions or part thereof not adjudged invalid or unconstitutional. 1 Section 5.Effective Date.This ordinance shall be in effect from and after its final passage,approval and publication as provided by law.
