AN ORDINANCE TO AMEND CHAPTER 300,ZONING ORDINANCE,CITY OF
WAUKEE,IOWA,BY AMENDING SECTION 301.11,"R-l"SINGLE FAMILY
RESIDENTIAL DISTRICT,TO INCLUDE PROVISIONS AND REQUIREMENTS FOR
THE USE OF TEMPORARY ElJTT,DINGS FOR RESIDENTIAL LOT AND
SUBDIVISION SALES
BE IT ORDAINED by the City Council of the City of Waukee:
Section 1.Chapter 300,Waukee Municipal Code,Zoning Ordinance of the City of
Waukee,Iowa,Section 301.11,"R-I"Single Family Residential District,is hereby amended by
deleting the word "temporary"and "job office and"from Section 301.l1(B)(7)so that said
section reads as follows:
7.Use of a dwelling structure within a new subdivision as a real estate office for the
subject subdivision,which use shall terminate upon completion or abandonment
of the project.
Section 2.Chapter 300,Waukee Municipal Code,Zoning Ordinance of the City of
Waukee,Iowa,Section 301.11,"R-I"Single Family Residential District,is hereby amended by
inserting the following as Section 301.II(B)(8)and renumbering each consecutive subsection in
numerical order:
8.Use of a temporary building within a newly platted subdivision with a minimum
final plat size often (10)acres as a real estate office subject to approval of a
temporary site plan.A temporary building permitted to exist shall be subject to
the following minimum standards and requirements:
a.Temporary building shall be designed to be compatible with a residential
neighborhood including,but not limited to,the use of pitched roof elements
and exterior building materials customarily used in residential development
which may include stone,brick,vinyl or wood lap siding.Skirting shall be
provided around the base of the temporary building to match the exterior
building materials provided on the building structure.Metal skirting shall not
be considered an acceptable material for purposes of meeting the requirements
of this Section.
b.Temporary building shall meet all building setback requirements of the
applicable zoning district.
c.On-site parking areas constructed for use by visitors to the temporary building
shall be constructed of asphalt or concrete but shall not be required to provide
concrete curb and gutter.
d.A minimum of twenty (20)percent open space shall be provided on the site.
A minimum of one (I)tree and six (6)shrubs shall be provided per every
fifteen hundred (1,500)square feet of required open space.

e.Temporary building shall not be permitted to be constructed within any
Planned Development Overlay District that has an underlying commercial
zoning classification.]f.Temporary building shall meet all minimum requirements of the building code
as adopted by the City of Waukee.
g.Any proposed signage shall be subject to the requirements of Chapter 305:
Sign Ordinance of the City of Waukee.
h.The use of the site for a temporary building shall be allowed for one 91)year.
Prior to expiration of the temporary site plan,the applicant shall be allowed to
request approval ofa one (1)year extension of the temporary site plan,but in
no event should the extension be granted if the granting of the same would no
longer be consistent with the surrounding built environment,Chapter 304:Site
Plan Requirements and Paragraph 8 of this Section.
I.A cash deposit or surety bond shall be provided in a form approved by the
Director of Planning in an amount sufficient to guarantee to the City the
removal of the temporary building and restoration of the site within sixty (60)
days after the temporary building site plan has expired.If after sixty (60)
days,no action has been taken to restore the site or premises,the City may
take action to restore the site by utilizing the bond or monies deposited or
other methods at its disposal.
Section 3.Repealer.All ordinances or parts of ordinances III conflict with the
provisions ofthis ordinance are hereby repealed.
Section 4.Severability Clause.If any section,provision or part of this ordinance shall
be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the
ordinance as a whole or any section,provisions or part thereof not adjudged invalid or
unconstitutional.
Section 5.Effective Date.This ordinance shall be in effect from and after its final
passage,approval and publication as provided by law.
