HomeMy WebLinkAbout2008-05-05-Ordinance 2630_Rezoning, YMCA ProjectORDINANCE NO.2630 AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF WAUKEE,IOWA,BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM A-I [AGRICULTURAL DISTRICT]TO C-lB [LARGE SCALE COMMERCIAL DISTRICT];AND THEN BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN FROM C-lB [LARGE SCALE COMMERCIAL DISTRICT]TO PD-I [PLANNED DEVELOPMENT OVERLAY DISTRICT];AND AMEND THE OFFICIAL ZONING MAP TO SHOW REZONING BE IT ORDAINED by the Council of the City ofWaukec: Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate from A-I [Agricultural District]to C-1B [Large Scale Commercial District],legally described as follows: PART OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 28,TOWNSHIP 79 NORTH,RANGE 26 WEST OF THE 5TH P.M.,NOW INCLUDED IN TI-IE CITY OF WAUKEE,DALLAS COUNTY,IOWA,AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AS A POINT OF REFERENCE AT THE SOUTI-IEAST CORNER OF SAID SECTION 28;THENCE NORTH 00°22'28"EAST,984.91 FEET ALONG THE EAST LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 28 TO THE POINT OF BEGINNING;THENCE NORTH 89°37'32"WEST,146.55 FEET;THENCE SOUTH 29°05'47"WEST,406.38 FEET;THENCE NORTHWESTERLY 130.37 FEET ALONG THE ARC OF A CURVE CONCAVE NORTHERLY AND HAVING A RADIUS OF 750.00 FEET,A CENTRAL ANGLE OF 09°57'35",AND A 130.21 FEET LONG CHORD THAT BEARS NORTH 65°52'18"WEST;THENCE NORTH 60°53'31"WEST,358.59 FEET; THENCE NORTH 00°22'28"EAST,466.27 FEET TO THE NORTH LINE OF THE SOUTI-IEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 28; THENCE SOUTH 89°30'50"EAST,775.45 FEET ALONG THE NORTH LINE OF THE SOUTI-IEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 28 TO THE NORTHEAST CORNER OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 28;THENCE SOUTH 00°22'28"WEST,333.21 FEET ALONG THE EAST LINE OF THE SOUTHEAST QUARTER OF SAID SECTION 28 TO THE POINT OF BEGINNING. CONTAINING 9.22 ACRES. And then rezoning the above legally described C-lB [Large Scale Commercial District]to PD-1 [Planned Development Overlay District]. A parcel also known as the YMCA Project. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clanse.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law.
