AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF
WAUKEE,IOWA,BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN
FROM A-I [AGRICULTURAL DISTRICT]TO C-4 [OFFICE PARK COMMERCIAL
DISTRICT];AND THEN BY REZONING AND CHANGING CERTAIN PROPERTY
THEREIN FROM C-4 [OFFICE PARK COMMERCIAL DISTRICT]TO PD-I [PLANNED
DEVELOPMENT OVERLAY DISTRICT];AND AMEND THE OFFICIAL ZONING JVIAPTO
SHOW REZONING
BE IT ORDAINED by the Council of the City of Waukee:
Section I.Section 301.4 of Chapter 301,Waukee Municipal Code,Zarling Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
from A-I [Agricultural District]to C-4 [Office Park Commercial District],legally described as
follows:
A PARCEL OF LAND SITUATED IN THE SOUTHWEST AND SOUTHEAST QUARTERS
OF SECTION 4,TOWNSHIP 78 NORTH,RANGE 26 WEST OF TI-IB FIFTH PRIME
MERIDIAN;IN THE CITY OF WAUKEE,DALLAS COUNTY,IOWA;AND MORE
P ARTICULARL Y DESCRIBED AS FOLLOWS:
THE POINT OF BEGINNING AT THE SOUTH QUARTER CORNER OF SAID SECTION;
THENCE N 84°02'42"E,596.48 FEET;THENCE N 00°34'03"E,787.84 FEET TO THE
ENDPOINT ON A CURVE CONCAVE TO THE NORTHEAST HAVING A RADIUS OF
1500.00 FEET AND A CENTRAL ANGLE OF 27°36'34"AND BEING SUBTENDED BY A
CHORD WHICH BEARS N 14°22'19"E,715.84 FEET;THENCE N 90°00'00"W,1414.85
FEET;THENCE S 00°14'00"W,1610.20 FEET;THENCE N84°02'42"E,643.30 FEET TO
THE POINT OF BEGINNING;
CONTAINING 44.75 ACRES MORE OR LESS.
And then rezoning the above legally described C-4 [Office Park Commercial District]to PD-I
[Planned Development Overlay District].
A parcel also known as Fox Green Office Park.

Section 2.Plmmed Development Agreement.Attached hereto as Exhibit A is
the Planned Development Agreement which shall define the minimum standards and
requirements of the PD-I [Planned Development Overlay District]pertaining to the above
legally described property.
Section 3.Repealer.All ordinances or parts of ordinances in conflict with the provisions I
of this ordinance are hereby repealed..
Section 4.Severability Clause.If any section,provision or part of this ordinance shall be
adjndgcd invalid or unconstitutional,such adjudication sball not affect the validity of the ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 14th day of September 2009,and
approved this 14th day of September 2009.
