AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF
WAUKEE,lOW A,BY REZONING AND CHANGING CERTAIN PROPERTY THEREIN
FROM A-I [AGRICULTURAL DISTRICT]TO M-I [LIGHT INDUSTRIAL DISTRICT];AND
AMEND THE OFFICIAL ZONING MAP TO SHOW REZONING
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.4 of Chapter 301,Waukee Municipal Code,Zoning Ordinance of
the City,adopting the Official Zoning Map,is hereby amended by changing the following real estate
from A-I [Agricultural District]to M-1 [Light Industrial District],legally described as follows:
APART OF THE SOUTHWEST Y4OF THE SOUTHWEST Y4OF SECTION 33,
TOWNSHIP 79 NORTH,RAGE 26 WEST OF THE 5TH P.M.,DALLAS COUNTY,IOWA
AND DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST CORNER OF SAID SECTION 33;THENCE NORTH
0°19'54"EAST ALONG THE WEST LINE OF SAID SOUTHWEST Y4OF THE
SOUTHWEST Y4,A DISTANCE OF 910.00 FEET;THENCE SOUTH 89°48'41"EAST,
760.00 FEET;THENCE SOUTH 0°19'54"WEST,910.00 TO A POINT ON THE SOUTH
LINE OF SAID SOUTHWEST Y4OF THE SOUTHWEST Y4;THENCE NORTH 89°48'41"
WEST ALONG SAID SOUTH LINE,760.00 FEET TO THE POINT OF BEGINNING AND
CONTAINING 15.87 ACRES
(691,598 SF)AND SUBJECT TO ROADWAY EASEMENT BEING THE NORTH 50.00
FEET THEREOF,SAID EASEMENT CONTAINS 0.87 ACRES (38,000 SF).
A parcel also known as the proposed Waukee Public Works Facility site.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance shall be
adjudged invalid or unconstitutional,such adjudication shall not affect the validity ofthe ordinance as
a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval
and publication as provided by law.
Passed by the City Council of the City of Waukee,Iowa,this 16th day of June 2008,and approved this
16th day of June 2008.
